To my knowledge, I have to say it will not effect your petition at all. I believe background checks are done on the petitioner and not the co-sponsor. Remember, background checks are done to see if Petitioner has any criminal records that will deem him danger for you as a fiance. Same goes for fiance and background check with Police clearance as well.
But the answer to your question is the co-sponsor having DUI will not effect your case at all.

I guess what I'm trying to say is that I really don't know if the interview date will be prior to my vac.date. I wishing and hoping for interview around late august early sept. and not go to the interview so if he gets approved by the time I go for my vac. I can bring him back with me.

Oh sorry, I just noticed the September date...well, I think you cutting it too close...but maybe you want to ask someone in DR thread or maybe someone can respond if you can file for extension in case your case arrive early. Am not sure how that works but maybe someone else can comment

I'm so nervous, I am traveling for my bday wknd to Dom. rep. To celebrate with my fiance in sept. Now, my dilema is that NVC has not yet Rec'd my package and I'm scared that the interview can be around the same time of my vac.
Your NOA2 dated 7/20 you still have sometime before your case at NVC... at least a month by looking at members lately and then time for the file to be sent to DR , then then then... you follow the instruction on proceeding with K1 visa application...... u have time to vacation

So, are you in Armenia or Dominican Republic. your timeline shows two different countries and each county has a different processing and procedures or requirements.
In Armenia petitioner can't be at the interview...DR , yes ...just as an example

By looking at time lines from some member of Lebanon, most had the file received in Lebanon in less than 15 days...I think most the security and background check is done at USICS.

Farzman, that e-mail you received the same as mine remember?
it means they have sent your file to the NVC. ( Your petition is in the process of transferring to NVC )
I Spoke with Tier2 this morning and told me that it means on its way to the nvc or they have received it But haven't been in put into their data base system.

Just check the status on CEAC , enter your case number and you notice the action...maybe in couple days it will say in Transit...For Lebanon, I might take a wild guess since most are sent by DHL, I have to say 10 to 15 days until it arrive to Lebanon...Mine is in Singapore and still show in transit since the 19th of this month, but we already began the process of paying and completing the DS-160

Congrats achraf!!! So happy you finally got there. Just saw your post and called myself but they didn't have my case:( she even put me on hold and got a supervisor because she said it should've been here by now- but she said they can't locate it and told me to tell a tier 2 at USCIS to send it again.
Tier 2s there are useless and I'm just going to wait it out I guess , maybe I'll get lucky and be there soon? Who knows. Very happy for you guys and I wish you luck in your interviews and approvals

i called them this morning and they said. they don't have anything and they even send me two e-mails stating that they don't have any record receiving my case.
So i was like let me call and check again half an hour ago, the lady answered and said that they scan my case and i have to wait till they update it in the system.

Yes, they will give you case and invoice number. I called three hours after they told me they have my file and to call back in ten days, I called in three hours after and they had my case and Invoice number....good luck on the rest of your journey!

It just got us worried as my fiancee ( petitioner ) called yesterday to uscis and ask the same and the customer service sounds like we're back into zero.
I'm just now praying and hoping to get our Noa2 as its been 73days that we're waiting.

It varies by embassy. Most embassies including the one I applied to require I-134 to be dated within 1 year preceding the interview, but you should check with your embassy as they might have a different time frame.
This is what they require from Guangzhou Consulate as far as affidavit or support.
□ AFFIDAVIT OF SUPPORT (I-134) AND EVIDENCE OF INCOME: The Consulate requires evidence that demonstrates that you and the members of your family who will accompany you are not likely to become public charges after immigrating to the United States. Please submit Form I-134 signed by your petitioner. The form should be accompanied by evidence of sustained income or financial resources, such as his/her most recent tax return. If the petitioner’s income does not meet the poverty income guidelines (please see http://travel.state.gov/visa/immigrants/info/info_3183.html),you may submit an I-134 signed by a joint sponsor along with his/her most recent tax return and proof of U.S. citizenship or legal permanent resident status. Even if you submit this documentation, a consular official may at any time require additional evidence to determine your eligibility.

