  1. I know this is not going to add too much to the discussion, but a trick that we have learned for coming through entry is to HUSTLE from the plane to the POE area. Often times the spacing of incoming flights means that if you move it you can be at the front of the line are damn close. This solves the main problem of everyone else coming through the visitor line not knowing what is going on. And if you can be there with her it will be easier, one less stressful thing. I have heard many stories of ladies spending hours getting through POE to be annoyed by a "happy" man on the other side with no realization of the ####### she just endured. Also, if she is coming alone, remind her (several times) what she can and can not bring with her. My MIL was VERY LUCKY to not have her luggage searched on this last trip. She had enough dried/cured "things" to stock a shelf. headbonk.gif

I didn't prepare the package myself, the lawyer's office did, but I remember providing them with bank statements up to september 2012, the USCIS is saying that the evidence provided doesn't show that me and my husband share responsibility for most of the assets and liabilities of the marriage and that we have not sent sufficient examples of shared assets and liabilities spanning the period of the marriage to share that we have continuously shared a life together.

    It sounds like your lawyer is less organized and prepared to do his job than the rest of the typical VJ community. Sorry for the RFE but you should be able to take care of this. Best of luck!

  3. If you have clear documentation of a legitimate relationship and act as a couple in front of the officer you will have no problems. If your wife doesn't speak English well, you have no evidence of life together, and she is 30 years younger than you...well, you might have some tougher questions but that is still not a game breaker. Just make sure you have everything in order and that you are both on the same page with your life stories and you will be fine. :thumbs:

  4. All that means is that she will need to use the divorce papers as part of her waiver. Once she is here there is nothing you can do about sending her back to her country of origin. If you have concrete proof she entered the country under false pretenses you can send it to the appropriate authorities. They would decide on their own if it is worthwhile to process her deportation. Hearsay and rumor won't mean anything if you can't back it up with some sort of documentation e.g. photographs or letters.

    The fact that you had a second child together after you were married makes the case almost impossible to prove as it showed she was still participating in the marriage at some level. Marriages fail on a regular basis in the US and no one is going to be penalized for a marriage going bad unless there is significant proof of wrongdoing.

    This is why the process is long and complicated. It is designed to give everyone time to learn more about each other and discover any inconsistencies in the stories we have been told.

    Exactly, and most ROCs do not have interviews as long as sufficient documentation was sent in with the application. I know that you are in the emotional phase of this crappy situation right now but focus on your children, get a lawyer, and protect yourself from abuse accusations. If she is doing this, she probably has done her research or has someone directing her on what to do and how to maximize what is in her best interest. This is not certain, but proceed with caution. :thumbs::unsure:

    Haha...yeah, probably true. However they adjudicate all of the "MESS" that a lot of people send in and more than likely non of us will have interviews so all in all it is not a big deal. I think ROC is the easiest part of immigration, assuming no hiccups in processing. I feel like there is really nothing to do but just keep on with everyday life and check in once in awhile on status. :innocent::whistle:

  7. I supposed that I have two thoughts to add, having been in a successful relationship with my wife, who happens to be from China. The train wrecks, blow-ups, ect. that I have seen and read about tend to be a result of guys who fall head long into these online dating sites. Again, not judging those sites but there is anecdotal support for this. I really don't know how you two originally met, so I won't assume anything, yet the relationships that do work tend to be those that have a more traditional period of courtship (which can be done online with the right maturity level). With that said, if you go looking for a wife in China you will find a lot of lady-players among the flowers, especially if they are over 25-30 as this is when they fall into the 'left-overs' category. Do you really want someone just looking for an out?? Whatever your reasoning, the path you are on strongly predicts that you are going to have a lot of troubles. That was point one.

    Point two: if you do find a good, solid woman from China...never let her know that you were shopping like at a meat shop. Be honest about your past, but you will lose a lot of face in her mind if she feels like a fish at market. Unless you are looking for that kind of woman, you know, the ones who want to shop on TaoBao all day and always eat out. Ultimately, good luck, but think about what you want and communicate openly and clearly. :thumbs:

  11. In this economy it is quite normal for job transitions. The main thing that you need is to keep continuity of jobs and have supporting documentation of your past and current employment status and income. You are at the petition stage which does not involve your finances. USCIS is concerned about if you are both single and willing to marry and do not have any red flags that suggest immigration fraud. The consulate will worry about your finances when you get to that point, which will probably be in the early summer. In theory, you can submit additional paperwork, but I wouldn't worry about this. You should make sure your fiancee has everything up to date on her end. :thumbs:

  12. If you plan to use your married name, then that is what you put on the form. There is a space that asks if you have gone by any other name, this is where you fill in your maiden name. The government knows that you are transitioning from a K-1 to LPR and that requires marriage, so they expect name change but do not require it. The main issue is if you decide to later change your name, you will have to pay for a replacement greencard and that is expensive. Good luck! :thumbs:

  13. Fire you lawyer....everybody join in.....fire your lawyer......cause he isn't up to date.......yeah! Darnell is spot on, they changed the process and you need to make sure that she takes her "kitchen sink" just in case. I have a HUGE stack of papers covering everything my wife (then fiancee) needed but was not asked for. The VO wanted to see a pic of me with her parents, asked a few questions and then sent her on her way. Good luck! :whistle::thumbs:
