  2. Guys we still can't get through .. still can't send our birth certificates to the nvc add it is not working ....Really feel so bad about this. We thought of just calling the embassy manila today, is this ok?

Who has the right to terminate the application is it the embassy manila or the nvc???

  3. OK - they are asking for yer birth certificates, IMO, to prove up WHO YOU ARE. That's normal, but rarely utilized. Don't sweat that.

Now, as to WHY you cannot send email into nvcinquiry@state.gov - I've no clue - it MUST be some problem with YOUR computer. MANY OTHER PPL (thousands each month) send stuff in to nvcinquiry@state.gov with success.

DOES YOUR HUSBAND have a scan of yer birth certificate? If so, have HIM send yours and his , in, to that email address, with some reference (in the body) to the prior I-130 USCIS casefile number.

USUALLY, it's enough for the USC spouse to give the casefile #, the dates of birth (yours and his) plus the names, and then jump start the case at NVC, via telephone. For some reason, that's not working for your husband. I suggest to keep caling and to try, each day, over 3 days (monday, tuesday, wednesday) until an NVC Tele-Operator accepts the info via telephone. If/when the info is never accepted via telephone, then send it in via email.

Yes they said that the record was not right that is why they are asking for our birth certificates.

He did scan our birth certificates and when he was trying to send it , it goes back and says failure dont know what is wrong and he said today he will try to call the nvc again.

  4. Because the PI is not a country that participates in NVC Electronic Processing.

There's only 3, at this time. PI is not one of them.

Yer Husband would have to handle NVC Processing via Postal/Courier delivery.

HOWEVER, you can handle the DS-3032 via ASCII TEMPLATE EMAIL -

    see http://www.visajourney.com/wiki/index.php/Email_DS-3032_form

    for the template.

If indeed things look good for NVC Processing (IE - the original I-130 is at NVC and waiting for NVC Processing) - your husband might want to follow these steps -

What did your husband discover about the original I-130 petition , from NVC Call Center, from Friday ?

When my husband called the NVC they were asking for our birth certificates and to email it on this add which is nvcinquiry@state.gov and as i tried i cannot get through :( And said that they could not give some more details about the case until we can send our birth certificates, we don't know why i mean they don't give definite answer and i am very disappointed about it.

  5. http://manila.usembassy.gov/wwwh3238.html

There is a place on it where you can check the case number when you have it already and that is what i did but there is no luck. I guess i will just have to call the embassy and see what is the update of our application before. Can i reach them thru a mobile phone or got to be a landline because i did try to mobile before but it did not work huhuhuhu....

Anyway thank you so much Scott and Mhay...

    God Bless both!!!

  6. to re-file a new I-130, use the address listed here:

    http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=c67c7f9ded54d010VgnVCM10000048f3d6a1RCRD&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1RCRD

but - your husband really should make a phone call to NVC, get a human, and inquire if the prior I-130 is still at NVC, or is not at NVC, prior to filing a NEW I-130.

If it's still at NVC, then I strongly suggest he jump start the NVC Processing.

    Thanks for the mailing add.

Would it be best just to call the Embassy Manila since our case was forwarded to them from NVC and got our case number before? appointment? and cancellation?

    NVC or Embassy Manila???

    Really confused!!!

    Please Help!!!

  7. All you can do is call them and see. there are im sure in some cases that you may not receive the termination letter. Maybe because you never tried to reschedule they felt you were abandoning the visa process. CALL THE EMBASSY and find out what are your options.

Thanks both I think this is the best that we could before sending out the papers. Thank you.

  8. I have read from this link http://manila.usembassy.gov/wwwh3222.html about the visa termination.Says that:

A Notice of Termination of Registration is sent if, after one year, the beneficiary fails to:

    1. apply for an immigrant visa despite official notification from the National Visa Center or the Embassy to apply or respond to Packet 3;

Beneficiaries, however, may request reinstatement of their immigrant visa applications if, within a year of the termination notice, they are able to satisfactorily explain that their failure to pursue the application was for reasons beyond their control. Otherwise, visa applications will continue to be subject to cancellation procedures in accordance to U.S. immigration laws and regulations.

It is almost 2 years now since we cancelled the appointment with the confirmation of course. On their record it says we cancelled it but is the cancellation the same as termination?? Because we did not get a notice of termination.

    Thanks for the help.

  9. My husband live in Alabama. One of the VJer's here send me a link of the place where to file it but it is different from what i have read here on VJ. Can i choose any from them?

    VJ add:

    USCIS P.O. Box 804616

    Chicago, IL 60680-1029

    Other link:

    USCIS

    P.O. Box 804616

    Chicago, IL 60680-4107

  10. National Visa Center

    Automated Voice Response

Ask yer US Husband to call them tonight, get into the AVR, and check the OLD I-130 casenumber - see if any status on it AT NVC. If the casefile exists, is possible to kick start this I-130 AT NVC (re-read what I wrote prior, get that info to yer husband)

Thanks Darnell we will try to check it.
