Hi Family
Straight to the point married for 2 yrs received GC for 2 yrs...something Happen 2 weeks ago water damaged our Apt so we had to move some where else different Complex. My question is do I need to notify INS the new address or just do the foward thing and will b fine?

Definitely do NOT do the mail forwarding thing when it comes to the USCIS. I don't believe Government mail is forwarded. Do it via snail mail and online, and too, check to make sure that it was received and recorded.

I-94
in Philippines
Hi everyone, Erma will be coming here on Sunday Jan. 31st, we are so excited. We have been looking at the I-94 to be prepared, will they give that to her on the plane to fill out?1)What is the admission number, the number at the top that looks like it would be 11 digits?
2)For number 7, it asks the flight number and airline, but in the instructions it says to put land if by entering by land, and enter sea if entering by sea? Does she just list the flight number and airline?
3)For city where visa was issued, she will enter Manila?
4)Number 8,For country where you live, she will enter Philippines, since she has been living there until now?
One last question, it says to fill out the arrival and departure record? She needs to fill out the departure too even though she is coming here to live?
We just want to make sure she understands everything and that all will go smoothly. Thanks for any replies.

The I-94 will be given to her at POE, Point of Entry into the US and they will staple it inside her Passport. Question #1, I don't quite remember, but all other questions are correct.

I assume recovery is more painful?
Not for me. I have had two root canals and wisdom teeth extracted, not at the same time of course and each and every time, I ended up flusing my pain medication down the toilet because I had NO pain after the procedures. I can't explain that, but during the procedures my hands would be squeezing the arms of the chair so tight because of fear you could see my finger prints in the dentitsts chair.

One of my wisdom teeth is slanted towards the adjacent teeth (molars?). One dentist told me it's no big deal, another suggested it is and I should go consult with an oral surgeon about having it removed.
I did some reading online and apparently wisdom tooth removal is routine (if painful) and usually goes by without a hitch. Sometimes, complications can occur resulting in lifelong loss of sensation in the face and lips.
Given that my wisdom teeth don't hurt at all, does it make sense to get them removed? I am under the assumption that the oral surgeon will recommend removal - after all, that is what they do.
Your opinions and thoughts on this are welcome. Please focus on the medical/dental aspects of this and not cost.
If they don't give you problems, leave them be. I would only experience minor discomfort not often, but I still had mine removed at age 43 under gas and IV.

I got my green card today in the mail after looong tiring journey.....
For all those who were asked to do another medical.
If you look in the instructions for the I-693 medical form section 3 part 2 it states if you came on K-1 or K-3 visa and had medical examination in your country before you came to the US and you have filed for your AOS within a year of that medical examination you ARE NOT REQUIRED to do another medical.
I just thought to share this with everyone because i know it cost money and time.
Correct, but reading many VJ posts, many are still being subjected to one.

I'm a regular poster on VJ but posting here anonymously to ask a question.
My fiance and I are getting married some time later this year; we're almost done with the K1 visa process. He's European and we've known each other for about 2.5 years and have dated for a little more than a year and have seen each other multiple times over the last year.
His best friend as he proclaims is a girl who lives on the opposite side of the country from where I do. I was fairly put out by this; shouldn't you marry your best friend? but since I'm his fiance, I'm that, not his best friend. I've met her and she's very nice, she's the type of person who has more guy friends than girl friends. She's going to be my fiance's equivalent of "best man" in our wedding.
But I have to confess that the relationship hasn't always put me at ease. My fiance wants to spend a week or two with her every 6 months at least, although if he was able to work, he's said that he'd like to do it a lot more often than that and would like to do that as the years go by. Though I can feel that he would never cheat on me, it still doesn't make me feel comfortable him staying at her house for that long period of time without me.
If I'm being honest here, I suppose part of this stems from when I had a guy best friend a few years back but we reached a point after a long time that we started treating each other like we were dating each other even though he had a girlfriend at the time. I was so disgusted with myself (we didn't have sex, but some heavy petting) afterwards that it was a good push for me to move out of that city; I was in a life transition at the time and this was the last bit of push I needed to move to another city because I couldn't stand being that girl. I had never ever intended for anything like that to happen, but as we got closer and closer together sharing our thoughts and time together, it just happened (I know, very original).
Do I think this would happen to him?
No.
But I didn't think it would happen to me. Not in a million years.
He also has a lot of friends a few hours away from here that he'd like to see on a regular basis...he's the type of guy that has more girl friends than guy friends because he's a touchy-feely type, which is what I love about him. Those don't really bother me except for the idea that he goes alone all the time.
I know that people are still individuals in their marriage, but on the other hand I felt it was more like a unit and that one doesn't generally (not always, but generally) go without the other.
What do you guys think? Am I being very silly here?
A fiance/Man's place is at home with is fiancee/Wife. If it walks like a Duck yada yada yada.

