Case is complete but now checklist for minimum income requirement

9 posts in this topic

Just received a checklist AFTER case complete about not meeting minimum income requirement to sponsor the immigrant according to poverty guidelines. I don't understand! We are abroad so income is $0 but we are using a combination of cash and stocks to make up the $95k required for a 4 person household (3 x poverty guideline for a 4 person household as it's spousal). I have to bring more information to the interview. Why do I have to do this when I meet the requirement????

The NVC is suggesting you find one because sometimes embassies and consulates do not like assets.

it seems strange to me seeing as they make it a viable option to use assets in the instructions for the AOS. I only reported enough assets to get us over the 3 x poverty line. I will take evidence of all assets to the interview which hopefully get us over the line. Do they take into account your employment prospects? I am an elementary school teacher. Is this likely to give me any extra help in determining whether I will become a burden to the US govt?!

No they don't.

They "should" be okay with assets. I think sometimes it's better to line someone up, just in case they don't accept your assets.

I feel the same way as you do. My husband and I also have more than enough of the three times the poverty guidelines but have still been told we might need a joint sponsor. You just never know until you have the interview, it's totally at the discretion of the person interviewing you at the embassy.

Also, I already have a job offer for a management position once I enter the US but US immigrations don't care about that at all. It's so retarded!!! Ironically, on other types of immigration visas, they allow entry without any financial proof or joint sponsor but apparently, for a spousal/fiance visa, it's super important to show proof of income/assets. :ranting:

By the way, I've heard that low fraud countries, such as Australia and Scandinavia, usually do accept assets instead of income, so fingers crossed. :)

125% of the poverty guideline in INCOME. if you use assets, as a spousal visa, you can have 3x the assets that make up the difference. (Other visa types besides for a child or spouse, or if a joint sponsor is needed, is 5x the difference.)

It's in the I-864 instructions.
