Yes, unpredictable is putting it mildly. The Ciudad Juarez consulate just gave visas to two cocaine users after they served their 3 year bans. Both only brought 1-2 urine tests to show as proof of their "rehabilitation" - and both received their visas. My fiance took a few puffs off joint once in Dec 2006, we served our three year ban and came back to the embassy armed with 16 clean urine tests. We however were told to come back in another six months and to attend further AA or NA classes for "behavior modification" - now we are going back in August, I wonder what run around we will get this time? Just remember that the people that work in the embassy are just paper pushers, equivalent to going to DMV, you are just a number folks so don't think anyone is going to look at your case with any kind of concern, they only know how to push paper.
Hi TwoInLove, I know exactly what you mean. My fiance went for his interviews which included the waiver one and was told that we had to send in more hardship evidence as well as his criminal record from here because of the DWI's he

Hello again!!! Well finally today i send my first pack
(help me god) and i have a question . . in Mexico is easy get the letter of non criminal record , but for one i need to travel . . i have some free time now so i was thinking in go, get the letter and back for find a job with out quit for go . . But maybe my interview is 5 months away (i hopefully less) so . . i dosent matter the date of those letters? Or they must to be "Fresh" documents?
I can have it in one day but i live far away from one of the places that i was living since 16 years old . . Should i go for it? Just wait a little bit more?

Hi Keka and congrats on sending in your package!! Well, my husband to be is from Mexico but he didn't to get the criminal record. So I'm assuming that you're not going to need it. But its always better to be safe than sorry. Hope this helps!

Ok my fiance has his waiver appt this morning. He called me and said everything went good that his appt was for 9am and he was back home by 10:30. I of course asked what the officer said to him and he said nothing just asked for the waiver papers and hardship letters. Then she just said ok just go to the DHL. At the DHL window they got him to fill out a couple of papers and asked for his passpot, gave him a number to call and said to give it until this coming Friday and he should get a package with paperwork.
My question is what does that mean? Does it mean that he's got the visa or no?

I have red in the forum that some embassies have unwritten rules if the USC is not present at the interview. I called the embassy in Bulgaria and the officer was surprise that I am asking the question Could the USC be present?
She answer me that the interview is for the beneficiary not for USC.
Any opinion ?
Hi! Well, I'm not really sure how most embassies or consulates do the interview process. However, my hubby to be had his interview around the 16th of last month in CDJ and the officer requested that I the USC had to be present. So I'm assuming that yes the USC has to be present.

Morning VJers, ok we filled out our paperwork over the net or rather I did. The things that I didn't know I left it blank so he could fill it in in BLACK ink whenever he got the package in Mexico. For anyone that is planning on doing that DON'T. He went into the consulate because the receptionist at the medical clinic said they couldn't give him the medical without the letter (stupid on my part). So anyways he went into the consulate and asked for the letter and the guy that helped asked for his paperwork and then said that they couldn't take it because it was written in INK, that it had to be printed off the computer!! So he (the guy inside the consulate) said he would fill out the package paperwork and medical and fees necessary for a fee, also because my fiance EWI he would need a waiver sooo....I think last night when I last talked to him he said he would have to be in Juarez until about the 20th of March

Has anyone had this happen to them before??

Ok so we finally got our open appt letter and the only stupid question is does it matter what color ink he uses to fill it out? I printed them off and everything except I had to send it to him in Mexico we were just wondering.

hey guys ive been reading here and i decided to do my 129f, i just recieved my NOA2. My fiancee is from mexico where i was raised part of my life, my question is
1. Is the medical and interview the same day or a few days apart?
2. how many days do i have to stay over there, because i can plan for work and days off?
3. The interview is in juarez right?
4. the thing im mostly confussed on is what exacly is the process? is it we get a date for interview, we do medical and a day later she can come home with me? or does she have to go back home?
Sorry guys im just a little nervious, and the funny part ive read almost every post in this fourm at least the K1 part. thanks again
Hi Miguel, ok we're not that much ahead of you guys. But from what I've read and where we're at they say that your fiancee should get a 3rd package after the Consulate in Juarez has processed your file. They also recommend not to make any plans as far as like getting a plane ticket or anything until after she has her visa in hand. We're still waiting for the interview appointment so you know. I was told that you can be there a couple of days like one day for the medical and the next day for your interview. They also don't allow you the petitioner inside the consulate is what they say so....as for her being able to come home with you just really depends if she's approved for the visa or not.
That's all the information that I have been given hope it helps.

