  1. its obviously their fault, just a typo. I too would make an infopass appointment.

    Like I said i never had a problem since day 1 in my K1 process.. and also i just checked all the photocopy of documents i sent them when i filed my Removal of condition in July 2009.

    I remember they have it wrong in my biometrics notice and i am 200% sure that when i had my biometrics I told the person who did my fingerprinting that the notice i got was wrong and i even entered my name and everything in their computer myself to correct the error in the notice but still My green card appeared wrong? Can anybody tell me how to make an infopass? Thanks a lot so much to all.

  2. Hello fellow VJ members,

    In connection with my other post about the wrong data in my 10 yr. green card,, some said I need to file I-190 for correction of my green card.

    The fee is $370 and some said if it's their fault for the clerical error then i do not have to pay for the fee. My 2 yrs. green card is correct but my 10 yr. green card is not.

    My correct name is:

    First Name ---Maria

    Middle name/single name---Llamera

    Married name--Smith

    The 10 yr green card shows:

    MARIA LLAMRA SMITH ( letter "A" is missing)

    My questions are:

    1. Who's fault is it that my green card is not correct? I did sent them a copy of my 2 yr. green card, old and new passport and other documents with correct spelling?

    2. SHould i pay the I-90 fee which is $370.00?

    How can i convince them that it is not my fault for the clerical error in my card?

    Please please i would appreciate your help.

  3. You have to file an I-90 form/application to correct that USCIS administrative (clerical) error. Submit photocopy of your card of that particular error and other documents that you need to prove. If your other supporting documents that you need to submit proved that you have your middle name correct, while your 10-year green card shows different, you don't send payments or fees for that error, otherwise if it's your error that you misspelled it since the beginning of your application (your previous documents --examine or look it up) then you have to pay for that....Go to USCIS website and look on FORMS section and find I-90 form and instructions to fill that form and follow instructions. USCIS phone hotline is just useless, they will just tell you stuff that they don't even know deeper...Just follow the I-90 form/instructions how to process that....

    Thank you. My 2 yr green card shows the correct spelling, only in my 10 yr. green card. I don't know if who's fault is it since my 2 yr. green card had no problem and every documents. just the 10 yr. card.

  4. I'm here in Vegas, My mom ask the DFA in the Philippines and told her that but the DFA in Manila that one signature of the parent is good but the DFA in Pampanga sad it should be both signature of parents

    Mom applied for my son's passport in La Union and all i sent them was the SPA and the travel consent signed by only me coz my husband(petitioner) is not my son's biological father.

  5. Members, please keep those inputs coming. Based on your replies, oath-taking will take place but ONCE (meaning, there's no need to take the oath again ever). On the other hand, passport should be renewed every 5 years, which I know because I had my Philippine passport amended and renewed 2007 and will expire 2012. And I sent my application in Washington, DC without going there or anywhere else and I got my new passport by mail too.

    So I am just wondering, Ms. Happywi...why do u have to go to Atlanta? Is it an immigration office? I am from Alabama so I am just curious if instead of renewing my passport in person, like DC, is it possible for me to show up within the vicinity of our state?

    Yes i have meet several pinays from Alabama who came to Atlanta Consulate office for personal appearance and they just send their application in DC. i have a pinay friend also who sent her application but did not even have personal appearance.

    I am not so sure if u have to go for personal appearance. That time kasi when i was there DFA employees from (DC) had an outreach in Atlanta (they do it once a year) and all those who had their oath taking for citizenship, passport renewal application were done on that same 2 days activity. If i were u try to call DFA in DC to make sure about this coz my responce is based on my experience.

    Been quite a while since i last posted a topic here as we been busy on my kid's I -130 who are now in NVC and of course me being a full time worker. But even then i still have time to read vj everyday and answers questions as much as i could to be able to help others.

    I have a quick question. I received my 10 yr. green card early December of 2009. I did not notice till yesterday that the middle name in my card is incomplete. There was 1 letter missing but my Married and first name are correct.

