For k1 fiancee visa 100% or 125% of the poverty guidelines?

Hello again guys, I have another question. So i finished putting together the i-134 affidavit of support form. Now what is the income requirements i have to go by, is it the 100% or 125%.?

We are a family of 6 and i make around 34,000 yearly. Will i be ok or no?

Its 125% unless you are in the military and then it's 100%

K-1 Jan 2016 Applicant timeline.

I-129f sent to lock box 7th January 2016.
Delivered 11th January 2016.
NOA1 sent to CSC January 14th 2016.
NOA1 Hard copy January 21st 2016.
RFE email 10th March 2016.
RFE hard copy - 21th March 2016.
RFE Evidence sent- 4th April 2016.
RFE Received by USCIS- 6th April 2016.
NOA2 Received by email dated 18th April 2016.

NVC Recieved- May 9th 2016.

Nope you'll need a co sponsor 6 would need nearly $41k

You said before you make around $34K. Now you say that you made $50K. That's a big difference. What do you actually earn? What did you show on your 2014 tax return? Will your OT and holiday pay continue at the same rate in 2015?

Well last year i made $50,000, but thats with the overtime and holiday pay. My base salary without overtime and holiday pay is 34,000 yearly, so how would they go about my situation to measure my income with the 2015 poverty guidelines? I have a family of 6 including me.

You'd need proof that you would indeed be able to receive this level of income. Pay stubs, employment letter, taxes etc

I have my tax transcript for last year 2014 stating my income at 50,000 and also have my paystubs. The only thing is my employment letter my boss wrote for me states i make $34,000 yearly. Im so confused i really need help

Did you receive the OT n holiday pay for this year? If so have your boss write another letter stating that addition which is above your salary and that you do receive the OT n holiday pay yearly. Hope this helps.

Isn't it 100% for the I134 that you take to the K1 interview and 125% for the I864 for the AOS? Not that it matters, but it might buy the OP a little time in case he needs to get a 2nd job to be over the requirement. What country is this for?

No, since the K1 has immigrant intent and leads to the Adjustment of Status where the 125% amount is used with the I-864, most embassies use the 125% number with the I-134.

I'm having an issue with this too. My fiance worked part-time for the year of 2014. So his income is over than 100% but doesn't meet 125% [only $1000 more]. He is a full time this year and currently make it over than 125%. But as we know we have to wait until the mid of January 2016 to get tax return for 2015, it's a bit make me worried. However I'll go for an interview in November with the fact that his income in 2014 doesn't meet 125%. I will just get additional documents like his 2015 pay stub also letter from his boss to confirm his salary. Would this help? Or should I just wait until next January to go interview?

My K1 visa journey △ ( My process took 90 days until the interview )

14 August 2015 : Mailed I-129F through USPS express service

02 September 2015 : Received NOA1 hard copy by mail.

05 October 2015 : Case number was assigned.

20 October 2015 : Packet 3 arrived in my hand.

03 November 2015 : Got Packet 4 e-mail from Bangkok embassy about the interview date.

18 November 2015 : Visa interview and it was approved!

20 November 2015 : Got documents and a passport with K1 Visa back in my hands

12 July 2016 : NOA1 for AP and EAD  / 14 July 2016 : NOA1 for AOS

26 July 2016 : Got Biometric letter

09 Aug 2016 : Biometric appointment

07 Oct 2016 : AOS case was approved. Without interview!!

13 Oct 2016 : card was mailed to me

I think with a letter from an employer and also your pay stubs you should be fine.

I had the same question regarding my situation and was told on a thread where I asked that same question that letter and pay stubs was considered enough (at least by the 2 people that responded that had applied and been approved with a letter and 4 to 6 months pay stubs).

My interview is also in November...or I would let you know how I fared :)

I also was told this by the Vancouver Consulate but I'm not sure if it would be the same at any other consulate: "Evidence of support is usually requested by the consular officer. There is, however, no absolute requirement that an affidavit of support or other public charge documentation be presented. It is only necessary that the consular officer be able to conclude that the alien is not likely to become a public charge. It would not be unusual, therefore, for a healthy alien of working age, applying alone, to be able to establish eligibility during the visa interview without the need for substantiating documentation."
