Since there is a different mailing address for the federal return from the state return, should you make an extra copy of the W7 to go with the state return? If you attach the passport with the original W7 to the federal return, what would you attach to your state return?

His visiting would not complicate the I-130 petition, however, entering would be a bit "risky". He would be at the mercy of the customs at POE. If he's lucky, they'll let him through, otherwise, he'd be turned back.

The worry with the medical is how long it lasts for. Fill in your timeline so we know how far along in the process you are. You dont want the medical to expire before your interview, or you'll have to do it again.

Did you put them in some type of folder? Can I make 2 holes on the left side of the documents to put them in a folder?
Do not put any hole in your documents. I put all my documents together and put the in the envelope I mailed them in. No folder used, no holes, no stapler. When they get your documents, they will scan every one of them and sort them out into how they arrange them. Just stack your documents and put them in a sizable envelope and mail them. You do not need any folder.

Do not staple. I just organised mine in order and put tabs to differentiate the types of documents. I did not use any metal of any sort.

An update...but still a little confused.
I overnighted all of the documents that they wanted which arrived last Monday. During the week, they called our boss where my fiance and I originally met and worked together in Malawi to verify our relationship. Today my fiance stopped by to see if there were any updates, and they asked him to bring his passport and that they could call him any day when the visa was ready. But they didn't come out and *say* it was approved, and they *still* did not give him any slips of paper. I'm jumping for joy because I'm assuming that means that it's an approval - but I also am still fearing the black hole of AP. Would they have asked for his passport if we were going to end up in AP?
This means that they requested his passport for his visa. This is good news.

There is no real time limit. It depends on the CO period.
Example 1, A person on VJ met his fiancee and within one month asked her to marry him, he went there not knowing this woman for 30 days, he stayed there only 5 days, came home and filed for the visa. 6 months later they had the interview he flew back (only 5 days again) and were approved.
Example 2. I met my fiance (now wife) and we chatted for 9 months before I ever went to visit her. I stayed 15 days the first trip, came home waited about 2 months to file for the visa, and made 2 more trips. We were denied.
Example 3. A friend met his fiancee chatted for 3 months came to visit, went home and filed for a visa, 6 months later an interview they were denied, he came back (4th time) they got married, and they filed a CR1, this visa was also denied, all this time is now going on over 2 years, they just had their 3rd interview and were finially approved (4 years total)
As you can see, it truly depends on the CO, ours lied at the interview because he didnt like something about our case, and I have now been in Vietnam for an entire year and enjoying it. Some people can barely know their loved one and get approved, it all depends on the CO. There is no majic number of months or years, or even trips, the majic is all in the CO

Scott, you should be the first one to know that it is all up to the CO, and that many MANY people have gotten very lucky, which means it comes down to the CO, and NOT the HCMC consulate. If it were all about the HCMC consulate then many people would NOT have been given a visa. More often than not you are correct because it seems that there is a clear pattern, but to say it is all standard is a bit off base. They also use the cultural norms issue when the CO chooses to, NOT based on what HCMC says to do. How else could a person know a woman for less than 30 days, only spend 7 days together in a total of 6 months and then get issued a visa with the CO knowing they would have only had 10 days together total? If it was HCMC calling the shots and NOT a CO then they would have been denied. I also agree that people that dont know HCMC should probably not post as much as they do, but clearly this question was simply about a time frame being good enough to file, nothing about cultural norms, and if their relationship is real and they can prove it then they SHOULD be fine.

Thanks for all the responses, but I need further clarification.
When you go to http://nigeria.usembassy.gov/immigrant_visa_forms.html, you are not able to click on the link for the K1 forms (packet 3). So far I have taken care of Medical and Police issues. My question is what specific files are included in Packet 3 and 4 because I can always get them online once I know the file name or number.
So in short, I have the Medical, Police cert and I-134. What other specific forms do I need?
Also, does the co-sponsor use I-134 or I-864?

actually I don't oppose k-1 at all. the thing we are worrying about is how likely my fiancee will get her k-1, if we decide to choose k-1.....
Mind you, you have to be married first and obtain a marriage certificate and other documents of proof before you file for the CR-1. You would include the evidence of your marriage with the I-130 petition for your CR-1.

Hi there,
I am US citizen, my fiancee is Chinese citizen. After we did some basic research in this wonderful web site, we find out that the average processing time for CR-1 is 9 months. But it takes much less time to process K-1 visa.
So we want to decide which way we should proceed; cost and all the hassles after she arrives in US through K-1 are not problems to us.
which way should we choose? How much chance will she get K-1 visa if this is the way we wanna go?

The choice is yours to save time or money. The K-1 route has more hassle and expenses but the time difference is not that much anymore. It's your call!

thank you so much guys for you advise. To the glory of God i call USCIS yesterday and asked to speak with a tier 2 officer and i complained about the problem that i was having and the lady sent in a service request on my behalf, only for me to get an approval notice on my case status this morning, am so excited beyond words. But as we all know this is just the first part, now my new question is do i need to get a new immigration letter from my bank (i submitted an I-134 with an immigration letter from bank in September 2010 with my initial I-129F application). thanks

Even if she gets a visa to visit while the process is going on, she is at the mercy of the IO at he POE. there is no guarantee she'll be allowed to come through. It might be easier for you to visit her instead, while your petition is pending.

The K-1 used to be faster than the spousal, but not anymore. You are better off going for an IR-1/CR-1 visa as it is much less expensive and much less hassle. The k-3 is supposed to be phased out but from time to time I see someone on the K-3. The K-3 was supposed to be a kind of intermediate between the K-1 time and the IR-1/CR-1 time, but is purposeless since the times are about the same now.

The main requirement for you is to get married within 90 days of his arrival. If you don't meet the income requirements for the AOS, wait until you have found either a new job or a co-sponsor before filing. There is no time requirement for AOS, yet your then husband can't work until your AOS has been filed and he received his EAD or Green card.
