  1. The requirement for a waiver with the second I129F must be fairly new. I filed a K1 for Layla in late 2006, closed out in February 2007, married her and filed a K3 in April/May 2007. She is here on her K3 visa, I did not submit a waiver request. When I submitted the second I129F, I read the instructions, and interpretted that I didn't need a waiver, and did not ask on VJ or anywhere else. It worked for me.

    Besides, if Paris Heart goes for the CR1, she won't need a waiver request anyway.

    You need a waiver if you have filed 2 previous I129Fs (making the current filing with waiver request your third I129F) or if you have had an I129F approved in the last 2 years.

    From I129F instructions:

    If you have filed two or more K-1 visa petitions at any time in the past or previously had a K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver. To request a waiver you must submit a written request with this petition accompanied by documentation of your claim to the waiver.

    Certainly u can do it, but the likelyhood of USCIS asking many questions because of it exists. Also check if you could file for a k-3 again.. good luck to you :luv:

    You can file as many times as you want but you'll need to ask for a waiver if you file a second I-129F within two years of a previous filing.

    Yes, I know that's what it says and agree that even most idiots would interpret it correctly as you did. Nevertheless, USCIS is requiring a waiver request with the second request. Go figure, but knowing this, I gave the correct answer.

    That is for multiple K1...you're second was K3. ;-)

  2. jJ, I am proponent of filing both petitions...and especially now moreso that the 129 is fee "waived". When I previously filed I think they were 185 and 175 respectively. But you just never know....they are approving both at the same time these days. But honestly, I am nervous about them (UCSIS NVC) "forcing" you to purse one OR the other. I hope that doesn't happen to me...as it seems to be happening at VSC a lot.

    My first time around (when AMM was scheduling interviews only when they received the paperwork back from the beneficiary) my 129 made it to AMM first as it should have. We got the paper work back to them 2.5 months after they received the case from the NVC ( they sent it to me in the US then I had to send to my now ex, resulting in 2.5 months wasted) and they scheduled the interview like 6 months in to the future. During that time my 130 made it through NVC and was forwarded to the consulate. AMM agreed to interview for the CR1 rather than the K3, at the previously scheduled K3 interview.

    Since the NVC now schedules the interviews for AMM, I am still sticking to what worked before and hopefully AMM will accommodate that same request (interview for CR1 at K3 slot) if the need should arise. In the grand scheme of things, we are talking a few months between the two these days, rather than the 8+ months in the future if you were wanting to interview for the CR1 a few years ago.

    All that being said, I sense that filing both gets you approved "faster"....as they are approving both at the same time at CSC. That is just my feeling and from the limited research I have done. I was torn whether to file the 129 as well, but you just do what you need to do to get your spouse here ASAP. And worst case, then might have the opportunity to go back once they get the K3 to interview for the CR1.

    I have committed in Dawn's memory to live a better life both physically and mentally. Dawn has inspired me to do this and it's my way to remember a special person. Once I reach my goals I can always look back and remember Dawn. One of these goals is the run the Dead Sea Marathon in Jordan in Dawn's memory within the next few years.

  4. I see he has PR. So he will more than likely pay in state tuition (depends on schools residency requirements) That will be a great thing. He would need to contact the University he plans on applying to find out their specific requirements. They may waive some of the foundation course he wil have to take for his masters. Like if he was a business undergrad, he probably will not have to repeat the business foundation classes for his masters if he's chosen to pursue a MBA. I would contact the grad school and set up an appointment with a graduate advisor. You should provide official transcripts. The school will of course need to be recognized by the universities here and of course accredited.

    Dawn. You are the sweetest, nicest, kindest, most caring lady anyone could ever hope to meet -- how can you be gone ??????

    I will never forget what you did for me that day when Mahmoud first arrived in the U.S. You took the day off work to meet me at O'Hare, and we spent the afternoon and evening together -- sharing stories, looking at pics, laughing, eating Italian food, watching the clock until it was time to go back to the airport to meet his flight. You waited with me there for hours, keeping me company and helping me watch for him as the crowds came through from the gates. You laughed and said it was like your practice run for when Hatem would arrive. Your phone kept ringing as people from your work kept calling to ask when you were coming, but you said you wanted to stay and see that Mahmoud had arrived safely.

    As the hours passed, and crowds of arriving passengers passed by, you kept pointing to all sorts of different guys, saying "I think I saw him -- is that him ?" And each time it wasn't him, and you tried to calm me as you watched me getting more and more frantic by the minute, panicked that he had somehow missed his flight, or who knows what.... until finally you said "I think I saw him over at the other door -- I'm sure it must be him." And I ran over to that door and sure enough you were right -- there was Mahmoud, walking through at last. He saw me and the flag and smiled, and we were hugging and you had my camera and your camera and you took the very first pics of us together in America right there in the airport. And you had this incredible look on your face -- of joy and awe, as if you felt everything I was feeling.

    You brought joy and happiness wherever you went, Dawn, to every life you touched. You always reached out to help others and to be a true friend. You are beautiful inside and out, and your wonderful personality made everyone love you.

    I can't believe you are not with us any more, Dawn -- you are too young to be gone, you had too much life, too much happiness yet to experience. I don't know how to begin to accept this news.

    lulu, Dawn had just asked about you, oh about a month ago. She was suprised and happy you had found a new love. (she was happy for you and called me crazy!) Really, she cared alot about you.

    Wow. The more I hear about her the more I realize it was not only I who found her SO special. She was truly one of a kind. Really. How can this be? How?
