  1. I guess I should read pub 519...when I can't get to sleep. ha! So we have to put their income on our taxes? I'm going to play around with turbotax tomorrow and see what happens if I do married filed separately or jointly (if it lets me go back and change, which I think it does)...then wait until my Finn gets his SSN (which will be before 4/15). So confusing!

Speaking of sleep Mark, I bet you can't sleep tonight!!!!! Yay!!!!

Only slept in fits and starts, if you can really call that sleep. I have been up since 4. Her flight landed 6:22 (4:22 my time). It is 5:09 and I am anxiously awaiting the "I am here, my love" call. Man, I hate waiting....

Then they get here to Seattle at noon. Oh happy day!!

  2. Does a spanish issued in Spanish language has to be translated in English?

    Thank you.

At NVC you don't have to translate any documents that are in English or in the language of your home country. From your timeline, it appears you are at NVC. From your profile it would appear you are doing everything in Chile. So, I would say you don't need to translate your passport.

  3. Add two weeks to that Mark, and you have my count!!!!

Hey, btw, how are you and everyone else filing your taxes? I'm so confused...I don't know if we should wait until they get their SSNs (if they move here before the deadline), or if you can even file jointly if they didn't live in the US last year! Makes my head spin.

According to pub 519, I can count her as a resident for tax filing, which will be to my benefit (since she earned way below the allowed foreign-earned income exemption), so I just get the additional allowance. Pub 519 only talks about the ability to treat the spouse of a citizen or PR in this way, it omits other dependents, so I can't treat my stepson (which would be another allowance, but would add child support complications that I would rather worry about next year). So, I am waiting for the SSN. I should have it in plenty of time. I will have all the stuff done in TurboTax and will be able to push the button the moment the number is in.

But I am not versed in tax law, so follow my lead at your own risk.

From what I have read, you can file married filing separately, in any event.

  4. Hello Gang!

I'm sitting at Logan airport in Boston using the free wifi waiting for Diane to finish work to pick me up. I have just had my visa stamped and I am officially a US resident. The whole process took literally 5 mins. Nothing to it. Exactly 7 months to the day since we got married we can start being a real married couple.

Happy, happy day!! A week from today it will be my turn :)

  5. Hello everyone,

I have a question regarding the form DS-230, I'm confused whether I should put my wife's last name or whether to put my last name as her Family Name and then where it asks for Other Names used put her maiden name. The I-130 application was filled out with her last name, the reason for this is that in Peru there is no name change for marriage. My spouse is going to get her passport for the first time, for what I'm informed NVC gives you the visa according to what name it states on the passport. But lets say that in Peru they don't want to change her last name in her passport, and she stays with her maiden name, can I still fill out the DS-230 with my last name as Family Name or should I go by what's printed on the passport. Our biggest concern is that we both want her visa to be issued with my last name, this way her green card also has her married name, this way we don't need to be doing any changes afterwards. So basically on her I-130 applicaiton she has her maiden name, on her DS-230 I would be putting my last name as Family Name, and hoping that her Peruvian passport they change her last name to her married name. I hope somebody can help me on this issue, and I hope I was clear enough. Thank you in advance.

Hey man. We just finished up in Lima. It doesn't really matter what you do on the DS-230. NVC will change it to match the passport. That's what they did in our case. I will just go through whatever I can to get her name changed on everything here. We tried really hard to get the name to be American-style, but RENIEC refused. And once they refused, it was all over but the shouting.

The good news is that I don't think you can mess it up. I used my last name as the family name the whole time, but NVC forwarded the case to the embassy with her name as it appears in her passport.

    Good luck.

  6. When I entered they confirmed my current US address so informing at POE should be sufficient. Your wife can reconfirm this when she is being processed. If you were to move after the POE then your wife would need to file an AR-11 and you would need to file I-865.

    Good luck

Okay, so I have now moved and will be filing my change of address as sponsor with USCIS. My wife will inform at POE of change. To ease in this I am writing a letter she can present to the agent (in case of language barriers, etc). My question is who should I address this to? What is the agency? What is typically the title of the agent in question? Just trying to keep it as formal as I can.

    TIA.

  7. Congratulations! I bet you are all so excited!

David got the visa and will be here the 8th. I think he going to get a return ticket even if we dont use the other end because it is half the cost.

I can't wait! I feel like a little kid on Christmas eve!

Super excited!! Of course I am pretty beat right now, as I just finished moving to a new place. Now where did I put that freaking corkscrew...

In case you were wondering, entry will be 02/15/10 (yipppeee!!).

  9. i pay 400 $ visa fee bill to NVC , then i send form DS 230 with all another requested document,.

Now we waiting for NVC to give us date of interview.

But , i have one question, did we have to pay any more many (to embassy) before we go to interview?

Cause ,i read on embassy web page , that there is fee for visa, so is that what i already pay to NVC , or is there something else to be pay?

Just the one fee. You don't need to pay again at the embassy. The embassy collects the fee for DCF (I believe, but someone will correct me, I'm sure, if I am wrong).

  10. Yes, you will find it on the visa page of her passport. It is listed under the registration number. My "A" number is the registration number with a "0" added to the front. For example on my visa the number was listed as "12345678" and the A number on my green card is A 012-345-678.

    Good luck.

Okay. We noted the "registration number". My concern was the lack of the "A" when she quoted it to me. My wife is lots smarter than I am (and, what's more important, smarter than I give her credit for). :)

  11. Yes, coordinating flights can be a real pain in the a$ As far as the luggage... I can tellyou that there is a 99% chance that they will only check the bags through Houston since you purchased seperate one-ways to Seattle... Foreign airlines have a big issue checking bags through US airports.. In houston they get their bags, go through customs after immigration, then there is a connections desk just outside the customs, they can direct you to where she needs to go to re-check the bags, if you are taking Continental, they they can usually check them right there, other airlines I am not sure...

Yeah. I figure that is a possibility. The only hope I have is that all the flights involved are Continental. Worse comes to worst, she has to pay for her bags on the connecting. Oh well, it will still come out cheaper than the other permutations I looked at.

  12. The I-865 requires an A#. This is assigned at POE, right? If so, I can't complete this form until they actually enter, or can you fill it out indicating "unknown" or "unassigned" in the spot for A#?

    Mark

Of course, if I would learn to read instructions, it tells you to write "None"... Duh.

    edited... adding...

Check that. Writing "None" would be for me. It does not say what to do in part 2 which is the sponsored immigrant's info. So the question stands. What do I do?

    Mark :)

  13. Great news Mark! You do have my head spinning with the flight info though...ha! I don't quite get how the two itineraries work...you have me beat though! Finn Man won't be here until 3/3...but I go get him on 2/23! I was able to get a very reasonable flight (and his one-way flight only wsa $500 on Iceland Air!). I can't wait for all of us to get together!

How did you manage to get your return to coincide with his one-way? That was the problem I couldn't solve...

Very soon now... Of course, by the time Finn Man gets here, my wife and I will be an old married couple :)

    :(

That blows! I hope you have a speedy resolution to the RFE.