My husband, a permanent resident who arrived in the US at age 37, wants to apply for a US Census job. The application form asks if he is registered for selective service, and says that he should be if he was born after 1959, which he was. The Selective Service website says that he does not need to register, because he was older than 26 when he came here. Does anyone know about this? We don't want to make a mistake. Thanks!
The Selective Service System is a means by which the United States maintains information on those potentially subject to military conscription. All males between the ages of 18 to 25 are required by law to register within 30 days of their 18th birthday As of the end of 2008, the names and addresses of over 14 million men are on file.

I've read some sources that say it's not allowed by law for a foreigner to book someone in the Philippines a ticket out of the country? Is this true? Anyone have any experience booking their fiance a ticket to the USA? Please help!
This is NOT true. In fact I did the booking from the US of my wife's ticket to get here, but just in case, I did a letter stating that I had used my debit card and did indeed book the flight. Now I did read somewhere on the net in 2008 that carriers in the Philippines had received a slap on the wrist from the FCC for not allowing a passenger to board because the ticket had not been purchased within the Phillipines. So in a nutshell you have nothing to worry about.

I am a bit confused. As our wedding date approches, my K1 fiance and I have been looking into the AOS and also a SS# for him. According to the many posts I have read here, he is fully able to get his SS# before the AOS. However, according to the Social Security website, one of the documents he is required to show is work eligibility. What is this exactly? To me, it sounds like they are requiring the EAD which we won't have at least until after we file his AOS. This is very confusing.

Just by showing your I-94 and valid passport, you should have been able to obtain an SS#, which is what I did in my wife's case days after she arrived in the US. A K1 does NOT give one the autorization to work. This must be authorized at POE or when doing the AOS period.

over the past few days, i've been window shopping airline tickets from both work and home. last night while at work, i noticed that the price had been increasing on a specific ticket combo, which was really surprising and upsetting me, but i came to my senses that i was willing to pay for the increased price to have my fiance with me sooner than having to wait and search for later dates for cheaper ticket pricing.
i went home to buy the tickets, thinking that i would have to pay the higher price, but when i was checking up on the price before purchase, i noticed that the price was back at the original price i found when i first started researching prices.
moral of the story: it might be a good idea to check the pricing on another computer if you notice the price is going up on one specific computer
i think that the websites are keeping track of how many times a certain computer is visiting the website and is increasing the prices.
we're not talking about airline ticket prices that fluctuate like the stock market people.
all i know is that something was fishy, but good thing i bought the tickets from home. it saved me over $200
I experienced the same thing in 2008 when I flew to the Philippines, but I was using the same PC. I think it's just a market think like supply and demand. I would check ever 30 minutes and the prices would change. Too, from day-to-day by hundreds of dollars.

Hello guys,
I talked to a friend of mine and told her that my k-1 petition was approved. She told me that when his fiancee got the approved k-1 petition letter, he immediately call the embassy to make an appointment for her interview. Was that possible even if i don't have the packet yet since i have the case number from the NVC?

Also, the person must have the medical prior to the interview and there's still additional paperwork that needs to be completed for the interview at the Embassy and fees paid.

If she has the money, buy a ticket, pack her bag, call a taxi and board the plane. She is the mother. Also, they are not married. She could do anything she wants with the baby. She could leave anytime with the baby. She does not need to tell him that she is leaving him.
To all who are posting about this topic. Please let's not turn this into a Male, Female thing. I can tell by some of the comments that it is headed that way. We we are trying to help a fellow VJer. It is true in most states a Father has no legal rights until a court rules on a custody matter. He is just merely a sperm donor, but that said I don't study criminal law for nothing. I'm not into to the family law, but I know kidnapping when I see it. I have SOLE custody of my 4-year old, but I still can't remove her from my State without pre-approval from a Judge. Just be careful.

Thats not kidnapping who will take care of the child while his in jail. So you rather a drug addict raise the child? Well rather make a way to get out than stay with him miserable.
Are you meaning her take the child on the plane while he is in jail, if so, that is kidnapping. Am I understanding you right?

Hi, does she have enough money to buy a palne ticket? Buy a plane ticket and two days b4 her flight turn him in to police for the drugs and while his inside the jail she can leave and her baby and go back to the philippines. Dont let him know her plans though.
So you're telling her to kidnap the child!!!!!! That's not good. We on this site are trying to help people do things legally.

