  1. If I am correct, you mean your fiance's interview in 10 days?? You are the petitioner, right?

    1-Ok you will need to submit a letter explaining why you have not filed income tax in three years

    2- If you have been working since January 2016 making $3000 you need to submit pay stubs, copies of your bank account statement

    3- You said you have $100 k in savings...There is a formula to be used if that amount alone is enough to be your own sponsor. I believe this amount is more than enough depending of how many your are sponsoring beside your wife...maybe someone can break it down for you.

  2. First of all, when it comes to filling out the DS-160 and have it completed, you will need Case and Invoice number from NVC after your petition NOA2 approved to be used to pay the fee for the k1 visa application.

    Second, in some countries they will require police reports within the last 6 months. Depending on how long the petition process will take you, I would hold on that for not. I know in Singapore were my fiance is filing, they will not issue her Police report until she bring a proof from the embassy requesting it..and that will take her 15 days to get it after providing the letter document from the embassy.

    Third, I suggest that you request a copy of your transcripts from the IRS. I hear that consular rather look at transcripts copies from IRS.

    Fourth, I would send another letter of intent to marry within a month or so from the interview date.

    Fifth, I am not sure about China and medical exams, but normally the embassy will provide you when to take medical exam along with packet 3 that is normally send out to you. What your fiance can do is, look at the required vaccination and try to get them all shots taken in advance so she have the book showing she complies with US laws when it comes to vaccination. That she can do anytime on her own and pay less outside rather than during the medical exam which I hear can be costly.

    I am not expert on China's Visa processing, but I believe this is typically how it goes...If anyone more familiar with China and the procedures they can correct me or add to it...

    Yes, this is the right way to do it...the question is simple, how long you lived outside the states...does not matter if you overstayed or not...you stayed one year and three months...good luck

    I TOTALLY AGREE with you on that.

    But why many people who were approved in beginning and mid of June and July have their case numbers and we are not? lol,

    is it a lottery and luck or some must happened to delay our cases?

    Achraf, that is a good questions and I wonder why myself...I was told also that USCIS ship files not in boxes but rather in Pallets...true or not but this what I was told.. also here is some information I read online...I wonder if there are system on how petitions are handled and I don't know what is Urgent, expedite and current means...

    The National Visa Center (NVC)

    The NVC is operated by a private contractor with more than 400 employees. The Department of State has five supervisory employees who work there. The FBI has one employee assigned to the NVC.

    The NVC receives between 15,000 and 20,000 petitions per month from the USCIS of the following types:

    I-130 – Relative

    I-140 – Employee

    I-129F – Fiancé

    I-129 – K1 and K3 LIFE Act

    I-600/A – Orphan

    I-730 – Asylee/Refugee

    I-529 – Investment

    I-360 – Special Immigrant

    When an approved petition is received by the NVC, it is placed into one of three categories (expedite, current, non-current), and sorted by visa classification and priority date. The NVC enters the remaining data that has not already been transferred electronically from the CIS to the NVC. The NVC then assigns a case number which consists of the three letter consular post designator, the Julian date (+500) and the number of petitions designated for that particular post that day.

    Typically, the NVC has approximately two million files on hand on any particular day. Bar codes are used to track transfers and file locations and prevent misfiling or other record loss.

    Expedite files consist of the following types of filings:

    I-129F – Fiancé

    I-129 – K1 and K3 LIFE Act

    I-730 – Asylee/Refugee

    I-600/A – Orphan

    These files and processed and transferred to overseas consular posts within one week of initial receipt. The only exception is in cases where a security advisory opinion is required. In such cases, the NVC will forward the case together with the security advisory opinion when it is received.

  5. I just talked to friend of mine who have knowledge about the NVC situation . From what I understood, the NVC have thousands of files that are stacking up on top of each others waiting for processing and its a matter of time to get to each one of them. NVC is running behind with the thousands and thousands of applications that are waiting for visas and case number to be assigned. Summer time is the busiest time for processing application not to mention not having enough man power to catch up.