    Example: My real correct name is:

    Maria Llamera Smith

    (First name) (Single/middle name) (Married name)

    In my green card it shows: (lacking letter "A")

    Maria Llamra Smith

    Should i be worried about this? SHould i call USCIS for correction? Pls I would appreciate any help. Thanks a lot.

  7. If I was to reacquire my Filipino citizenship, I'd be required to take the oath in front of the consulate in Washington, D.C. where my state of residence is under jurisdiction. I'm fine with that. But my question is, is it true that I have to take the oath or renew my passport every 5 years w/c I read in one of the discussions here w/c I quote, "She would then have to go to the consulate every five years to renew her Philippine passport. We don't live anywhere near one, so that means paying airfare and hotel for our family to get there every time she needs to renew."?

    I've been looking for a specific part of that law mentioning the "5 years" and still can't find it. Is there anybody here who can show it to me? I would love to hear your input on this for accuracy.

    In my books, it is ok to do the oath-taking face-to-face once but doing it every 5 years is ridiculous especially for applicants who has to travel that far. Besides, it also involves money, how about for those people who can't afford to do so, like me? Legislators, please do some amendment. What do u guys think?

    Oath is done only ONCE but passport shud be renewed every 5 yrs. I renewed my passport in washington dc by just mailing the application but had my personal appearance here in Atlanta. You don't have to go to DFA office personally for renewal of passport.

To all those who have knowledge about filing CRBA for their child out of wedlock,How will i strart the filing and what are the necessary documents and fees?Our hospital bills and some of the documents,my fiance brought them along with him coz he will need it to show in his work coz he filled a paternity leave when i gave birth.My question is will it be ok if he will just send those to me in email?that will mean i will not have the original copy in my hand?and can he just send me a scan of his birth naturalization too and passport.Whay is the average maximum time to obtain a CRBA?

    Check ur email all the info is there..i just sent it to you. Documents submitted for CRBA application are all ORIGINALS but will be returned to u during the interview. You need to have those hospital receipts and bills with you coz tthe embassy will ask it from you, believe me been there done that . Good luck don't hesitate to ask and email me if you have questions , So many pinays here who have gone through this are willing to help you.

  9. I'm a K1 beneficiary and our daughter(11 months old)is a K2 beneficiary..Do I have to get a separate passport for her?or will it be ok without it?

    hEYi forgot to tell u. The best thing for u to do is apply for her crba and u don't need to worry about k2. once your crba is approved she will be issued a US passport and no need of k2 visa coz US citizens don't need a visa to come here. All they need is a us passport.

  10. Hi I'm done with I-864 for my son and now I need to do the DS 230. I am just wondering because it says on the DFA website when getting passport for minors and both parents are in abroad we need to have an SPA and affidavit of support filled out and sign in front of the consulate. But it says on their website that personal appearance of either parent is okay to get a passport for my son. SO with that can one parent just do the SPA and affidavit of support so my mom can get a passport for my son? because my husband is here in the United states but I dont really have a good contact numbers with him.

    So are u also here in US? If yes ,,before your mom can get a passport for your son..you need to send her an authenticated Affidavit of Support and Travel COnsent ,and Special Power of Attorney . These affidavits should be authenticated from the DFA here in US . You don't have to be with ur son when he applies for his passport as long as you give your mom the Power of attorney on your behalf. I am here in US and my 7 yr. old son just got his passport 2 months ago and that's what i did.

    Hey girl so many fellow pinays here can help you on how to apply for crba.

    I did that almost 2 yrs. ago. I am alread married to my USC husband and is a permanent resident already here in US when i gave birth in Pinas to our child. Eventhough i was already married to the father of my child..still i had to apply for my baby's CRBA to get his US citizenship because he is not automatically a citizen. Read my reply to your other post.