LOL That's a good idea...definitely try a free place first! I think it's outrageous that they charge to call.
You wouldn't happen to have the 1-800 number? I'm either overlooking it or can't find it....(guess I'm just freaking out)lol..

Supposedly they don't recommend using the email, but you can try. Apparently they prefer the "extortion line." You could try the other number if one of them doesn't work...Or you could see if your honey can get through from Mexico...I would try again if you have just tried once. Someone probably just hung up on you by accident. or try the other number 1-800 as opposed to 1-900 or whichever.
You have been a lifesaver Lia! Thanks I'll try the 1-800 number and see if maybe they'll answer. I know that I can use a credit card but its like come on $1.25 or so a minute its outrageous. I'm also going to give him the number from Mexico maybe he'll have better luck. I wonder if the DOS will have any information as to if they've (CDJ) has processed our file?

Yes. You want to make sure they are ready for you to come. Supposedly they send out an interview letter but I hear they take forever to arrive. So most people just get verbal comfirmation that they are ready for you to come for the open appointment.
They don't give you the visa right there. They have a bizarre setup. They send the passport via DHL to DHL in Ciudad Juarez. People have to check on the DHL website until their package arrives at DHL in CJ and then pick it up.
I also read something interesting yesterday on www.smf.juarez-mexico.com. They were saying that people schedule their waiver appointment before they go to the visa appointment to try to make them as close as possible to do them all at once. I believe the waivers appointments are scheduled through the call center.

Thank a million Lia! However, I've tried calling the call center in CDJ and the only thing I get is disconnected I don't even get a chance to talk to an actual person. How did you get in contact with a "live" person? Yea I have a feeling that our appointment letter is going to tak awhile since he lives way out in the middle of nowhere lol....

OK so now that I've got almost all of my "pkg3" except of course I need to send it to SO. I've read somewhere that we don't need to wait on an interview date or anything as long as they've already processed our file am I reading this right? Also does the Consulate in Ciudad Juarez do they give you the visa right there? I have other questions but at this moment they've seemed to me out of my head. LOL... Oh yea how do you know when the consulate has processed your file do you still get a txt or email like from the VSC OR NVC??

Thanks guys! I've already gotten started on the "begging" letter. I've also asked my parents and sister to write a letter also. Since I don't have any type of medical condition that's not going to help except that I have to go the dr. just about every 3 mth because I get inflammation in my left arm muscles, left shoulder and chest(with pain that feels like your having a heartattack), I doubt that its going to help.
. Would my parents being dependent on me to do their bills and translate for them would that count as a hardship, not to mention leaving behind a job that has good benefits, ruining good credit and not being able to continue my education count??
So confused!

For everyone's benefit - the DHL tracking scheme you're referring to doesn't show any individual's package being sent nor delivered. These are bulk-shippings from NVC to respective Embassies/Consulate and there is no way to know if your individual file is in any particular shipment. (In other words - it doesn't help much if at all.)
OP - I wouldn't worry - try to relax and let the process work for you (I know that's easier said than done but hang in there...)

The Dreaded 601 waiver.....maybe also the 212 waiver ....maybe...
Like a few members said take a trip over the i2us site there ya find plenty of dos/don'ts about this process..
I Didnt do a lawyer for my 601 waiver nor my hardship letters neither it was (D.I.Y) For me so with some great advice in writeing such hardship letters you also could do this yourself...
But if not....l i recommend Laurel Scott as she has a good record and she does this stuff everyday.....
Also she has a open chat on her site once a wk..which maybe handy for you..
Im not sure what it cost to file nor how long it takes for your country..but please , please, take this waiver stuff very serious .....they don't play around with this..as ive seen some great hardship letters being denied.....
sorry...H/S/L is a letter that the usc must show that his/her spouse is giving blah blah blah hardships in being split from each other...(its a begging letter from the usc and also the alien) to ask for forgiveness...for his/ her crimes....

