  1. Priority dates are 'when a visa # is available'

For Spousal -based visas, it's immediate availability. So that priority date is prolly the same date of notice, or even a day before.

    re: ex wife info.

I'm sure he has it somewhere - check the divorce decree documents - it's BOUND to be in there.

    Good Luck !

The birthdates are not being written in there so i think we will just leave it blank.

Those appointments are supposed to be last april 2008 and it is almost two years now. The reason why we did not contact the embassy/NVC because they exactly said on the letter that there will be a possible termination if it is already a year and we dont think that we could get another available appointment so this is the reason why we decided to refile:(

  2. What is the status on that I-130 ?

If it is still at NVC - then there is huge possibility to 'kick it into play' at NVC. You say you did not do medical or interview for this I-130, but I'm betting (right or wrong) that HE did not submit I-864 or DS-230 at NVC, either. IF that's the case -

Check the I-130 casefile number (starts with WAC or EAC)

then call the NVC AVR system, input the casefile number.

If it's still active, then NVC AVR will read back an NVC casefile number, usually starting with MNL . (I THINK?)

IF you get an NVC casefile number on this old I-130, then have yer us spouse call NVC , and jump start it all.

You might want to review this, in case he is successful to jump start the old I-130 -

    Good Luck !

Those appointments are supposed to be last year which was the month of april 2008 and it is almost two years now. The reason why we did not contact the embassay/NVC because they exactly said on the letter that there will be a possible termination if it is already a year.:(

  3. The above is on track. If you have the priority date, use that. It's when they received it, so close to when you mailed it. Even just the year would be close enough though. You also need to provide a "result".

Still do not know if what to write as the "result"

    Any advice or example????

  4. If he has no documentation about the exact date answer the best you can. Approximate birth date 15th Oct 1970 or something to that effect. Get as close as you can.

"Have you ever before filed a petition for this or any other alien?

If "Yes," give name, place and date of filing and result."

Is the name for the beneficiary which it was me?

Is the place mean to be where we filed or sent out the papers before?

Could be the month and year are acceptable because we both could not recall the exact date?

Sorry but we are just really confused what to write on it.Hope anyone could help us.

  5. What if my husband could not recall his ex wives date of birth can we leave it blank or is he really need to write that one? Hopefully this will be our second time to file. There is a question on the form "have you ever filed a petition for this and if yes give name, place and date of filling and result?" ------ "Due to unfortunate problems we canceled out the appointments" Would this be enough reason? Another thing i dont think my husband could recall the day we filed the papers and me either but that was around feb 2007, is feb 2007 ok? But we got the receipt or the approval notice. Really need help for this one. Thanks in advance!!!

  7. I think we had a good reason why i did not show up during my appointments but it does not mean that i wasn't serious about my marriage or in our relationship. When I had my first appointment my husband was here in Philippines and he resigned at his job and believe that he will stay here for good but he wasn't in good shape after 10 months to stay so he decided to go back in U.S.A (we lived together for 13 months) as the main reason why we had to cancel the 2 appointments but I hope there will be another chances for us. We The medical exam was already paid in BPI, i know it was a waste and it hurt me a lot but we are having a problem about money so that ware almost 9 months apart from each other since he left , i hope the embassy will understand. But right now I am studying and i have almost 8 months to go before my graduation day. My husband want me to go and visit him during my semestral break this coming october, so we are planning about visitor/tourist visa would it be possible? I will only stay atleast 2 weeks and back in phils to finish my school and if so does anyone could give me all the details if what are the requirements or documents needed???please help

i thought the medical exams are to be paid only at st lukes? i didnt know it could be paid at BPI.

getting a tourist visa is next to impossible if youre married to an american, the consul will just tell you " youre better off with an immigrant visa"

try calling the us embassy and check about the status of your case. you may have to start all over again.

Yes thats true it could be paid in the choosen bank BPI or BDO and what i did i paid the amount for the medical and then they gave me a pay slip where a medical form was attached and told me once i get to St. Lukes all i have to do is to show it that i am paid.

  8. 2 years??? that is just way too long my heart will be probably broke. With all the answers/advices i got from here about tourist visa I think i am not going to pursue on it coz it will be just a waste of money so i think am gonna just wait if when we can re-file it again. The only co -sponsor that we would get is my husband's son but he is not doing well this year so it would surely out of the question right now.My husband is doing 2 jobs where the other one is tax free so it means it would not be reported and that is the problem there..To all thanks for the responses and I would appreciate more if i hear you guys..Goodluck to everyone...