  12. What if the father of my daughter is my fiance,who is a USC. We had her even before we file for a K1 visa petition,we also get a K2 for her so she will be included,,But some are saying K2 is not needed anymore,we might as well let the Consulate in Manila about it so if they will approved no need for K2 visa and she is automatically a US citizen too coz her father is a US citizen...I thought that is just for married filipina and US citizen one..My fiance even took a paternity leave when i gave birth and he is the one who even register the birth of our daughter and get an affidavit that Kiss(our daughter)can carry her name even we are not yet married...

    It is NOT true that your child is automatic US citizen just because the father is a USC. You have to report your child's birth to the US embassy in Manila and apply for CRBA. Your child can have k2 visa if the baby is included in the original k1 visa application.

    Your child is not yet a US citizen unless you files for her CRBA and is granted the US citizenship. Wether you are married or not to the father of that child,,still you need to apply for CRBA since she was born in the Philippines.

  13. My finacee got her Cenomar and NBI clearance in Dec 09. She was to interview on Jan 14th,2010 but had to do the Sputum test at St. Lukes thus delaying the interivew.

    We are now waitng the result of the culture which will be ready March 11th, If she pass's and is reschelduled for interview will the Cenomar and NBI clearance she received in Dec 09 still be valid or does she need to get new ones around March.

    I prefer not to have anymore setbacks if she clears this next hurdle. Please advise!!

    No she don't have to get a new one because the NBI has 1 year validity and CENOMAR has no validity period.

    I think she meant "forms" as in AOS forms. What u need to do is read the guide here on how to adjust status gurl.

    You need to gather all the requirements or documents first before you even fill up your AOS form. Read the guide here on how to adjust your status. Gud luck gurl.

  15. USC husband can file I-130s for the kids if they are unmarried and the marriage to mom occurred before their 18th birthday. If they meet both requirements, then it should take about 6-12 months for the kids to get visas.

    Read the guide here about the I-130. Yes your husband can file an I-130 petition for your 10 yr. old son. We just filed last April and got approved this month.

    Is your husband the father of your kids? Are the kids filipino? If your husband is not the father of your kids.. he can file an I-130 petition for your kids being his stepchildren. Thats what my husband did for my 2 kids now.

  17. My wife just got her green card on Dec. 15th. We want to fly to the RP a few days after Christmas. Of course her green card has her new married name, and her passport has her old maiden name. Will this be an issue when flying? She will probablly stay a little over a month, because she is 9 weeks pregnant and is really craving the Filipino foods...so I told her she could stay until week 20 if she wanted. My next question is, if flying there isn't an issue? Once she gets there can she just redo her passport while in the RP and get the name changed? I know she can send it off to the consulate in L.A. but we wanted to leave sooner than time allows us to do it that way. I guess my major concern is her getting stuck in the RP, even though she has her greencard.

    She "May" have to do CFO again if she try's to change her name in her passport in PI. I'm not sure on that tho since I imagine she's done CFO once already

    Or she can apply for a new passport (with her married name) when she gets back from PI. or she can have her passport ammended first.

    There should'nt be any problem. When i went home last year ,my green card was in my married name and my passport was in my single name. Never had an issue.

    You put the name of the person who is accompanying your child to get a passport. You dont need to have a lawyer.You are just giving your sis the consent to apply for your child's passport in your behalf. Or you can make it in your own word ..something that says I, ___(ur name) is giving my sis ______(her name) to apply for passport for your child. needs to be authenticated since DFA Pinas will not accept it unless it has red ribbon on it.

But in the upper portion they didnt check anything for me to submit. Maybe they will just give me instructions on the mail that they will send me.

    I just don't have any idea now what will happen next. And how long it'll be. And if the applicant just need to pass something again to them. Or will they instruct me to have another interview. I don't like another interview. I had enough nightmare. The questions were:

    1. Where and when did you meet your fiance?

    CO: what site?

    ME: Filipinaheart sir

    CO: Oh, I know that, it's a site where they render visa something.. people get to seek faster visa processing or thingy.

    ME: I don't think so sir. COz it's a dating site sir.

