  1. Either she came with a visitor's visa, which is the B2, or she came without a visa, in which case she would have taken advantage of the Visa Waiver Program (VWP). None of this matters, as she entered as a visitor with the intent to adjust status, which is visa fraud.

    No, he can't get a SSN for her unless she has adjusted status, and he can thank Jesus Christ and the 7 dwarfs if she's not denied adjustment of status for the fraud and be deported back to the Outbacks.

    Let USCIS decide if that's visa fraud not you. I just needed to know if she can apply for SSN.

    I think you might be missing some details about what process your brother is filing for his wife.

    My brother married his wife and did wedding in Australia. She came to visit him and I think she came on the visitor visa. While she's here, my brother filed for her and he's got appointment for fingerprints already. He's wondering if he can apply for social security number for her. I-94 expires on feb. 17.

    can he apply for SSN for her?

  3. So your brother's wife came on a tourist visa. Can not get a SSN with a tourist visa.

    Is that what the visa waiver program is for? Only for tourist? He told me his wife came on visa waiver program, I'm not sure if that means she came as a tourist.

  4. Did they do the Tuberculin skin test in her home country or just the chest x-ray?

    If she had the BCG vaccine when she was younger but they only did the chest x-ray, it would've been clear but the BCG vaccine has been known to cause false positives on the TST.

    Ya, she said they did the both the skin test and also chest x-ray.

    I'm looking at her vaccination card from home and I don't see any BCG vacines. am I missing something? Is there a specific name for some of these BCG vaccinations that I should look for in her vaccination card?

  5. If the chest x-ray is clear, then she could be false positive. Did she show them the x-ray?

    False positive will show up in people who had BCG (anti TB) vaccine - they received it so that's why it shows as positive.

    I told them my fiancee has her chest x-ray from her home country and we can bring that to them but the nurse said that x-ray is only valid for 3 months. so they referred us to a place and we did take a new one.

  6. My fiancee was tested for TB (negative) in her home country and did chest x-ray before visa was issued. She arrived in the states about 2 weeks ago and I decided to get another vaccinations for the I-693. They tested her again for TB and said it was positive. My fiancee said she hasn't come in contact with anyone with TB since her last test in her home country.

    Does this mean she has TB but wasn't detected during her first test in her home country?

  7. Although my fiancee just arrived less than a week ago. I'm thinking I'll book an appointment to have her redo her medicals and vaccinations again tomorrow. We'll take her vaccinations card so the doctor can decide if she needs anymore shots. I'm gathering the paper work.

    Is this a good idea or not?

  8. On I-485 section A, it states: " Give your name exactly as it appears on your Arrival/Departure Form ( I-94 )"

    problem is on my fiancee's I-94 they only wrote her last name and her first name on it, leaving out her middle name.

    Is it ok if I include her middle name on the I-94 form myself so it will match what I'll write on the I-485 form?

    I'm a bit confused as to why they didn't write her full name on the I-94 at the POE. advice please.

    We went to the SSA and received the SS card in her K-1 name.....

    When we got her greencard we went back to the SSA to order a new card without the "restriction" language...

    either way you end up with a couple trips to the SSA so it all depends on when you want to make the trips

  10. In MN you get a marriage license from the county... MN has a 5 day waiting period from application to receipt of license. Once you have the license you can get married whenever you want within 6 mos. You find a registered officiant... could be a judge, priest, pastor, rabbi, cleric, neighbor, co-worker, etc... anyone who is registered with the State to perform marriages. The license bureau might even have a list you can see. I had someone in my workplace who was registered and she did the ceremony.

    On the MN marriage license application you will indicate your current name and the name you want it to be after your marriage. Either party to the marriage can change any or all of there names. My wife changed the spelling of her first name, adopted a middle name and changed her last name.

    The after marriage name on the license is the name that you should apply for AOS with.

    The St Paul office of the SSA is a good office and understands the K-1 visa and eligibility for SSN.

    Is it a good idea to apply for the SSN after marriage so my fiancee's new name will appear on the social security card?

  11. Can anyone run me through the civil ceremony process, please. How does it work? is it all private and simple, quick? After applying for the marriage license, do you then take that to court with your rings and get and get married there and that's it?

    Let's say, we fill out the name change section on the marriage certificate and we get married today. Can my fiancee use her new name to apply for the AOS process?

    advice please.

    I'm also thinking, I'll wait till after marriage to apply for SS# so my fiancee can use her new name to apply for the social security number. good idea or not??

  12. If a properly prepared & complete DS-3025 was included in the POE packet then the answer is suppose to be no...

    However, you have no proof that a DS-3025 was included in the POE packet... so you have a choice... submit the I-485 with a possible expectation of an RFE (and then get the CS to transcribe the vaccinations) or have the CS transcribe it up front and include it in the original filing.

    Better safe than sorry, I'll choose option 2. So what is CS and where do I get the CS to transcribe the vaccinations upfront for me? like you said, I have no clue what was in that brown envelope.