Thanks. In the internet age, I just don't like international snail mail. If I dated the documents around the projected time we are to receive the NOA2 would that be close enough? Or maybe 3 months from the NOA1 date? What is there typically; another 2 month delay between NOA2 and the embassy interview? For China, the Guangzhou Embassy actually refers to "Packet 4" , not "Packet 3" for the K1 Visa. I have that list from their site. Just wondered about anything else with my signature she might need before she got to USA.
Yes, you are correct, in Guangahou case they issue packet 4 when most other not all, issue packet 3 followed by 4. Either way, I would send the letter of intent along with I-134 right after the NOA2 approval.
In my case, I sent my fiance entire complete copy of the petition as well.

Thanks. So are the only two points in the normal process where we need forms with each others signature and are in different countries for the I-129F packet and the Embassy Packet? We prepared the I-129F packet together and I brought back her signed papers. I'm thinking of going back and preparing the Embassy Packet together with her. Are there any other forms she will need original signature from me before she gets to the USA that aren't in either of those two packet checklists?

When it comes to the embassy, it depends on which embassy and how they process the K1 visa application. You need to look at the embassy information. Most the time, packet 3 will explain what your fiance need to bring to the interview. But as far as if she would need any other forms from you the petitioner, I have to say just the I-134 and I would write fresh new letter of intent to marry closer to the date of interview...this will need your signature and date as well.
It really help a lot to read on Vj if you have time. So much information that you can use to get you ready and prepared that will help you now, and in the future...This is some learning experience in progress for sure...Best of Luck...

You will send them to your fiance.. The I-134 should have wet signature and any other document such as Tax Transcripts etc can be copies. So, you should send them by mail, DHL, Fedex etc...

First of all you say you are permanent resident and that means you are not a citizen yet, right? So tell us your status fill up your timeline so we know more about you what is it you are trying to do...
Second,. There are no Islamic Laws in the USA and Sharia laws does not exist here. Its all on you to provide a certified marriage licence from the UK somehow, somewhere. If the UK would certify the marriage license then am sure the US will accept it. If you are married under Islamic laws, how can you claim on a form that you are single?

The I-129f itself, you sign and date where its required...Also if you are attaching any extra sheets, you sign them.
Letter of intent, you sing and date.

The cover letter, I don't think its required to sign but I did and I dated it as well...does not hurt
You passport picture, in the back you write your name and date
Photos with your fiance, you write explanation on the back of when and where they were taken, just to give them an idea
I also signed copy of chats and I highlighted the dates on each page.....not required but I did it anyway.

I think the best bet for you guys is to wait for her to get insurance through her Employer and if not, then she needs to buy insurance under the health exchange including you. But for the mean time, god forbid, if you need any medical attention, you be sure you go to Urgent care facilities and not Emergency room unless it is serious. Emergency room can be very costly vs urgent care. Best of luck!

Thanks all for your help.
I completed the customs form on the flight to Dublin and did the k1 processing there so I was assuming that Dublin would count as the POE but just wanted to make sure as it was outside of the US.

I was doing some googling and from what I read, you are right, Dublin would be your POE.

You need the I-134 with original signature...I-864 is used for Adjustment of Status when your fiance is already in the States and both got married.

During your flight from Dublin to Dulles Airport you were given Custom Declaration form? If yes, then your port of entry is Dulles Airport even Dublin considered a preclearance site for immigration.

Definitely you need to call the Fraud section at USCIS. This woman will never be able to stay in this country legally. No way Jose!! You be sure you keep that text message...But first of all, you have to be sure that she is not really back home and be sure you saw her with someone else...I am not sure if the airlines can release her name to you as a passenger, but am sure she if cleared immigration, her name was there entering the states...I have heard of cases like this before happening from the the Philippines.