    CO: No, I know that. It seems you don't know this site well. ( his voice was kinda intimidating already and his eyes were sharp)

    ME: Sir, I know it because that is where My fiance and I met. ( My reply was a bit calm yet i'm kinda pissed coz he was in a debate mode, wherein im not and i know im saying the whole truth and i know it well)

    CO: So, you mean i'm lying? and i don't know it?

    ME: I didnt say that sir, I was just telling you it's really a dating site where we've met.

    CO: So, I see you have some relatives in US.

    ME: Yes, sir. sister, brother and my mom.

    CO: I see, you know people who have relatives there are highly introduced to someone.

    I Suppose your relatives took part in it., And they introduced you to him.

    ME: Sir, no. Coz we met online. They have nothing to do with that.

    CO: Oh, really? Well, is your mom a US citizen?

    ME: No sir, she's just legal permanent there but was married to an American.

    ( This is the truth guys, coz my mom isnt a citizen yet, and until this day to be honest i dont know why my mom doesnt want to take oath or to be citizen. My mom and i were not that close and i dont question her decision when she left us and married. I was too young when my mom left us. I was only 8. And I've seen her again 2004. She left us like around 1192 and showed up 2004 when I graduated in college. then showed up again 2007 and 2008. but we never talked about her status in US. SO in short, I dont know much about her condition there.)

    CO: are u sure ur mom isnt a US citizen?

    Me: Im sure sir.

    CO: I guess you didnt meet your fiance online. I guess you're not telling me the truth.

    ME: (I raised my right hand) - - Sir, I swear to God im telling you the truth. We met online in that site. (I almost cried) but didnt show I was scared of his smart #### comments. I stood for what was right and for what I know is the whole TRUTH. I never encountered this. Being accused as a liar! I am not! Geez, why was he like that? Then, there was a 2 minute silence he was just looking at his monitor clicking the mouse over and over again.

    CO: Ok, we will call you outside again. Just wait.

    Damn, he didnt even say bye phrases. NOt even greet good morning and not even say hi and be friendly to my 4 year old kid who was with me as my K2.

    You got a white paper (221g) and that doesnt mean you are denied. I got the same paper when i had my interview but i was approved.I got my visa a month after the interview. They don't need more documents from you. What they do is they will do more document verification.

    Don't worry to much..Am sure it will be approve. If it was denied they should have given you back ur passport right after the interview.

  21. Hello everyone! Me and my USC husband is currently gathering all the documents for my 6yr old daughter, stepchild of my husband, who is in the Philippines.

    I'm not sure on what the requirements are for my daughter to get a Phil. passport... I planned to go to the Phils. in time of her medical exam and interview.

    It says on the DFA website that:

    For Minors (below 18 years old)

    Personal appearance of either parent (if minor is of legitimate status).

    Personal appearance of mother (if minor is of illegitimate status)

    If minor is NOT traveling with either parent:

    Original and photocopy of DSWD Clearance

    Affidavit of Support and Consent

    If both parents are abroad:

    Affidavit of support and consent (must be authenticated by the nearest Philippine Embassy or Consulate General if not executed before a Consul).

    Special Power of Attorney (must be authenticated by the nearest Philippine Embassy or Consulate General if not executed before a Consul designating the representative by name and authorizing him to apply for a passport on behalf of the minor).

    Passport and photocopy of the passport of the traveling companion of the minor.

    I'm not married to my daughter's bio-father and I do not know where he is right now.

    So I just wanted my sister to accompany my daughter to get a passport.

    Which documents do I need to send in the Philippines so my sister will bring it whenever they apply for the passport of my daughter?

    Do I also need the Special Power of Attorney even though I'm just the one who's working with all the paperworks? Do I really still need it?

    Please help me with this matter.

    You need to send a special power of attorney for your sis and that SPA should be authenticated and with red ribbon from the DFA here. My 8 yr. old son just had his passport 2 months ago and i just sent mom an SPA.
