I have a question about change of address of the primary sponsor (the USC spouse).

We sent the AOS and IV packages and filed DS-260 in mid-February. At that time my husband was unemployed, looking for a job and living with his parents in South Dakota.

Since then he has found a job (today is his first day!) in Minnesota and moved there and lives with his friends.

My interview is scheduled to take place on May 10th.

I will have to provide new I-864 forms from my husband and my joint sponsor anyways, since we will have to include the new tax forms for 2015.

Can we update his current residence address in the I-864 form?

But if we do that, then it will be a different address than what I filled out in the visa application DS-260.

Is this OK or is it a problem?

All the documents that we filed with NVC in February show his residence address in South Dakota. The reality is that we will live in Minnesota and he already moved there.

Feb 24, 2020 - naturalization interview in Phoenix, AZ

Have your husband fill in I-865 form first. the same address can be filled in I-864. you can attach a copy of either USCIS acknowledgment of sponsor's change of address (I-865) or a copy of (I-865) form itself that will be sent to USCIS. it is required by the law

almost_umrican and Ryan H, thank you both for your replies.

If the address can be updated at the interview with a new I-864 form, does it mean the sponsor (my husband) still has to send form I-865 (change of address) to USCIS?

Here's are the reasons why I'm not sure that we should be sending it:

1. We never filed our I-130 with a local USCIS office. At the time of filing I-130 we both lived in Poland, so we sent it to Chicago lockbox (my husband's address in I-130 was our address in Poland). We only put his South Dakota address on documents sent to NVC later, when he moved back to USA. So I'm not sure that USCIS in Nebraska (where we would need to file the I-865) even has our case file at this point.

2. When I was reading other threads here on VJ forum regarding this issue, it was pointed out that the sponsor hasn't technically sponsored the immigrant until the immigrant moves to the US, and therefore filing I-865 would only be necessary if the immigrant is already in the States, not before they immigrate.

In this thread: http://www.visajourney.com/forums/topic/544927-change-of-address-after-submitting-ds260/ it is suggested to update the address at the interview but also to call NVC or email them about the change of address. But does it make sense to call NVC if our case is already complete and at the Embassy stage?

No you do not send the I-865 until after the beneficiary has immigrated and THEN you move. All address changes before POE can be done either at interview or POE. After that point you need an I-865 and AR11
