  1. I don't agree with this at all :no: Their K-1 Visa is only good for 90 days - once that expires, they are out of status. You are technically supposed to file for AOS BEFORE the 90 days is up. That's why they say to file immediately after you get married. I know some people have waited, but I don't recommend it.

    This is what it says under FAQ for Adjustment of status:

    6.1)...How soon after we get married should we apply for Adjustment of Status?

    A..Right away, or at least right after your honeymoon. You should make every effort to get the Adjustment application filed within 90 days of the fiance(e) entering the United States, which is when the K-1 status expires, as indicated on the I-94.

    Filing for Adjustment of Status within the 90 days protects your legal status. Your legal status as a K1 expires after 90 days, married or not. The only way to protect your legal status is to apply for Adjustment of Status, and the only way to maintain continuous legal status is to file for AOS before the K1 visa expires. On the practical side, it is often difficult to arrange for the marriage, and get all the paperwork ready in time to file for AOS within 90 days. Many newsgroup couples have filed for AOS a few days or weeks after the 90 day limit with no problems. Thus far, newsgroup experience has shown this is not a major issue with local USCIS (INS) offices.

    There is absolutely no "technical" part to filing AOS and there's is absolutely no mention of a filing date before then. It is "recommended". TRUST ME, I have done research upon research on this. There are maaaaaany couples from all sorts of countries that have waited well over the "90 day period" and never had problems. Now, for us....OH I'm quite sure we'll have issues, just because that's "my luck" and nothing is ever ever an easy road for me.

    You file for AOS so that the SO can be legally working, driving, etc etc.

    Shauna, it just depends on your situation. Yes there is nothing written in stone, BUT I also agree w/Rhonda filing the AOS w/in the first 90 days is in best interest. God forbids something happens in JA and he needs to leave ASAP b/c he was "out of status" he could cost him problems to come back EVEN though he may have a AP on file. I say to do it ASAP so he can work and travel (if needed). If your having money issues now having him here adding more expenses and not being able to contribute will only make the finances and the adjustment period even harder to bear. Just my opinion.

  3. I usually take US Airways with an layover in Charlotte, NC or AirJamaica. I haven't any had any major problems with either carriers although I love AirJamaica...only a 3 hour flight.

    I LOVE non-stop flights. You save soooo much time that way and it's especially nice on the way back going through customs. I wish Air JA flew out of Detroit. Northwest is the only airline that sometimes has non-stop flights from Detroit to JA and even if they're more money, it's worth it to me :yes:

    I feel the same way. I rather pay more then to take a connecting flight no matter where I go.

  4. I am new here and trying to absorb all this new immigration info. How do you log on to find out when you've been touched? I have read all aver and see where touches were noted but can't find info on how to do so. :help::help:

    The only way to check your status at the NVC stage is to call and speak to a C/S/R or the automated line. Also I noticed on your timeline you are waiting for the DS-3032 (Choice of Agent) form to reach JA. Well good luck w/that b/c we all know how the mailing system is down there esp now after Dean. I would advise either you or your husband send an email to NVC assigning you as the choice of agent. My husband doesn't have access to the net so I emailed them myself via my email acct and I recv'd an email accepting it 10 days later.

  5. I'm in the process of filing K-1 for my fiance in Jamaica but have a friend who's also just starting the "process" and is unsure about which petition to file. Here's the scenario.....

    She met and got engaged to a man from Jamaica who is already working here in the States on a work visa. His current visa expires Oct 2008 and she's unsure if they should be looking at a K-1 or a K-3 later down the road. They want to eventually get married but don't know if they are legally allowed to do that while he's already here or should they just wait until he's no longer on the work visa, wait till' he's back in Jamaica....then just file the K-1?

    I've heard mixed things about all of this in the past and wasn't really sure what to tell her. It seems like it would make sense for them to get married while he's here - even if he has to return to his country for her to file the K-3 but she wants to make sure she's doing everything on the up and up.

    Any advice I can give her would be helpful! :)

    Did she meet him before he came to the US? If they get married while he is here on work visa, they will have to prove that they didn't know each other beforehand. I have a friends that did this with their work visa - he stayed in the US even after his work visa expired and to be honest I am still surprised that they were granted approval. It's a tricky process, the Yardie thread and other threads here on the board will be of more assistance.

