My suggestion is to hire a lawyer if you plan to adjust status while you are still in US. I have read that for you to be able to adjust status, you have to have a current status (K1, student, tourist, etc.). Since you are overstaying on a tourist visa, you don't have a status anymore. Good luck!

Much cheaper to skip the lawyer and just file the form to get a replacement I-94: http://www.uscis.gov...00045f3d6a1RCRD

Saw the same link. Didn't know if they would replace an expired I-94 (couldn't find anything on USCIS website one way or the other). Hope someone comes along who has experience with it.

Overstay is forgiven for the spouse of a USC.

thank you jay-kay

i'm worried that i'll somehow mess it up. is there anything else that i should know about?

Follow this guide. http://www.visajourney.com/content/i130guide2

Read all the instructions for the forms.

Check out this forum and ask any questions there you might still have along the way: http://www.visajourney.com/forums/forum/130-adjustment-of-status-from-work-student-tourist-visas/

If you still do not feel comfortable doing it yourself, then hire an immigration lawyer and not just any general attorney.

Yes they will. You can do a search for it here on VJ.

The above post is exactly right. Overstay will be forgiven. Do NOT leave the U.S. during the process.
