  1. yes, she work here legally. She was issued EAD. She is worried that if she files, it might have a bad impression on my part as i have sponsored her. We are thinking that claiming unemployment could be considered a "public" burden.

    An Employer pays into the fund, not the employee, and no, unemployment compensation is not means-tested public benefits.

  2. Just a heads up for those who are coming to the US Consulate in Ho Chi Minh City: there are scammers setting up across the street.

    My wife just got back from the consulate and told me that there were men preventing her from crossing the street and getting to the consulate. They pulled her and would not let her go and then directed her into an office right across the street from the US consulate. She knew where she needed to go and still they wouldn't let her go. In their office she told them she had a letter directing her where to go and so on. Finally, they allowed her to leave. I wish I wasn't so lazy and had accompanied her... Apparently, they operate off consulate's territory so the consulate can't do anything about it. Anyway, they do some sort of "paperwork assistance" operation. Very aggressive bunch!

    Don't let your women folk go there alone!

    And that's the time she should have kicked them between the legs! Good to hear she's ok.

  3. My only guess would be that they are touched when the systems automatically sends a reminder by mail.

    I got it some months prior to ROC

    From my understanding, correct my if I'm not, I don't believe "reminder" notices are sent to remove conditions, at least on the 2-year condition PR Card. This is what we were told by the AOS Adjudicator, as she said it is our responsibility to keep track of that timeframe.

  4. WOW! I didnt know that it was an issue to reopen a topic....I guess I will listen to you and not ask for advice anymore. I just thought maybe there were some new people that joined that maybe had better advice then just get an attorney...obviously I will need an attorney.     I am a Father with Sole custody of my daughter and I know how you feel about your child. Here's the first step I suggest you do as this is what I did, and of course it will cost you additional monies. Seek a "Family Court" Attorney. Tell the Attorney you wish to file "A Motion for Emergency Ex Parte for Temporary Custody" and a "Proposed Emergency Ex Parte Order of Custody." The Attorney will file this for you for a fee of course, and then a court date will be set for the hearing. This will at least stop any activity she may be attempting. The Attorney may and should ask why you are doing this, simply tell the Attorney "I believe she, the Mother, will attempt to leave with the child which is against my wishes. Trust me, in most states, the Mother is considered the Legal Custodial Parent. Sorry to say, Men or just Sperm donors in the eyes of the law even if your name is on the Birth Certificate. This is just the way it is if it has not been some decision made in a court of law. Of course I'm NOT a Family Attorney and let's make this clear, as this is my own experience. I have only studies in Criminal Law. Hope this gives you somewhere to start.

  5. This appears to be yet another case of confusing petition with visa application. For K1 and K2, there is one petition filed, so one petition filing fee but each person desiring a visa pays the visa application fee prior to the interview, currently $131 but soon to be $350.

    Good comment, yet again, pushbrk. So many members that have made hundreds of comments think they are giving sound advise when they are only misleading and confusing others and they are outright wrong. I still believe in the following: It is better to be silent and thought a fool, than to speak and remove all doubt.

    Mine was reasonable. I only trasferred what she asked for, which was never a problem. She was so ashamed to even ask, but I knew when she need things. I always added a little extra. Think of it as a prepaid debit card.

    I see a lot of services where you can transfer money to a loved one in the Philippines, and none of them appealed to me in the least. Maybe check at your financial institution, like I did. My Institution has a card called Unidos, and all I do is a transfer from any of my accounts to this Unidos Card account, that has a debit card attached to said account that carries no monthly fees or transfer fees, and no annual fee. When my wife was in the Philippines I mailed her the Debit Card once I received it from my bank, and then called my bank to activate the card knowing it was safely in her possession, then after that told my then Fiancee the PIN. The only thing I paid was $2.00 withdrawl at my end and $2.00 ATM fee at her end. Much less than I was paying using Western Union or Money Gram which is a joke in the Philippines.

  8. When you enter US on a K1 visa you will have to get married within 90 days since your arrival.You can apply for a social security number before or after marriage and also apply for a permit to work.

    You actually apply for a work permit, called Employment Authorization Document (EAD), at the same time you would file for AOS, not before. Correct, you can file for the SSN, but it will be in your unmarried name, then you would have to take your marriage documents and have the SSN reissued with you married name on it.

    Marry in the US and try to adjust status.

    Marry and return home and try the CR-1 .

    Not marry and go home and try another K1.

    Either one can have HUGE negative results if denied and waivers denied also.

    I would marry too, of course because you love the person, and I too, would not let anything stop me, but what I'm saying for example, let's say a person is in front of a judge, be it Immigration or Criminal, that Judge DOES NOT have to except recommendations from the Defense or Prosecuting Attorney/Lawyer, I speak from experience being involved with Criminal Law.

  10. It says in the Chicago Consulate website that it will take 6 weeks to process the new passport. I am curious about how long did it really take from the date of the application to receiving of the new passport. So for those who have done it in Chicago or any consulate, I would like to know how long did you wait to get the new passport.

