  1. so i can use the I-864EZ then if my income alone is enough, correct? cuz i want to prepare that now.. just getting ahead of myself cuz i am so friggin bored of waiting!

so where is this biographic data page??? and where do I find these things out? the forms i need? Jen it's a great idea... I plan on visiting him in Sept/oct so i am with you on doing something to take the time up.

since i didn't have a passport then, i just sent in my naturalization certificate..

rather be safe than sorry.. i would have copied my ENTIRE passport too if that was the only thing i have to show

Your best bet is to ask some of the other going through you consulate...they might even scan their forms they received from the consulate and email to you so you know what to expect.

Also to those haveing the forms filled outand signed in advance, I would suggest having 2 or 3 forms signed in case they get lost in the mail when you send back to NVC. :-) Just never know and when it's crunch time you don't want to worry about it. :-)

  2. Wishing everyone a fantastic Tuesday!

I just witnessed an accident on the way to work (not major, but still). The crazy fool that hit the other car was weaving right in front of me for a while - til she hit someone else. So I called 911 and stayed to report my "witness account" for the other guy. She was driving under a suspended license and probably had no insurance..... all I could think of was Dawn - this is not going to happen in front of my eyes! Thank God it was only minor damage and no injuries.

    :crying: Dawn.

tamara - I"ve never heard of world relief but I hope it's true!

tasha - I had to laugh when I read what you wrote about your husband. Mine keeps saying "it's very hot....very very hot". roflmaooo!!! did they, like, forget already what it's like in Egypt??? This is NOTHING compared to Egypt heat so I'm not understanding why he's hot and moreso why he is so AGAINST turning the a/c on during the day so that I can come home to a nice cool house and be the loving wife he's come to know and adore instead of the raving mad lunatic beeeeeeeeeatch he meets at the door when I realize it's hot as hell in the house again because SOMEONE didn't close the windows and turn the a/c on.

    :innocent:

I had this problem when he first got here. He would crowd himself up in the house with no windows open and I felt like I would die of a heat stroke when I approached the front door. Also, he thinks that Malek still needs to be swaddled in a furry blanket. Malek was napping on the couch yesterday, I came in, picked him up and he was sweating. My husband said the air is on....ok, yes, but its 78 in here. Dang it....if I keep him outside he thinks its a wonderful idea to run the AC but if he's inside he says its too cool. OH also, he says if the fan is on him at night it makes you sick...like sick in your chest. I feel like its a no win battle...too hot, too cold. Oh whateverrrrrrrrrr, I still love my wishy washy man!

The houses here trap heat IN with all the wood, house wrap, insulation and all that....and surely the humidity is the real cuplrit...don't these guy feel that....how many showers a day do they take ;-) MENA cement homes keep cool even in the H3LL of the summer. Heck even the shade under a tree is cool there!

  3. I truly wish you all the very best in getting this sorted out and your wife in your arms here in the US.

I just wanted to bring to you attention question 17 on the I129F. 17. Is your fiancé(e) related to you?

Good catch. I think most of us spend about a second on that question and then forget about it.

Thank you for spotting that LuLu.

    Thanks pushbrk.

Capsule, not I a problem...truly wish there was more help I could provide. :-) Seems you have some good leads on lawyers and I really hope they'll be able to help you. Good luck.

  4. W4/W2 from you workplace is a whole different ball of wax. You can leave that as is for now if they don't want to change it....plus why would want to pay for health insurance for her if she can't use it or is already covered in her home country. Increasing/decreases from what I understand just changes the amount of tax they take out at each pay period. When you file taxes, how much you've already paid(accumulation of all the pay periods) versus how much you owe will come out. That is why they say when you get a refund you pretty much gave the government a free loan...cause they used your money the whole year. The tax filing should reconcile everything and it usually does. For example if your W4 says 1 exemption and then when you file you file MFJ you will have two exemptions, usually that means a few thousand dollars back in your pocket. You can treat a nonresident alien as a resident for tax purposes....even if she has never ever stepped foot in the US.

Does you wife work in Japan? If she does then you have to claim her income. Up to 80K is exempt.

If you don't want to file MFJ, then chooes MFS. Then when she gets here and gets her SSN you can ammend your 2007 tax return. And for an ammended return the IRS pays interest...of course you get a 1099 that you have claim in the following year...buy hey they pay interest.

But for the embassy to have more proof that you are married file as MFJ or MFS. You don't want to get to the NVC stage and then get an RFE for that....they might ask you to refile your taxes correctly and then provide them with a copy....do you really want to fumble through that at that stage? Or worse at the interview the consulate asks you to do that?

