  1. Why didnt they get tax transcripts like the guides recommend? All i can think is some of the supporting documents are missing. Have you called and talked to an operator or a supervisor to get more clarification?

    That's the thing is that the tax transcripts WERE included.

    I've talked to 4 dif people am going to call again tomorrow morning and have my grandfather (the co-sponsor) call tomorrow. He's more intimidating and is actually a tax lawyer/public account. Which is weird that he got an RFE for all these things.

    Anyway, I have a copy of the packet in my hands and ALL OF THE TAX TRANSCRIPTS are here.

    Possible they lost something?

    The part about not including a statement about not filing taxes doesn't make sense because a. he did file taxes and b. everything was included.

  2. Did you (the petitioner) have an income for last three years? If so, did you file for taxes. If not, you need to attach a statement to why you didn't have to file for taxes.

    I did not file taxes, I did attach a statement. The only thing I (the petitioner) did wrong was instead of writing the years and zero next to them, I wrote "see attachment." The problems with the 1040s are for co-sponsor, not me.

    I am asking about the co-sponsor,not me the petitioner.

  3. I need help with one of my 3 RFEs. :blush:

    Received official emails, I understand 2 of them.

    Third one is this (as listed on checklist):

    Supporting Documents missing or incomplete

    [x]The listed income tax documents/IRS statements for the years marked below are missing/incomplete (if you have lost any of the requested tax information, contact your local IRS office to obtain a copy)(Only federal returns (not state or local) are acceptable unless the sponsor's income was earned in Puerto Rico.)

    ·Federal income tax returns or literal printouts from IRS (RTFTP) or a Letter 1722 issued by the IRS are missing/incomplete for the year(s): [X]2008

    [x]You have not enclosed an explanation of why you were not required to file income taxes under Federal Tax laws for any/all of the 3 most recent tax years.

    I have the packet in hand and see that he included:

    -1040 for 2008

    -W2 for 2008

    -Self Employment Schedule SE

    What could be the problem?

    Maybe there is a specific page left out or something?

    For the firs part on the checklist?

    For the second part it says that he hasn't included a statment as to why he was not required to file...

    But he included his 1040, etc. and listed his income for the past 3 years.

    One thing that I can think of is that he filed jointly with my grandmother (co sponsor his my grandfather) and wrote HIS individual income and not what is listed on TOTAL INCOME?

    Help!

  4. OK,

    We received an RFE because my husband's certified copy of BC (which his mom was given a few weeks after his birth and has never had any other type of document nor the ORIGINAL because in Argentina the government keeps the original--stores it away in ancient books which they then hide away...)

    I called and talked to 4 different NVC operators, was given similar info by each person but each time the info varied a bit. One person told me "just write a note explaining why this is actually an original", another told me "we have BCs from all over the world, from every country and this just didn't meet our standards." Another person, who I assume was new never really gave me a 100% answer, I could here someone prompting her with info in the background.

    After talking to 3 different officials here in Argentina, found someone competent.

    They explained to me that this certified BC was rejected because BCs from Argentina, when used in transactions or official matters outside of Argentina, expire every 6 months. And an updated version needs to be sent out. (In Argentina this does not apply.) Of course none of this is listed anywhere on BC or on websites thus the mistake. The BC was also LAMINATED and when it is laminated it is no longer official.

    SO...there you have it.

    Eight different people to get things straight. :)

    Time to tackle my RFE (not putting a zero in the correct spot) and my co-sponsor's RFE (they claim to have not received his 1040 or W2 which is totally not true since we sent them!!)

  5. Yes, if your income was zero, you should write in a zero. I know it seems a bit silly, but it is a legally binding document and they need to you state exactly what your income was.

    This other RFE is a new one? Sure you can email them, but you can also call them and ask them.

    yes there were 3 in total.

    they say that they did not receive my grandfather and co-sponsor's 1040 for the most recent tax year, which at that time was 2008, not 2009. i explained this to the woman (has anyone ever gotten a male operator?) and she said oh yes, well you need to send 1040 instead of W2. maybe there was only 1 copy instead of 2??? it was sent...i am 100% sure.

    the other, BC of course.

    and mine, writing in zero.

    so i should write the years and then zero? or just one zero?

    i will call again, i just think i'd feel better to have it written down since i am always so nervous. will call for the 4th time.

    OH!!! AND MY INCOME WAS NOT ZERO, I JUST DIDN'T MAKE ENOUGH MONEY TO ACTUALLY FILE TAXES...would it still be a zero? I didn't file taxes because of this...not making enough money I mean. I was not due any return nor was I required to file it.

  6. Can I email NVC and ask them to explain an RFE?

    Or should I just wait until letter or email arrives? (I haven't received either yet.)

    ALSO I didn't even tell you guys about my stupid stupid RFE!

    I haven't filed taxes since 2005 and attached a written letter/description (for question #25, I-864) and wrote SEE ATTACHMENT. They said that I had to write in zeros. #######.

    Should I write 2007----0

    2008----0

    2009----0 ???

  7. An apostille is a certificate that authenticates legal documents between countries. It isn´t common in the US but quite common in Argentina. I had to get all my US documents apostilled to get married and residency in Argeninta, so we went ahead and did the same for her documents to go there. I dont know exactly where to get one, she is a lawyer here and did everything, I will ask her and post when I see her later.

    i made two huge mistakes--two that you did not.

    one i never got my dni (i've lived here for 4 years, i am a big f--- up, yes).

    and two, i did not marry a lawyer! damn me...:D

    ORIGINAL/CERTIFIED copies are acceptable.

    NOTARIZED/ATTESTED copies are NOT.

    ok, so if they will not accept the one we sent as long as we send a new certified one it's good??