    It's going on two weeks that I submitted my Wife's application, and she is not even on the list for Dallas yet.

    I am so sorry if there is a topic as this one. Well, I searched but I didnt find. Ok, here is my question:I just filled up the forms for I485, but I don't know how to send. For example: In a different envelope should I send G-325, I-130, I864, 1 photo, birth certificate from my husband? And then I485, G325, passport copies, 1 photo, from me? I have a joint sponsor so Do I need a different envelope for the I-864?

  12. I used cheapoair.com and purchased my fiance ticket to minneapolis without any problems..just use the search engines because there are only a few sites that will have flights originating from manila..good luck, and shop around because the price vary alot right now.

    I booked my wife's flight via Expedia.com, and emailed her eticket to her, and she too, printed it from her end. She had no problems and no questions about the booking when checking in.

  13. I came here for fiance visa and now i have my 2 yrs greencard, but now we dont live together because of not understanding each other like financially and the life style of living. At this time i live my friend house. So my question is can i marry my new boyfriend or need to go back in my country. But my boyfriend dont want me to go back home because he wants to marry me and help me for evrything. So it is possible to stay here and continue to process my papers? Please help me what im going to do and what are the best thing for me. Thank you

    I'm sure you will get many responses to this. It sounds like you have been married for less than 2 years, and if this is the case, your PR/GC is conditional based on that you have a bonifide marriage, and thats why it's conditional. You may, if I'm not mistaken, have to return to your country, unless there has been documented violence in your marriage, which may entitle you to take a different route. Someone else ring in an add to this.

  14. Hi I filed a k-1 i-129 for my fiance in feburary, 2010 and it was received feb. 18 and my check was cashed feb. 22 I filed at california center and was wondering do they send case number or confirmation, because it is 1.5 months and I havent heard a word.

    How do I contact them if I dont have case number, or should I just wait for them to contact me?

    You should have received a notice of receipt by now. I have never seen anyone waiting this long to receive their initial confirmation of a filing, at least the I-129.

    We just received our NOA2 but had a question for those who have gone through a similar situation.

    Currently my wife's passport is under her maiden name, while filling out our paperwork however we use her married name. Before sending our package to the NVC should we update her passport to her married name beforehand?

    Has anyone kept their passport using their maiden name but filed all your paperwork using your married name? If so, at the POE did you have any troubles?

    If more info is needed please let me know.

  16. We had our interview today in Irving Texas. It was the easiest part of the entire visa journey by now!!! APPROVED!

    No questions asked but date of birth and the standard questions about : have you ever used illegal drugs,etc...

    So relieved at last!

    We are one of the last December AOS fillers... filled on Dec 31,2009... and hanging in between December and January fillers ... this is why I posted our experience on both topics... cheers

    Yes, I know about the setup fees and maintenance of a website. I used to build them, and I was going to include the import and shipping fees in my statement, but I didn't. I know all that plays an role, but to me it's still overkill on the price. Take for example this JUNK sold in America, but made in china. Cost pennies to make/manufacture and does not last at all. I bought a $400 dollar CP and it died 15 months later. The US loves to bilk people here, citizens or not.

  18. Hi husbands of Filipinas.....Just today, as my wife (Filipina) and I were driving around doing some errands....she said something like..."drive careful....you don't have to drive fast".

    I started laughing...and I said....wait a minute....I'm not driving fast...and I am very careful.....you don't even have a license...and I noticed you are becoming a "back seat driver". She said...now that she has read the DMV booklet...she knows. :innocent: ..hahahaha....I then told her...hey, all the times we rode in a bus....on a trike...in a taxi in the phils...and they we driving close, almost hitting people, etc...I never heard you say anything about...slow down, be careful, etc. :lol:

    We had a laugh....and I thought it was funny...so I just wonder....is anybody else encountering this behavior...or am I just blessed? :rofl:

    I do love her...but I still think it is funny.....my driving is boring and so very safe.....especially compared to the way most people drive in phils.

    Living in Los Angeles, I'm used to road rage, being cut off, given the bird, you name it, and I myself drive like a bat-out-of hell, but when I went to Manila, my Wife and I were in the back of a Taxi and the guy was talking to us as he was driving but head turn around, and at the same time, motorocycles weaving in and around us, and I'm like praying my #### off wanting him to turn around :o . I think I almost soiled my pants. I thought people in L.A. drove crazy and I could stomach any traffic situation. I can tell my wife is petrified in the passenger seat and does say something about my speed sometimes.

  19. Its really sad that a lot of these products on pinoygrocery.com & philamfood.com are so over priced. I have seen these same products in various asian stores where I live and they are at least 4-times less expensive than on both of these sites. Even my wife has stated how over priced these items are and will not order anything from them. Why price-gouge your own people just because they are not in their former homeland and want a taste of home. :(