  5. Thanks for all the responses.

So I think the best thing for me to do is first- change my status to married.

Second- Amend 2007, since we were married in Nov.

I am still on the fence about applying for the ITIN. It seems like if I just change my status and amend, I dont really need to.

There will only be a few months after she gets an ITIN, that she should get her SSN anyway. So doesnt seem to be worth it. Please let me know if I am wrong though.

Thanks again for all the info!

Everyone here gives more clear answers than any other site. :)

You will prob get more money back. And you were married in 2007, so you cannot file Single for 2007. You were married you have to choose MFJ or MFS. Don't forget you will have to provide the NVC/consulate with this information. Are you going to tell them you are Single as you 1040 states and interview for a CR1?

  6. You attached the W7 to the year you are filing for. If you filed for this year already....then you have to wait until next year.

I disagree with this. I filed an amended tax return in August of 2007 for my 2006 return to add my wife to get her an ITN. She sent a letter from her email address to me stating that she would give me permission to sign the w-7 form for her, plus she sent me her passport, which I returned during my visit this year. I also took our chinese marriage certificate.

I think you need to file an ammended return for the year you were married, it shows an additional tax year with her in a bonafide relationship as evidence

So what did you do for 2007? Amend that one as well or file late?

    http://www.irs.gov/pub/irs-pdf/fw7.pdf

    Instructions:

    2. Your original, completed tax return(s) for which the ITIN is

needed. Attach Form W-7 to the front of your tax return. If you are

applying for more than one ITIN for the same tax return (such as for

a spouse or dependent(s)), attach all Forms W-7 to the same tax

return. After your Form W-7 has been processed, the IRS will assign

an ITIN to the return and process the return

  7. I've been thinking about this and I don't know if I buy the whole "you're a foreigner so it's different" thing. Maybe someone can explain that to me better.

If you're wearing a short skirt, what about that makes it ok and not #######-like being a foreigner as opposed to a local? Because more Americans wear short skirts? Doesn't that just mean that more Americans are whores?

*disclaimer: I don't personally think that these things make one a #######!

hmmmm, I do think foreigners can get away with wearing things because it's prety normal in their countries....or better use of words...no one makes a big fuss if you a wearing say a tank top and short. In the MENA, the entire street would stop and I am sure there would be many accidents. But I am also 1000% sure you would be harrassed or worse verbally. Me b/c I'm Jordanian and I look like it...except they can tell I am a foreigner from a mile away, could not get away with wearing shorts in some of the smaller towns....and I'm a dude. They wouldn't come up to me and say anything to may face, but I am sure they'd say look at that #(*$&*@$#&*....or something to that effect. But I don't wear shorts there cause I know and people are begining to recognize me and know what family I belong to.

In AMM these days pretty much anything goes. I wonder if the author visited there what he would say that. Girls there wear things so revealing (hijab or not, even with their conservative mom and grandma next to them) that it shocks me who let me tell ya, has seen it all.

  8. I must confess, I have gotten hooked on a new game site, now the sad thing is, mostly children play the games, but I love this new game. If anyone asks my age, I am now 10 years old.

Was just going to ask about ya GG. Wondering where ya been. I'm in need some fresh herbs! ;-) LOL.

    Have a great weekend everyone!

  9. I visited Congressman Saxons office today and talked to their immigration department. They told me they just had a USCIS meeting few weeks ago, and questions popped up why I-130's werent being processed. USCIS told them that they are only processing "SELECT" I-130's for the time being until they clear I-400 backlog which they said was their #1 priority.

BTW this is directed at VERMONT SERVICE CENTER only,

I believe the "select I-130's" are the easiest ones they can find, all of our DEC/NOV/JAN get ready for long wait.:angry::blink:

Dude, all I know is I'm waiting to see you approved as well. I hope it's soon. Hang in there!

  10. If you have no current need then I would say "Don't bother"...

PS.. The IRS could care less about another country's tax return.... The application and evidence is usually included to the 1040

It is worth the bother.....and he's talking about US taxes. OP, try filling the forms out both ways (MFS and MFJ)....usually it means more $$ for you if you file MFJ.

  11. You attached the W7 to the year you are filing for. If you filed for this year already....then you have to wait until next year. When I applied for my ex, I had to send in a certified copy of her passport (have her go to the Consulate and heave them do this...it runs $30 US) or you can also mail in her passport. Note, you don't mail your tax forms to the address on the 1040...you mail it to if I recall correctly Philadelphia. I also went to my local IRS office and submitted the forms in person, they stamped them and all that and submitted them for me. Few months later I got the letter with her number and also my $$.