  6. Agree with Georgia16, you really don't need a lawyer to do it...Just gather all the documents required and do it yourself. The guides and good people at VJ will help you along the way...Just remember, if you do hire a lawyer, you still have to do the work and provide him all the required documents, all what a lawyer has to do is fill out the forms according the documents you submit to them, then they file it on your behalf...Save your money!

    2) Do you have another copy of your DS3025 or do you remember what it looked like and does it have a tickbox selected stating ''complete"?

    3) Responding to the RFE is going to require you either going to a CS and getting the full medical, or going to a CS who is willing to sign off on the vax sheet portion only. But this will depend on the exact wording, as those who have had this issue (myself included) have encountered various wording as to what they really want from you.

    No. You must complete exactly what the RFE requests. So the wording of the OP's RFE is very important. A K1 is not required to have a new medical exam, correct. However numerous instances of persons being asked for a new medical regardless are happening, and quite a few are those who went through London. It can happen that the USCIS has lost the medical, finds what papers they have been given deficient, or simply the officer reviewing the case is ignorant of the rules. You will never get them to admit which is the case.

  9. Hey everyone, I could do with some advice. I just received a RFE today asking me to submit a complete Form I-693, completed by a USCIS Civil Surgeon. I came on the K1 visa and had a medical in London, and included the DS3025 vaccinations record I was given in the AOS application. Does this mean I need to get a new medical done in the US, or get the record transcribed? Just a bit confused having already had the Knightsbridge medical.

    Any info would be greatly appreciated

    You don't need new medical exam, if you had some vaccination shots missing, then you need to get those shots by one of the Civil surgeons and they will complete the form for you that you will need to submit showing that you completed all required shots. I suggest you take your vaccination record with you to Civil surgeon and see if any are missing. They will complete to form and have it signed for you.

  10. I just got a letter in the mail today from USCIS California Service Center (CSC) in regards to my inquiry from last week. The letter basically says the following:

    "Your case is within a batch of cases that is currently being prepared for shipment to NVC."

    At least this gives me peace of mind that the case has not been lost or sent to the wrong entity. Wanted to share this with everyone else here waiting for NVC and hoping everyone get to NVC soon.

    USCIS was shopping around for discounted shipping rate this why the delays of a batch of cases...hahahah. At least that is a good news

For what I understand pch1, when you talk to a USCIS Tier-2 supervisor, you are talking to someone located at USCIS main headquarters, (located in Washington, DC I believe), and not the service center itself where the petition was actually approved. For example, when I spoke with Tier-2, she was nice and everything, took the case details (names, DOB, case #, etc.) then typed an email to CSC for them to research the petition. In other words, they (USCIS) just relay the message to the approving service center to locate the file, CSC in my case. I believe this is hope they do things, please correct me if I am wrong.

    MandyAlex, I am searching for a post that I read on VJ where someone actually did call Tier 2 at USCIS and were able to locate their file...If I can find it I will post it...

    Honestly, I am trying to find an answer for you guys that can help you calm down and give you hope...I am typing as fast as I can to get any information that can be of help to you...I just hope all of you can get your case number cause you guys are stressing me out....hahahahahah...

  12. You are dealing bureaucratic system. Even it is within your rights to contact your congressman and the office of the congressman conduct their own investigation or inquiries, if USCIS determine that your petition is within the time limit or if it needs more security clearance, there is going to be nothing the office of the congressman they can do about it but inform that your petition is still being processed. Would it help in expediting it, maybe yes and maybe no and might add more to the delays if your case is in the hand of disgruntle employee feeling pressured from the top.

    This is my own humble opinion of course, but you can proceed with whatever make you feel comfortable and if it works for you, that is great... Good luck!

  13. Just saw what you posted pch1, that's very informative. Is the USCIS hotline different than the regular number we usually call?

