Concurrent filing of I-130, I-485, I-131, I-765 | Couple of Questions

Hi Everyone, 

 

We are about to file AOS from Visa Waiver, I am a naturalized USC and my spouse is from Germany

 

Here is a timeline:

 

07/07/2015: Spouse Entered US on a J-1 Visa

08/03/2016: Spouse Left the US

11/22/2016: Spouse Came back to the US, Visa Waiver with planned return on 1/17/2017

01/10/2017: Proposed

02/22/2017: Married

 

Right now we are trying to figure out how to structure our package, here is how we have it planned so far.

 

I'll be using paper folders to separate the I-130 package and the I-485 package

 

------------------------  I-130 Package  ------------------------
1.    Payment check for $535.00
2.    Cover Letter. Signed and Dated
3.    Form I-130: Petition for Alien Relative

3.    Form I-130A
4.    Copy of ALL pages of the US Citizen's passport.
5.    A copy of petitioner's proof of naturalization
7.    A copy of the intending immigrant's birth certificate along with certified and notarized translation
8.    Certified Colorado Marriage License.
11.    G-325A filled out by the US Citizen, signed and dated.
12.    Two passport style photos of US Citizen
13.    G-325A filled out by the foreign spouse signed and dated.
14.    Two password style photos of Spouse
15.    Evidence of a bonafide marriage

15.    a. Sub-lease from USC to spouse?

15.    b. Various photos over the course of a year showing my parents and spouses parents (they visited us while she was in the US)

6.    A copy of spouses birth certificate along with English translation.
7.    Certified Colorado marriage License
10.    Two passport style photos of Spouse. 
11.    G-325A filled out by spouse, signed and dated
13.    I-864, Affidavit of Support
         a. 2015 Tax return

         b. 2014 Tax return
         c. 2013 Tax return
14.    I-765, Application for Employment Authorization

         a. Passport Biographical Page of Spouse

         b. Two Passport style photos of Spouse
15.    I-131, Application for Travel Document

         a. Passport Biographical Page of Spouse

         b. Two Passport style photos of Spouse

We also had some questions, I'm not sure if we are allowed to ask multiple questions per thread though. If not, let me know and I'll take them down and post other threads.

 

Q: The new I-130 instructions from 02/27/2017 have no mention of a G325A, are they still needed?

Q: My spouse has an A-Number from her previous J-1 Visa but we are adjusting from a Visa Waiver, should we put the J-1 Visa A-Number on the forms or leave it blank?

Q: For the Bona-Fide proof on the I-130, I signed the lease before my spouse came back on the VWP. I am allowed to sublease however, would me subleasing to my spouse b enough proof that we are living together? 

     We have also opened up a joint bank account recently, but since she doesn't have a job yet we haven't used it.

     The only other thing I could think of is adding her on one my credit cards and submitting a verification of that as proof? Any ideas?

G325A is needed if you use the pre-2017 I-130 form.  If you use the 02/2017 version of I-130, G325A is combined into the new I-130 (which is why it's so long): http://www.visajourney.com/forums/topic/628526-2017-checklist-for-cr-1ir-1-spouse-i-130/

No need for G-325A with the new I-130/I-130A combo, but you will need the beneficiary G-325A with the I-485

 

The A-Number is like a social security number, it doesn't change, so you should use the one from their old visa

 

For verification you can also add her on your car insurance, health insurance, add her as the beneficiary on your life insurance and retirement accounts through work

04-10-2017 RFIE letter received for birth certificate (that we already sent)

04-11-2017 InfoPass and mailed RFIE response

04-19-2017 RFIE response received by USCIS

04-21-2017 Biometrics appointment

06-08-2017 EAD/AP approved (day 80)

10-03-2017 Sent online case status inquiry for I-485

11-06-2017 InfoPass appointment about case status 

12-05-2017 Requested case update from Congressperson's office

01-22-2018 Interview!! Approved on the spot

Thank you! I just added her on my car insurance. Only ended up costing $78 more too :D

 

She just reminded me she never had an A-Number, I guess I was thinking about my old A-Number.

Did you add the G1145? The e notification form?

Hi Guys!

I am in the process of filing concurrently (i130 + I485) for my parents. And I have couple of questions if someone can guide me better...

1) I am sending forms I130, I485, G1145, I131, I765, I864. 

Do I need to send G325a and I130a also? Some say no need for g325a (biometrics) anymore but some say we still need it. Also not sure what the form I130a is for? Needed only for spouse or for parents also?

2) For the I864- sponsorship document, can my husband be the primary sponsor? or he can only be co-sponsor? Reason being- I am still a student with no income but me and my husband file our income tax jointly so the household income still is above the poverty line.

3) Form- 693 can be sent later, correct? The medical/immunization record?

4) In form i130 - as a student, should I mention my employer name as my current university address and details or just mention unemployed?

5) Wasn't sure if we need to write the Beneficiary's name and details in their native language in Part 4 of form I130 Q57-58? Just hand typed?

 

Sorry for so many questions. Just wanted to be sure. Really appreciate the responses.

G-325A is an obsolete form (for AOS). It isn't required for either I-130 or I-485. It was first removed from I-130 (w/ addition of I-130A), then, later this year, they removed it from I-485 too. Your packet does not need the form. If you had additional addresses in the last five years, just use the attachment page at the end of the form (copied as many time as you need).
