Just got married on an expired Tourist Visa, what now?

Hello everyone!

I just got married and I am clueless as what to do in order to change my status in the US. Why a do I need to submit to start the process and where do I need to send it to? Also, when it's convenient to sent the paperwork?

Check out the I-130 Adjustment of Status guide for couples with both individuals living in the US.

If successful, this will end with you getting a green card. In the interim, this process can also give you work authorization and the ability to travel (depending on the forms you file in addition to the I-130).

There are a lot of parts to the process, so take your time with it.

Thank you! After reading the guides I am still a bit confused. Are both forms, the one filled by me and the one by my husband, supposed to be sent at the same time? Also, I signed the marriage certificate with my new last new, will I have to change my last name or can I still use my previous last name to do the forms?

Because you are both here in the US, you can file all the forms at the same time. If you were outside the US, it would work differently.

To be honest, we completed AOS a while ago and we used a lawyer so it is all a bit of a blur for me.

Your best bet is to read the guide multiple times and read the forums. I am sure that any question you can think of has already been asked and answered in many different posts on VJ. By reading these before you post your own questions you will actually understand the process better.

I also recommend having your spouse join in on the fun. Two heads are usually better than one when trying to understand something as complex as this.

On the bright side, it might be a complex process but a lot of people have gone through it without the help of a lawyer. It will take time and effort but you can definitely do it. :)
