Hello,

Please,do I need to file my tax as single or married, because my wife still oversees and never been at USA , no SSN for her.if I file it single could be an issue?

If you were married as of Dec 31st, you can not legally file as single.

You can do married filing separate and mail it in. You dont need a SSN from her for that. Filing single is a horrible mistake.

You can hand write "NRA" in the place for her SSN, then send the forms by mail to IRS.

You can apply for an ITIN if you want to file married/jointly and have all proper documentation required, but seeing as how you aren't aware of this, I'm guessing you don't have all the forms signed by your spouse. 

 

So married filing separately is prob the best way to do it. You can't file online, have to mail a paper form. You can always amend it later when she gets SSN or ITIN if you choose to.

I have not gone through the NVC stage yet but I am told you need to submit tax transcripts for the past three years. 

If you are not working how will you be showing proof of your ability to support your spouse? 

Will you use a co-sponsor?

Sounds like you need a joint sponsor .  You have to show current on-going income to sponsor your wife.