Ok so I've read somewhere that you can go on to DHL and see when your case left the NVC. So I did and according to them the package was recieved on the 31st of Dec. I called the NVC around the 27th of Dec and they told me that my case was transferred to CDJ on the 24th of Dec.
So because we haven't heard nor recieved anything I called the DOS and they told me that my file was sent to CDJ BUT they haven't recieved it?? Should I be worried because let me tell you that I'm freaking out thinking that maybe they've lost it and we've only got until April for the approval notice.
Sorry I'm just going on and on.....is this normal??

The DWI and the illegal presence both concern me as both may be a reason for a waiver
His illegal presence - how long was it? How many times did he enter the US without inpsection?
His DWI - how long ago was it? Was it just the 1 time?
Take a stroll over to immigrate2us.net, they specialise in waivers and bans.
Why is just now your lawyer telling you that you 'might' need a wiaver?

Really my lawyer hasn't been much help through this whole process. He has been a TOTAL waste of money, and to be honest it doesn't sound like he knows what the ####### he's doing. He (David) was here since '94 he's only had one EWI and hadn't left the country since he came in, and no it wasn't he's only DWI the last one was 2006 I believe ( I have the papers somewhere).
Sorry about the INS part just easier for me to type.LOL.

*Hopefully they won't give you a waiver.
*If they do, have the waiver packet ready because sometimes you can stick around in Ciudad Juarez. I think they either send the visa to DHL or if you are eligible for a waiver or not.

Thanks e veyone for the quick replies. Well, while David was in the US like everyone else he had his run in with the law. He got a couple of DWI's which was considered a felony and got sentenced to rehab which we or rather I have the certificate where he did his rehab and graduated or whatever from there. While we was in rehab for 9 mths INS did a random name check and found that he was illegal and put a detention hold on him, when he finished his rehab they transferred him to Louisiana. He was able to post bond and then we were also able to get him voluntary departure and he's been in Mexico ever since. That's why our "lawyer" said we might want to have the I-601 ready just in case.
However, I've read some of the other topics none of them even apply to me. I think that we're just freaking stuck.

ok I just got off the phone with our "lawyer" and he seems to "think" that we might have to file a I-601 waiver. My question is where do I get it and how much is it and what if we can't prove any hardship on me. I mean besides a parent being on cholesterol and blood pressure meds. As well as me also borderline diabetic and needing to keep an eye on my cholesterol and blood pressure.
Anyone know the guidelines for Cuidad Juarez.
Also do they give an answer right there or do you have to wait??

My visa was approved today by the Consulate in Vienna
The interview was short and the lady who interviewed me was very friendly! After her last question she smiled and said "Congratulations and welcome to the United States of America!" What a moment.. Without this site I would not have gotten so far and without any RFE's and such.. When I first found VJ I didn't understand half of the words and terms on here and now I have my visa in hand (well.. have to pick it up within the next days
) I learned so much just by reading through the different forums and topics here. Just wanted to say THANK YOU to everybody who contributes to this site!!

The gravity of this proof will be increased tenfolds if its on an official company letter head. But again, thats not required as your boss will verify, if required. But if you have company paper, print it on it and have your boss sign it. Trust me thats more golden then anything.
She actually typed it out on a company letterhead paper and signed it in blue ink. So if I just print it will that actually do. The thing is that I work at another office than she does and therefore we get off at different times so that actually puts a damper on things.

Of course we have copies, and certificates of where he's done his rehab. But the thing is I don't understand how they just gave visas to the two people who have done a serious drug like cocaine?!?!!? Seriously, how have they punish the people for having something minor just has a DWI but not a drug like crack?? Sometimes it makes me wonder about our freaking goverment, anyway sorry just blowing steam off.