    Actually it's not really that strange. Ton of my friends all came up on visitor visas and overstayed. Most of them got married and filed for the AOS and others are just here. As long as he can prove their was "no intent" then everything will work out. I have a cousin who just asked me the same question b/c her friend from IL needed some assistance.

  6. Don't let the NVC confuse you. All you need are either: 1. tax transcripts from the IRS (no W2s needed). OR 2. copies of tax returns WITH copies of the W2s. That's it.

    I'm getting my I-864ez packet together I was thinking of attaching a copy of my federal return along w/the W2. However, on my return I filed MFJ and in the SS# field for spouse I entered "ITIN Applied For". We recv'd the actual # via rep @ IRS but nothing in the mail. Will that be enough? I tried requesting the actual docs to verify the ITIN but never recv'd anything. I was able to go online to the IRS website and print off the status page which states both my ss# and his ITIN. Should that ok? I also sending the following w/my packet.

    Employment letter

    Last six months worth of paycheck stubs

    2004 & 2005 Tax transcipts

    One year worth of bank statements

    Do I need anything else? Do I still need the bank letter since I'm sending the statements?

  7. Hubby was asking me last night how long it would take for him to get his passport with the visa. I told him about Kimmy & Kashi's time frame, but that a few people who did theirs a few days before the hurricane, still have not been blessed with theirs. I guess we'll see how long it takes for our early September interviews to get theirs back.

    FutureMrs., waynegeraldine, I pray that your SO's will have theirs soon.

    Maybe it's just me but I have noticing for quite some time now that CR-1 visa holders seem to get their visa a lot quicker then K-1 visa holders. Anyone see this pattern?

    Hi Ladies, I'm soooo upset right now. :angry: My daughter was suppose to come yesterday but the stupid ppl at KIN airport closed the flight so now she's coming home on Tuesday. Ordinally this wouldn't be a problem but now there charging me $75 for the change in flight. I cld Air JA reservation line and the lady told me there shouldn't be any other fees but of course it's out of jurisdiction. So I asked isn't this Air JA and she said yes but they don't cover the airports. So I asked her who does, the US :blink: Her dumb a** couldn't say nothing but pause. She evenutally gave me the # to the Airport and gave me 3 ext's for the supervisor but of course they were all invalid. I finally got thru the the rattid man asked me what I he to do....I swear I wanted to ugh.....so I asked for the supervisor and then was transferred back to a v/m. I "0" out and someone picked up but didn't say anything. You could hear the freaking ppl in the back ground!!!!!!!!!!! I cld back to back and all morning BUT still no answer. Me and Javon even got into b/c he don't seem to understand why I'm so mad. First off she' coming back late as h*ll on Tuesday and w/Air JA reputation most likely they won't get here until midnight AND she starts school on Wed. Not only that another $75 for sh*t. Man, don't get me started!!!!!!!!!

    I am so sorry that you are going through this Anna. Air JA has a tendency to close the flight and not say a word to you. They did that to me when I was getting married. Had the first flight out 2 days before my wedding. They closed the flight and didn't say a thing to anybody; I was at the airport til the next day. Someone gave up their seat for me on the last flight out the night after and my luggage didn't come for 2 days. My maid of honor never made it until after I was married. I was so mad and swore never to fly them again...

    There is no customer service, so my dear, it may be futile. It seems pretty crazy that a supervisor at the call center is unable to override the charges. They should have the same authority as the supervisors at Norman Manley.

    Right! Javon is telling me to drop it but I'm still upset. How are you going to charge me for something that is out of my control??? I went off on him this morning b/c of his "dunca" attitude but I quickly cld and him back to apologize. I know he means no harm but it's the freaking principal man!!! I also didn't want to stress him too much b/c today is his birthday.

  10. Hey everyone I need pointers on how to take as much stuff as I can with me to JA? I plan on paying extra for extra luggage, is this a good idea? Everyone needs everything and while I don't feel obligated to get everything, everyone is asking for something. :wacko: They all seem to be actual needs and I don't mnd, but I can't pay out the A$$ to get it in the country.

