Waiver for multiple filer

The new I-129f form a pile of new questions to answer. Looking at the instruction sheet that can be read to help fill out the form ( Page 3 Part b. Available waivers ), applies to my situation. I am a multiple filer. I have previously applied for and received a K-1 visa less than 2 years ago. The beneficiary came to the US, we married in the 90 days, but then for various reasons she returned home. I have since divorced her which was not too complicated given the fact we were married for only a short time. I have met someone else that I feel is a better match for me in many ways and want to bring my new fiancee here to the US.

The question then is in regard to requesting the waiver. The instructions are asking me to explain why a waiver is appropriate and to provide evidence in support of the waiver. Then the instructions give examples of "evidence" to supply... well none of the examples are appropriate for my case. We just decided it was best if she went home and we not continue the relationship. Not complicated at all. So how do I explain this adequately in order to be granted a waiver?

provide solid evidence to show that she aint in the US and that she travelled back home,not sure what you show to prove that though #just my thought#

Thanks, I had already read that thread.

Also, the divorce papers that she signed were notarized in Thailand, so I would think that is a sure sign she is not in the US.

Here's an actual letter with pertinent info left out. Which is actually good: You want to be proactive and attached the waiver request as part of the initial I-129F filing, thereby, avoiding delays. If it is originally left out you will surely received an RFE. Good luck!

So, I want to make sure. I filed my last I-129f in 2006, the instructions state less then 2 years, does that mean I am not a "multiple filer"?

Yes that is correct you do not need a wavier!