My friend from the Philippines came here in the US on K1 visa last November 12,2009.Unfortunately,she is not getting marry with her fiancee (petitioner) anymore due to relationship problem.They have a daughter who is 9months old and a US citizen through CRBA.My friend arrived here in the US with her baby.Her problem is,her fiancee doesn't want her to go back to Philippines with their daughter.He said she can stay here in US and they can get marry,stay in the house to be with their baby and just treat each other like friends only..The guy (petitioner) has a girl and my friend found it out just lately.She want to go home as soon as possible before her I-94 expires with her baby.
My question is,how can she get the custody to have her daughter go back to the Philippines?Her fiancee told her that she can't leave with her daughter without custody and he even told her before that if they get marry,they have to do the pre-nuptial.
She told me that her fiancee is taking/using drugs.Her fiancee doesn't hurt him or anything but she doesn't want to stay with him anymore.She's in North Georgia (Flintstone) and don't know anybody who can help her.I told her to go to Atlanta to the Immigration,US Embassy or Phil.Consulate,but the Philippine Consulate that covers Georgia is at Washington,DC.
She don't know how to drive yet,no greencard,no license.She don't know what to do anymore.
Btw,her daughter has a Philippine passport too so her baby is dual-citizen.
Please I need some help or information for her.

I think JimVaPhuong made a better point. Try to get the Father to just let her go back to the Philippines. Thinking about marrying the guy, in my opinion, may be frowned upon as consituting fraud, marrying for the sake of the child. VJers are not going to help someone by offering advice in that matter. Don't give up in trying to reason with the guy in letting her go back with the child.

Here is a rundown of the situation. My fiancee is married. He has been separated from his wife for over 13 years and never got a divorce. Anyway after meeting me and developing a relationship he decided to file for divorce which we are waiting to become final. I am wondering how long after obtaining the final decree should we wait before filing the I129F. I don't want to get denied due to bonafied relationship or fraud. Mostly I'm concerned with the time overlap of our relationship and the divorce. Should I include notorized statements from people stating that he and his wife have not lived in the same house for 13 years and that the wife soon to be ex wife has a baby and live in boyfriend? Really need some advice on how to proceed given present circumstances.
Definitely wait until you have your divorce decree in hand. You must be able to prove you are divorced if asked to do so and legally able to marry using the I-129F

If you have a number to your financial institution where as you can check the status of the check, such as if it has cleared, meaning paid.

Just simply means the USCIS has cashed a submitted payment included with filed paperwork, for example, the I-129F, just to name one scenario

I would get over to a temporary service and sign up right away and get them to sign a letter, and if absolutely necessary, maybe his mom or dad will sign a form to help him out, but it could be hard to get someone else to want to agree to 10 years of support.
Be aware that most Temp Agencies will NOT do a letter of Employment for a person. I know this because I was in the same situation, so what I did is copied my check stubs from that Temp Agency and typed my own letter stating the reasons and had it notarized and included it with my I-134, and it was never even questioned during my Wife's interview. I am now employed full-time, thank God.

What does RFE mean?
Yes I am talking about the I-864. They ask for a lot of things, most of which seems very repetitive to me. I am just wondering what if they have a problem with something at the interview? Will I get to fix it ? (like if I need a co-sponsor) My income is sufficient but...I just want to cover the bases.

if i take my baby with me, will i be charged for kidnapping? i haven't filed for AOS and i am already out of status. i want to stay in america. i want to leave my husband and take my baby with me. what should i do? and by the way my baby was born in the US.
A passport definitely will NOT be issued for the child unless you have sole custody. I took my daughter to Manila with me and I showed my Custody Order and had no problems getting her Passport. The paperwork for the Passport stipulates both parents must be present

My fiance is the American and I'm the foreign bride-to-be. He was married once and now he needs his divorce decree (he's got a copy of it but apparently he needs the the one with the raised state seal) to even start the application process. His divorce happened in New Jersey and it was almost 20 years ago (happened in 1990 to be exact). We have been researching on how to obtain this but it seems that the only way he can get it is by writting to the record centre in new jersey and apparently there will be a delay in their returning us his decree (they didn't say how long the delay will be. As a matter of fact, they didn't say how long the usual process would take). He could also do a walk-in but does anyone have any experience with this? Since he's got a copy of the decree, would he be able to get the official divorce decree the same day he physically goes to the record centre (I assume since he's got a copy, it should be easy for them to track down the original decree)?
(It doesn't help that he lives 8 hours drive away from the record centre).

That sounds crazy. I just included a photocopy with the seal visible in my case, and yes I requested mine via snail mail. It took about 30 days because my first copy was lost in the mail, but strangley received them both the same day.

Seems some employer's don't want to provide this type of letter for some unexplained reason. What I did when I use to work for a previous employer is did my own letter and explained within the letter the employer refused to do the letter, had it notorized and included paystubs and they never questioned it at the embassy.