    I've tried speaking to tier 2s it's just super hard because they do that stupid call back and there is no wifi connection here in Afghanistan and I can't use the google/hangouts/skype stuff because the Internet on my phone drops the call it's very weak here. Luckily it's strong enough for safari and Firefox and email that's about it lol.

    I'll be back in the states mid- August end of August if God forbid I'm not at NVC by then I'll be calling tier 2s ALLLLL DAY EVERYDAYYY lol

  14. This is something I just came across while googling about your cases you guys...lol


    In some cases, if you still haven’t gotten your Case Number past 8 weeks, you should call the USCIS Hotline to confirm if they have indeed sent the case to NVC. USCIS will confirm if they did send it out to NVC. If you call NVC and they tell you that they still haven’t gotten your case, chances are, USCIS didn’t forward your petition to NVC but to the National Records Center (NRC). It could’ve been “accidentally” tagged as an “inactive petition”, therefore, sending your case to NRC means it’s being archived.


    What is NRC, you ask? It is USCIS’s Center for record-keeping, an archiving facility.


    At this point you shouldn’t let go of this trail. You’d have to call USCIS and ask for a Tier-2 / Manager / Superior to discuss your case and get it back.


  15. I did talk to Tier2 office this morning and mentioned this e-mail and what is it about.

    the funny part is that The Tier2 Lady i spoke with don't even know what does that means,

    she said it might or not has been sent lol, explain that to me, if they don't know how would you nor i knew.

    if i know from the beginning this process might be complicated to this level i would have gotten married and filed i-130 instead.

    it's Already to late for that now.

    let's wait and see.

    Tier 2 person can input your WACxxxxxxxxx and right away can tell you where your file is...You have to tell them please just check on my receipt number this is all what am asking...You keep calling until one of them will turn out to be having a good day and help you out with locating your file...You will definately get different answers from one person to another...I would stay on the phone all day and just keep calling back and speak to someone else...Even if you did the I-130 and they still decide to do background check, it will take time. But you really are in the final stages and its just a matter of waiting and when your file at NVC then things go smoother...

    what do you think about this message, your petition is in the processing of transferring to the nvc? do you think it has been sent or still in the process of sending over to the NVC.

    Plus once you call USCIS Remember when they told us, Please wait up to 90 days for uscis to transfer your case to the NVC,

    and we are still within the 90 days and haven't been past due.

    Farzram if i were you, i would wait a bit more.

    I Have been waiting longer than you are and i want my case number so badly,

    But we are at the final stage of the process and don't want any mistake that might lead to more delays.

    My own personal opinion, I am 99% sure USCIS still have your petition and still, hence the "Processing of transfer" the NVC does not have it and if they did, you would had your case number by now. Like I said, if you can get thorough to Tier 2 at USCIS and sweet talk them to locate your file, am sure they can do that...You guys are still within the 90 days and if it does go beyond that, then yes, by all means contact your congressman, its your right to do so..

    I Don't think our cases misplaced or has been sent to other department,

    USCIS INDICATE that our cases is in the processing of transferring to the NVC, That means they still have our cases for further process or en route to The NVC,

    Contacting congressman should be our last option,

    you don't want pushing The case to be over reviewed, inquiries from second hand might delay the process, that's my opinion for now,

    i would give it more time, A week or 2,

    I think were are Almost there, And matter of days or hours till we hear some updates.

    I agree with you Achraf...contacting a congressman in regards to a case that might or might not be within the time limit is tricky. Each petition with NOA2 have an expiration date, I suggest that people wait at least a month prior to the expiration to contact their congressman. USCIS might get annoyed with people going that route when their cases are within the time limit range and to have someone from the top calling them. This might expedite the case and might delay it even longer...You are dealing with the government and they can always come up with excuses and reasons that a congressman can't override.

    I suggest everyone just chill and relax for a little longer...let the process take its course

Most administrative processing is resolved within 120 days of your visa interview. When additional administrative processing is required, the length of processing time will vary based on the circumstances of each case and some cases this can take up to one year. If it take really long, you might want to consider calling your congressman.
