Thanks, so he would fall under all others with a date of march 2007. Appreciate the response. Any other ideas on categories he could apply in or any categories that might be more beneficial coming from Canada?

Thanks, so you are saying country of birth does not matter. I was asking because I heard other visa categories consider it, for example h1b etc.

Hello
Like the title says, wanted to see if it helps to have been born in a country that doesn't have a long wait time for an i130 application for a sibling of a USC. I wanted to apply for my brother who is of Indian origin, but was born in the United Arab emirates and currently resides in Canada. He is able visit us but I would like for him to join us here since he is the only sibling who was left behind due to crossing 21 years.
Or there is another way I can bring him over permanently?
Thank you

Thats sad. I didnt know the petition would be voided the day he got married.
I was hoping it could be changed/upgraded/downgraded or something so he doesnt lose his place in line.
Oh well.
So now I need some more advice on what the best approach would be next.
- Have my dad apply for naturalization and then apply for my now married brother. What's the wait time on this for CSC and NVC?
- I am a citizen brother. I could apply for him. Again, not sure about wait times.
- Have him come over here as a tourist and apply for an I-130 and an I-485. Is this even an option?
Thanks everyone for the quick replies!

Hello All Gurus out there!
Here's the scenario:
My dad is a Lawful Permanent Resident (LPR) who filed for my brother when he couldnt join us due to being over 21 at the time our visa was issued.
The priority date is 2nd December 2004, and category I believe is F4.
Back then, my brother was in India and unmarried.
Right now, he is in Canada, married and has 2 lovely sons.
We looked at the current dates on visa bulletin and noticed its at 15September 2004!
But sice so many things have changed, I'm not sure what the course of action should be.
My brother is no longer unmarried so I dont know if he is still eligible under the same category or if we need to upgrade/change the petition. We definitely dont want to lose the priority date!
Also, my father may apply to become a US citizen this year, so what does he need to do to upgrade the petition if he decides to naturalize. Or what we should do if he decides to stay LPR.
Any help is greatly appreciated.
thanks!

Those who already went for Biometric appointmetn and got it done.Has anyone got anything yet...letter...anything? What should I exect to recieve....and how long it usually take? I got my BIOmetrics done on 10th August, Should I start looking for any letter soon?
I was wondering the same....
What's the next step? And if there is no letter sent out, what is the current processing time at both service centers?
-
One hour is crazy!
Maybe that's why they are so busy!
We did my wife's bio the other day, and it took them all of 10 minutes after they called her number, and maybe 5 minutes of waiting before that.
Hope you are able to reschedule at a convenient date.
And good luck with baby!

Heading to biometrics in an hour...

I made a mistake while sending in the form.
I checked the box saying we lived at a different address but didnt provide the previous address on a separate paper as specified.
I did go online and fill out AR-11 and asked them to apply it to the I-751 that's pending, but now I am not sure if it will cause any issues/delays.
Ideas?

Anybody has any comments?
Looks more than enough.
Way to go!!
-
A couple people here asked if affidavits are necessary.
The affidavits are one of the things the USCIS lists in the instructions document as an example for proof of ongoing relationship, so I would highly recommend sending them along with the application.
My 2 cents...
Edit...
This is how its worded: "The documents should cover, but not limited to, the following examples:"
1) Birth certificate of children if applicable
2) Lease or mortgage documents
3) Financials (Taxes, bank accounts, insurance policies, utilities etc.)
4) Affidavits
5) Others

Looks like my check was cashed today, has a date of 07/09/2012.
The memo on my bank account says "CSC FIELD OFFIC".
Hope to get my NOA1 soon.

Hi all,
I am getting ready to send our package shortly. I have a question for you, when you send bank statements and tax returns, do you only send the first page with both of your names on there or all the pages?
Thanks!!
I sent the whole bank statement, which for me was only 2-3 pages each.
I also sent the whole tax returns, including W2s, which I would recommend unless you are getting the tax transcripts from IRS.

Hey ya'll. I been gone for a bit. How's everyone?
-
Hey,
I was looking through my NOA2 to see where the A# is, since I was planning on taking it with me as "extra proof" of my A# tomorrow, but I an't seem to locate it. Anyone knows if it actually is in there and where on the paper if so?
I thought they wrote your A# in your Passport at POE....
-
Sorry to hear that! I haven't been on here lately. What's going on now? I hope she received the visa.
Hey, where have you been?
It really has been a while. Coz my wife sent them in the evening on the interview. got a reply the next day, and received here visa-stamped Passport after two days. So everything worked out ok. I have booked a flight for the 16th of July and will head back with her on the 24th. So good news all around.
How have you been?
-
I will say go with Fedex or Ups.I do not trust Post Office no more.Especially in third world countries, the postal employees steal almost anything. In 2007 when i got married i had to send hubby a few more wedding invitations and lo and behold the invitations were stolen and he only got the bare envelopes..So pay aliitlle more and use Fedex or UPS.
I second that opinion...
-
hey sean john my wife interview is on the 17. my question is when they sent you your packet 4 did they ask for the tax papers or not. because i sent my paper work to nvc and the checklist says they have received it. so should i still send her a copy or what?
The checklist they sent for the interview said I shouldnt have to provide anything I have already provided to the NVC. But I Still had her take copies of evrything we sent to the NVC. I would advice you to do the same. Just scan the taxes and W2s and send them over and she can print them out there.
Good luck!
Does birthplace matter for i130?
