Hello everyone. My husband's case is in AP in Afghanistan in US Embassy since October 2015. Its been 2 years and 2 months now. It is very frustrating. Is there anyone with such experience? I contacted the embassy more than 30 times and they say we should wait. I contacted congressman thrice and it didnt help. I dont know what to do. I have a baby 1 and a half years old US citizen. But still nothing helps.

Filing a writ of mandamus in federal court would be your only recourse at this time, other than waiting further.

But my lawyer says that i can not file it because it is only for casea stuck with USCIS or NVC. And my husband's case is pending in US embassy in Afghanistan.

Thank you for the valuable information and links. Have you experienced it or anyone whom you know? How much chance is there that it will be approved? And what is the approximate fee for the lawyer?

By their nature, WoMs filed in immigration matters are extremely rare. They are a last ditch 'hail Mary' move when you've been languishing in the system for years and nothing else (congressional involvement, and contacting the CIS Ombudsman) has done anything. 

 

A lawyer will charge several thousand dollars to file a WoM. There are guides floating around online written by people who filed pro se (themselves), but it's far from straightforward and should only be attempted if you're extremely comfortable with legal procedures and also completely fluent in English.

Thank you. We are looking for a good lawyer and have decided that we will file the rit of mandamus Inshallah. Hope we will get a positive decision from the embassy.

I have filed a Writ of Mandamus. Michigan allows people to act as their own lawyers. After a lot of study I filed the writ myself without the expense of an attorney. Contact me and I can discuss it with you in more detail.