    So stressful...called and talked to two separate people yesterday at NVC. They were nice this time and said that we had not sent the original BC. I assured them that this is the only BC my husband has EVER had and that when I called the registrar's office they said that this is the ONLY birth certificate that they give out. They said that we are welcome to request another birth certificate but the only difference is that it would have today's date but would still be a copy. I keep trying to get a letter from them stating that this is the only BC that they give, but this is Argentina and things take persuasion and a lot of time. (GRRRR!)

    My mother in law just dug up what is known as the "Family Book" (La Libreta de Familia). In that is listed husband's parents' marriage, his birth, his sister's birth and then it is also used to list deaths in the family. (We also have one but do not have children or his birth listed in it...we also sent it in with another marriage certificate. TOO MANY COMPLICATIONS! err..)

    His bday is April 21, 1983 and in the book it is listed April 29, 1983. It says that it is "Act #152, C2, Page 351 in the Office of Birth Certificates" and that they are "registering the inscription of the birth of Lucas" then goes on to say who his parents are, has in Nation Document ID number ad is stamped and signed by a "public official". Should I send this in along with copy of the other BC I sent in?

    So sorry to hear about your RFE, I was reading another thread some months back with a very simular case as yours... From what I can remember is that they just sent in the exact same document with a letter attached saying this IS the BirthCertificate... NVC really blows sometimes

  9. Just to clarify an error that occurs frequently. The original birth certificate is issued after the birth. Sometimes the same day, sometimes a day or even two later. Mine was issued on December 1, 1957, which is one day after I was born. I have it, and I would never, not in a million years mail it to anybody. So please don't say it's the original, unless the document you mailed was as old as you are now.

    What you sent is an official copy, and that should be sufficient, once you prove it is what it is.

    It was issued AFTER his bday.

    How should prove that "it is what it is"??

    Argue on the phone (ha!) or send them a written statement??

    And what should I put in the written statement?

    So confused.

  10. I would ask the operator to transfer you to a supervisor of they are of no help. A supervisor may have better handle on things. Your BC sounds to me as a certified copy so I am not sure why they have issue to begin with. This really blows tongue_ss.gif

    Right??? Got off the phone with a second operator who was nicer but I'm getting all confused and angry and am not 100% sure I understood what she was saying. She then said that they hadn't actually sent out any info but on the AVR said that something was sent out last Friday. What's the deal??

    That really blows Em. See, it makes no sense to me how the NVC cant understand (being that they deal with other countries) that different things apply to different places? Please keep us posted on how you are going to proceed.

  11. If that is the only birth certificate the region your husband was born in issues, then get an official letter from the registrar stating so. This should staisfy NVC.

    Alternatively, if there is something specific that they are looking for (perhaps an issue with the seal or what it says) then ask a live person at NVC

    Thanks. I called and the operator said that I could "write a quick little note" and then sort of went in the direction of getting a note from civil registrar.

    RFEs are like...

    eh. I think you could fill in the blank with any horrible thing.

    I read in Lingche

    "Annotation by the appropriate authority indicating that it is an extract from the official records"

    I said before that the document says that "this document is a true copy of its genuine birth certificate" and it is signed and stamped. Wouldn't this be annotation by the appropriate authority????

    If we write a letter stating this would it be ok or does it need to be done by an official?

    Because it looks like they won't write that the registrar may not write an explanation...

    The BC you currently have - does it have a raised 'official' seal on it?

    It's not raised, but it is an official stamp.

    There is one on the front and one on the back.

  13. Hi guys,

    Just got off the phone with an NVC operator (who was not as nice as the people I have spoke with before!). We have an RFE for my husband's birth certificate. It is not the original the woman told me. It in fact IS the original, the problem is that on the back side of birth certificate is that it says "...this document is a true copy of the its genuine birth certificate." We called the civil registrar's office and were told that this is the only birth certificate that they can and will issue. It is the only certificate that husband has had ever. The registrar's office said they can't give us the "original" because it is THEIR document and they will NOT give it to anyone.

    It is stored away (god knows where) in their records somewhere. Again, they told us that the certificate he has is the ONLY one that citizens are given.

    What should we do?

    Should we write a letter explaining this and mail it back to the NVC? Ask the registrar's office to write this letter??

    GRRRRRRR...

  14. going by this Sachinky.. I wonder.. if I used the average which is 10 days, then when I add it to the date that they recieved my last package I should have an case complete on the 19th... if I add it too the date that the operator keeps telling me <the 9th is when the DS-230 came under review> then.. the date of a case complete would be the 23rd... lets see... at this point I am tryin to not obsess about it... can you tell???? :P

    ok ok according to AVR our case was received the 18th, not the 15th...

    need to edit that for waiting list.

  15. Yes, once your case is completed at NVC, you will be assigned a date for the interview. Usually 3-4 weeks from the assignment. However, that TOTALLY depends on how busy/available your embassy is.

    Ghana, London, Canada, Dominican Republic seem to be severely backlogged. Might wait 2-3 months for an interview.

    Count 8-11 BUSINESS days from the day NVC received your last package (whatever it might be--AOS/DS230/RFE) and then call the AVR/try to sign in. If your sign in fails, means your case is completed. Confirm with an operator and then wait for your interview to be scheduled.

    oooo...yes! please do! that'd be great! i called nvc AGAIN and they haven't input it in the AVR yet. I know it was delivered Monday, but then again it is only Wednesday right? How much longer do you think I should wait 'til talking operator? I mean do they change the message to "nvc received info.." or do they only change it for when they actually put it in??

  16. No, they will not expedite it unless you have a good enough reason, such military deployment or health emergency.

    If a good ol' phone call would have done it, don't you think all of us would've done it?

    I was thinking about using "I've been living with my mother-in-law for the past 7 months and need my own place ASAP. Please expedite my papers!" Eh, whats another month or two.
