    We are married 8 months today. (sigh)
    Being apart definitely causes alot of stress. It makes every single thing in your life much more difficult.
    In 2 weeks I'll be flying down to spend time with my husband .. I can't stay more than 11 days because I can't afford to lose my job... This will be the 5th time I've gone to visit this year. 25 times total to CR ( could be more... I lost count )
    Next year we all will be able to spend every Holiday and birthday together and this waiting game will be behind us.

    Is your mother already in the US or is she abroad? I'm guessing abroad since you have been waiting this long..
    I hope we start seeing transfers in the next 2 weeks for April.

    GOODNESS... no need to be nasty.. just reading what you originally posted.. it sounds like it was forwarded to the team that reviews the expedite requests.... Expedites are few and far between... Good luck with that. I see alot of requests taking 60 days for a decision. There is a backlog for those too. The senators can only place a rewquest for expedite. they don't make the decision. there is a process and the senators offices are not above anyone. People here are just trying to help you.
    To answer your question in this post.... They ask for 60 days to review it. What is your reason for expedite? Maybe someone else has had a similar experience and can shed some light for you. The letter you attached is NOT an expedite approval. It is just giving you a status report of where your file is. It clearly states it is going for review. If you are going to post on a forum asking questions, its not nice to be mean to those who want to help you.

    First of all, I have no idea why you are even getting involved. Let them both hang themselves. Its not your problem.
    Second, does the wife know that divorce does not release her obligation to her husband? meaning, Married or divorced, she signed papers to be his sponsor. Unitl he becomes a citizen, she is still "responsible" She should really read up. I'd send his cheating a$$ back to where ever the Fug he came from. That is just too much drama for my taste. Get out from under that lead weight on her shoulders. Turn his a$$ in to immigration and let him get deported.
    It all sounds so fishy to me.
    Do yourself a favor and walk away. Tell them you have no idea and leave it like that.

    Don't waste your time and money on anything fancy. That will only piss them off. Your file might not fit in the file cabinet and they will have to spend the time taking it all off and replacing it with a plain folder. Use an acco fastener. Secure everything and make it as SIMPLE as possible.
    Put your case number on every piece of paper you submit and keep copes for yourself

    I honestly believe the backlog was created because of the rush of petitions filed once the provisional waiver was passed. None of the illegals wanted to file an I-130 because they knew they would have to leave and wait for the waiver to be processed. I guess for fear that the US would know they were here and if they didn't leave to wait for the waiver , they might be deported or something. But now they are free to wait here in the US while the waiver is processed. Which kind of irritates me too. But we are all suffering because of the rush of petitions no matter what the cause.

    K-3s were issued in 2009 when the I-130s were taking about 11 months.. NOT YEARS... And I am not sure which planet you live on, but the I-130's here on Earth are taking a very long time. not just months these days. Don't hammer these guys for stirring the pot.... It seems like you took on that job...
    My attorney pulled me back in his office to file the K-3 6 months after I filed my I-130 because he received word that they would be re-starting the K-3 processing due to long I-130 processing backlogs. Lawyers just don't make up that kind of #######. and no, he didn't charge anything extra and it was more time consuming on his part... he also pulled every one of his other clients who had a pending I-130 and filed the K-3.
    Also, the Ombudsman's office told me they see K-3 approvals all the time.. Know YOUR facts.
    And for all of you who say the K-3 is obsolete... Ok, then explain why it is still offered on the USCIS website ( for free) and why they still post processing times?     The USCIS doesn't run on tax dollars so I guess they don't have a high standard. They do what they want. The biggest slap in the face is the OCT 2012 line they throw at us.
    I am really trying to understand how transferring files from state to state benefits anyone.... Wouldn't it make more sense to scan each file as it comes in and create a PDF version, use the electronic file to work with and store the original file until it goes to the NVC? Then, anyone could access the file and adjudicate it. That would save on postage or freight charges and all that time it takes to box files up and scan them in and out and whatever else they friggin do before it gets shipped... Then , how about an automated adjudication tool? hmmmm just a thought. We all know the background checks dont' take 6 months....
    But its a good thing they spent all that time redesigning the USCIS webpage.. I was so worried that would never get done ( SARCASM)

    I know more than you think... I have seen more than you know.... YOU have no idea what goes on in my neighborhood..
    The benefits are for the USC... I'm not saying they aren't lazy... and I never said LAZY in my original post anyway
    If I had residency in my husbands country, I would NEVER expect the same benefits as the citizens get and if I were Illegal there, I 'd expect even less. As a matter of fact, I wouldn't stay there illegally. But I understand that is me...
    I know the reasons they come here,( I know MANY MANY illegals) I just don't think the USC's should suffer for that. It is illegal to enter this country without being documented, YES OR NO?
    How about the Citizens in the US that might be offended that they come here and get the same benefits and they actually broke the law getting here and by staying...?? Watch who you are offending.

    NO, its not giving permission to get married. You are able to marry whoever you want, whenever you want. The government has NO SAY over that. The K1 is a visa to enter the country because you want to get married here. The government does have a say over that.
    You are more than welcome to fly over to Brazil and get married there or whatever vacation spot you choose . THEY ARE NOT GIVING YOU PERMISSION TO GET MARRIED. The visa is to enter the country only with a stipulation that you get married within a given time or go home. People on this forum are very sensitive to the processing times and those who jump on and say things like " I don't really care about spousal visas because I didn't pick that" If you're done, then be done. I personally am exhausted from reading your posts.
    Married is Married.. Those of us who already made that commitment are suffering with these long processing times. Nothing anyone can say can change my mind about Married vs. Fiance. In my opinion, being married speaks volumes about the intent. You cannot compare a 3 month wait for a couple who is not even married yet to a 10-16 month wait for a couple who already got married and are trying to hold their life together .
    It is the USCIS that is to blame for the backlog and the poor planning . I don't care about the cost, I just want to be with my husband. These are months and months we can never ever get back. I am sure most people here would be glad to pay an extra $1000 to adjust status if they would just allow their spouse to enter while waiting for their approvals. The K3 was supposed to be the answer for that, but what's the point if they are taking just as long to approve those too?

    Part of the process is proving a bonafide relationship... Being married means we already made a commitment. (Not saying K-1s aren't committed.)
    Alot of couples have already been married for years and have children. Why should BF/GF be processed and united before married couples? Why should married couples be kept apart for so long?

    I just posted it because I just thought it was a good opportunity for a little laugh... I was told the other day that Tier 2 is only a call center and they really don't know anything about whats going on. The person I talked to seemed so irritated that I was asking questions. She talked to me like I was a total idiot and didn't have the ability to understand her. When I finally had told her I already know the way this works and I went through this before, all she could say was "OH" I knew what I was asking and I guess she was frustrated because she couldn't answer me.
    That so called "customer service" line is a joke...