    Why do you need extra luggage, can it not fit in the two your carrying plus the carry-on? THe thing about carrying more luggages if you might pay twice. Once at the airport here for overage and another at the JA airport for gifts. I normally carry alot and just pay for overage (if I have to) but when I get to JA I say I have nothing for anyone.

  11. What is everyones thoughts on having your SO working before he gets the employment authorization....i mean doing some under the table straight cash kind of work? Do you think doing that would affect anything down the road....considering it is illegal (I think?????)?

    I don't see anything wrong it ppl do it all the time. If you need to work then so be it. I have a cousin who used to come up and work for months at a local JA'n resturant as a cook. He will leave a couple times during the year just to renew his visa.

    I know!!! I am so happy. Time flies when you're having fun. I have been down to JA 4 times in the last year therefore, time was just flying by us. But I am really happy about all my decisions and just glad that we were put together.

    It took me awhile to figure out how everyone had a time line because I was updating my time line and it wasn't displaying but then I discovered the updating of the signature and put 2+2 together. :wacko::wacko: duhhhhh

    how i wish i could go down there that often with trying to move i will only be able to take 1 trip back soon

    I know. Its really expensive and now I am trying to buy a house so thats why I wasn't going to go to the interview but I just feel like I have to be there with him. I would plan the trips over holidays

    i do understand about it being so expensive but i also plan on going for the interview

    Its a girls day tomorrow so if the weather is ok we are headed to navy pier then hit a club downtown and back to work sunday :crying: have fun at the party

    Nyseness - I was thinking of going to this show too. I've been to the Taste a few times and never had a problem except the last time I went these females got to scrappin real bad and then this dude licked this girl so bad...it wasn't cute at all. Mavado is the boss but his lyrics might have people bussin some shots in there for real...

    I don't care for the Taste either but it's mostly b/c of the area. I've been going to that place for years (used to go there weekly for Reggae night on Friday's). Maybe it's just me but I have been to plenty of parties and see girls fighting. I used to go out every weekend to different sound clashes and if that was ok, then Movado will be fine. Now since I'm a married woman I choose not to hang out in those parts BUT I do love to party. Fire Links is coming soon too.

    I was just taking a look at the new immigration fees (I know I'm a little late) but man! I told him that we are going to need some time before he comes up. He might have to wait like 4 months or so. They are high!! That is a sure way to discourage people from filing or at least fake filing. Thats crazy.

    What kinds of jobs have you all encourage your SO to go for once they come over on a K-1 or any visa for that matter? I have been looking in his field (certified plumber) here in Philadelphia but i'm not sure he will be able to jump right into that. He might have to go back to school for recertifications from here and all types of things. How long does it usually take for them to get a job when they first come over? Sorry if you are sick of answering these questions but i'm very very concerned!

I also have been thinking about the same thing and I think it just depends on your SO and what kind of training his has. For me I have a friend who is a recruiter at a local temp agency and hire ppl for a local co doing packing for 3rd shift. It's not the greatest job but it's a paycheck nonetheless. Javon wouldn't have it any other way. I'm thinking of maybe that and attending classes to get his GED. He eventually would love to go back to school and get certified in either carpentry or something else.

    Yea, that sounds like a good idea. I was thinking GED classes for him as well but he has a high school diploma from JA and completed his trade there also. The only thing is, are those qualifications comparable to the requirements needed here? I would hate for him to have to do it all over again but then in a sense it might be better to do so. I told him last night to request his transcripts from his high school so that I may ask around before he gets here. All of his work and school experience is from JA. I know that my cousin came up from JA about 6-8 months ago and she is working as a supervisor at a nursing home. Get this, she came up on a K-1 and did not get married. Long story short: It was an arranged marriage and the guy decided he didn't want to go through with it after she came up. Everyone is trying to figure out he she still is here...lol. But the morale is that she is working receiving a pay check and all and I know for sure she did not go to school here. So, I am assuming that their education back home is good enough. Have you heard anything about this?

    Yes it is. My brother-in-law came up and started working w/o any add'l schooling. It took him a while to find a job b/c he didn't have any US work exp but he got hired permanently thru a temp assignment. It just depends on your SO and how well he is experienced. Javon also have a high school diploma from JA but I still want him to get his GED.
