    Yes I believe For 5 year, you would need to complete required number of days in US without any stay over 6 months outside US. Last time I checked you can apply 3 months before 5 years are completed. Decisions depend upon the case also on work load. You can check for timelines here https://egov.uscis.gov/processing-times/

    @Mike E @Crazy Cat may have better data points, but this article from allegedly former USCIS officer explains that not everybody is trained equal at USCIS. And I tend to believe it. Did you ever have somebody at DMV / SSA asking their manager to intervene because they don't know what to do? 

    Thanks for every ones input. My case is very simple and it does makes sense with pending i751 , it takes more time.

  4. Hi I filed my wife's case in may 2022 and I recently sent an inquiry to USCIS. I was got the reply below.

     

    USCIS systems indicate that your case is awaiting an interview. Your local USCIS Field Office will contact you once they are able to schedule the appointment. Should you not be contacted by your local USCIS Field Office within 90 days of this notice, please reach out to the USCIS Contact Center for additional assistance.

     

    I wanted to know what can be done cause its been over a year and I am still waiting for this process to be over. What are my options here?

    2. You can either get vaccinations now or if you don't you will need to during another medical for AOS in the US. Highly recommend you get them from Pakistan. No forms to be filled, the panel doctor in Pakistan will give you a sealed report after your medical which you will need to take with you to interview at embassy and at the POE, do not open that envelope under any circumstances.

  6. I have following questions related to K1 visa from Pakistan

    1- If a person has never been out of Pakistan, does he/she still need a police certificate for k1?

    2- If the person don't have vaccination record, then what should be done? Shall he/she get a vaccination certificate from a Dr. Or shall it be done during medical test? Any particular form needs to be filled on this or not?

    MY application of IR1 is in NVC and its closed there. They are waiting for London embassy to give appointment and there is no update since 16th of aug. When i called them they said that they couldn't get an appointment for September as embassy only hold interviews in first 2weeks. now they are waiting on and will update once they can schedule an interview.

    Now I don't know how long will it take. I am also wondering whether there is way to EXPEDITE the process or not?

    Please guide.

  8. They would both provide I-864 forms whether they live in the same house or not. The I-864a is used only by non head of household family members when combining income to qualify. This brother is the head of his own household, by virtue of the fact he's the one with the qualifying income, REGARDLESS of whether he lives at the same address as the petitioner.

    does my wife and brother in law have to send i864 in separate mails to NVC or they can put it together and send in one mail.

    I think they should send it in same envelope but we are not sure about it. any suggestion.

  9. Are your wife and brother in law living in the same household? If this is the case, your wife will fill out I-864 (regardless of lack of income) and your brother in law I-864a and he will be your wife's co-sponsor.

    If they do NOT live in the same household, your wife will still fill out I-864, and then your brother in law will ALSO fill out I-864 as a Joint Sponsor.

    They dont live in same house hold so they both should fill out I-864. Does it matter in my case if my wife is showing no income and my brother in law is supporting me. In other words, can they ask me why is he sponsoring me etc?

    My wife in US filed my case and I am the main applicant. My wife is not working and my brother in law is sponsoring me. We got an email from NVC to download the appropriate forms and then mail / email them by scanning them. now we are bit confused when we look at

    it has last 2 sections that falls in my case but not sure which one to follow.

    first section is

    1- All three of the following are true:

    You filed a Form I-130 petition, for your relative

    The there is only one applicant on the Form I-130 petition, and

    All your qualifying income comes from a salary or pension and shows on one or more W-2 Forms that you receive

    2- If none of the above apply

    ---Complete an I-864 (and possibly an I-864A) on your computer using CAPITAL letters.

    Any idea.

    Also as my brother in law is the sponsor, do my wife has to fill up one as well?

    Please suggest. Any further information will be helpful.

  11. You will find the AOS bill online and they will email you when it is ready to be paid. They will send you the DS-3032, though you can send it off before: someone will tell you how.

    You will need a police certificate from Pakistan, from every jurisdiction in which you lived: "Police records (also known as Character Certificates) are available at no cost from District Coordinating Offices, and take up to three months to obtain. There is no central police register in Pakistan, and applicants should therefore provide certificates from every jurisdiction in which they have lived for the requisite period of time. Police certificates are available by mail. Applicants currently outside Pakistan should contact the nearest Pakistani Embassy or Consulate for instructions."

    Go ahead and start the process of obtaining the necessary certificates. Don't worry about the possibility of not succeeding right now :-)

    If you are unable to obtain record of your vaccinations then you can go to your doctor and try to get blood titres done to test you for immunity to those diseases you think you have been vaccinated against. You will need to receive any vaccinations you have not had, or those which you cannot prove you're immune to. This can be done prior to the medical (in which case bring proof) or at the medical.

    with regards to UK certificate, shall i apply for it now. or is there any expiry or time limit on it. ( i search i couldn't find anything about it).

    My i130 is in NVC and i got nvc no yesterday. just wondering do i have to call again to find out AOS bill / ds3032 is generated or can i check it online?

    also i am living in the UK for last 8 years before i left pakistan.

    do i need to get police certificate from pakistan ? also i was reading that ill need to get police certificates from every area where i lived in pakistan after the age of 18.

    its quite difficult to get police certificates like this. i can get one or two but all is gonna be difficult.

    also if i dont think i have got my vaccination record? what do i need to do on that?

    @marriedtomrg : thank you very much for detailed information. we are married for almost 3 years now and we got kids too (they've already got american passports). Will that make any difference? also i have got valid visit visa for usa and i have got secure job here in the UK but i have heard that when you apply for visa (like k3) they revoke it, but its wrong perhaps.

    @JoannaV : thanks for exsplaing about the medical and telling about interview. thats a big relief to have it in London rather than some where else. Also is it like she will apply for I-130 in usa and ill wait till it gets approved over thered and then I have to apply DS-230? or once she files i-130 , then i can file for ds-230?

    My wife is a usa citizen and she needs to apply I-130 for me. I am a resident in UK and we got married in Pakistan. Now after reading saveral different guides, i am bit confused about requirements etc.

    For K-3 it says that application for K-3 needs to be filed from country where we got married. Is it a joke or what? do i have to go back to pakistan n file for K-3 and wait there till they call me. I have a job in the UK and its litterly impossible for me to follow it like that. Am I understanding it wrong? also a stupid kind of medical test is there?

    Also if i dont apply for K3 , then what do i need to get Green card? How long does it take?

    Is it possible some one can guide me through the process.

  15. You need to investigate this further, sounds like you have abandonment issues.

    i didn't get it. why do you think like that?

    As far as I know, you have not to be out of US for more than 6 months in a row and you need to complete a total no of days (when you have GC). then after 5 years you should be able to apply for citizen ship.

    Am i wrong? please correct me. I am bit ignorant of US laws...
