    If the USCIS think it warranted, then they will grant it. If the USCIS think it NOT warranted, then they will deny. Every person has a right to fight for his life and family. Good on him I say, and he should apply.
    I'm so very glad some people on this forum do not judge these decisions.

    Could that be because of the weekend? There are no April cases yet that I see either.
    I'm looking for cases to be called in later today. I think the DHL list will show shipments dated the 4th or 5th sometime tonight. Hopefully, ours and Jenny's will be on there. Is you case due to be sent I & M?

    My guess is, your case was inputted wrongly the first time around, and has been corrected. I am HOPING for you, that now, they are on it, and approval will be swift. Cross fingers!

    I'm actually impressed. It seems they HAVE got a rapid response thing going, and I suspect all the oddity emails are just corrections of previous mess ups. I wouldn't be surprised if they haven't got people from CSC down at TSC helping out on this.
    The one question I have is - why did they wait so long?

    Thank you, and all of you for your comments.
    One day we'll look back on these times with a lot of sorrow, but also with pride, because we have made so many friends during this epic struggle.
    They always say struggles bring the fight, and the best out of people, and I am proud to be a part of this little bunch. I get stress relief out of producing and playing music. It soothes the savage breast as Shakespeare said.
    Glad you enjoy it.

    I have noticed conflicting advice with regard to filing taxes whilst the spouse of a USA citizen is out of the country. This is the procedure we used. It is recommended that once married, for maximum financial benefit, the spouses file as married, filing jointly. The foreign spouse does NOT need to be in the USA in order to do this.
    Firstly, it is impossible to e-file, as e-filers need SSN's for both spouses. As the non USA spouse will not have an SSN, it is necessary to apply for an ITIN number.
    The procedure is as follows:
    Download IRS form W7, and the instructions from the IRS website.

    http://www.irs.gov/pub/irs-pdf/iw7.pdf
    The foreign spouse must complete the form, sign it and send it to the USA spouse complete with a notarized copy of their passport.
    On receipt, the USA resident has to file taxes by mail. I highly recommend Turbo Tax 2010, as this program allows a the IRS tax returns to be easily printed and filed. As stated above, you can NOT use the e-file feature, you print the tax return the old fashioned way.

    Once you have completed (married, filing jointly) and printed the return, gather your supporting documents, attach your foreign spouses completed W7 form to the front, and mail to:
    Internal Revenue Service
    ITIN Operation
    P.O. Box 149342
    Austin, TX 78714-9342
    You must do this before April 17th 2011. Once this is received, an ITIN number will be issued, and the tax form processed. You should get your refund in around 8 weeks, as it takes 6 weeks to get the ITIN number allocated.
    That's all there is to it.

    If you really are the one that got us approved and all the calling and e-mailing we've been doing and senator contacting did not really help .... can you do us a HUGE favor and get us through to the NVC so we can then have a case number....that would totally rock!!! Can you please do this for us because we seem totally helpless and we actually thought we 'may' have had something to do with the approval ourselves...but HEY...who knows.....maybe you are the GOD of approvals!! WOOHOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOO

    I looked into this. It is a bit of a minefield at the moment. It used to be very possible to do this, but, apparently not any more. Firstly, it is illegal to come into the USA on VWP with intent to marry. It is seen as visa fraud and carries a large ban. However, it IS legal to enter on VWP, and just meet someone, and then marry. In other words, you have to prove no intent. In the past, states have turned a big blind eye to this, but not any more. What is worse, is when a person overstays on the VWP, marries and then attempts to adjust status. Once again, in the past, the overstay was forgiven, and AOS was approved in most cases. Now though, in a lot of states, the AOS application is a license for the US government to deport the applicant as they are illegal. I think that may carry a long, or lifetime ban. Yes, some people get away with it, but from what I can gather, especially now, it is fraught with problems. There is no appeal system on VWP - you waive all rights to appeal, and a lawyer won't help. I preferred to do it the correct way. Imagine the stress of being in the USA, marrying, applying for AOS, and then being deported for visa fraud or overstay. In my opinion, it is not worth it. There are many many articles about this recently, and though it may have been easy a few years ago, it certainly isn't now.

    Sounds to me as if all us July filers HAVE been requested for EXAMINATION/PROCESSING.
    We were told exactly the same other than our date was the 28th December.
    REALLY crossing fingers they have been honest on this!!

    Has there been any plane crashes en-route from California to Texas?
    You're right though - something major HAS happened, as even senators cannot get through. Our latest call to a very nice Tier 2 person, when confronted with the lack of action on our expedite was that he couldn't believe why it hadn't been dealt with. Another officer told us that she would fax Texas on our behalf, and then said "Mmm - that's weird, they have removed the TSC fax number". Very strange, and worryingly puzzling. We hope now for a miracle of batch approvals.....
    Yes, we were told three weeks ago they were working on July 17th petitions....

    I am REALLY curious as to whether ANYONE has got ANY paperwork up to NVC from TSC. I don't think they have approved a single case correctly, and we were all transferred on the 2nd November. I think it is our right to know what is going on there. US citizens have paid good money for the applications - this is not a charity. USCIS have part of their wages paid by customers, and, as with any consumer service, at least have the right to know exactly where they stand.

    It's not easy to get your case expedited. We more than fulfil the criteria in at least three areas as laid down by the USCIS. It wouldn't be right to air those reasons on a public forum.

    We actually pay MONEY for this also, so we are customers. The luck of the draw I suppose, but it does sicken me that we are all in this little group. How very unfair, and maybe representations to congressmen/senators should be made. One thing that should always happen, is that the files should be processed in order - surely!!

    Quite a few people got the same email, though we didn't. No one seems to be quite sure whether it means you're approved or not. It may be wise to call NVC to see if they have issued you with a case number. If they have - you're approved.

    I SOOOOOOOOOOOOOOOOOOOOo feel your pain!!! My bottom is glued to this horrible chair in front of the PC.....my husband also tells me to calm down....but AGHHHHHHHHHHHHHHHHHH......I am going NUTS!!!! Two Jehovah's Witnesses came to my door earlier and I actually told our whole visa story to a couple of strangers....poor little old ladies, probably wish they had not come to the door.....GOD HELP US!!!
