  1. My mother is a green card holder. She petitioned my sister who is below 21. I am looking at the affidavit of support form. How do I count her household size? She is married but her husband is in the Philippines and she filed married filling separately in her tax return. She doesn't have any dependents. In the form, it ask there, put 1 if you are married . So is her household size 3( herself, husband and petitioned sister/intending immigrant) she is married even though her husband is not here in the US?

    Can anybody help me?

    Looks like I have messed up I-130. I am LPR and I filed I-130 for my wife and I have noticed that, under "Information about your relative" column, on line 7 ( other Name used) I wrote N/A. I belive I should have written None. My wife was never married before and She used my surname after marriage. So in her name I have put my surname. I belive in line 7, I should have written her name before marriage. I wrote N/A even on line 11 ( Name of previous husband(s)/wive(s)) Am I right? Looks like now I am waiting for RFE rather than NOA2. If this is true then is there any way that I can call USCIS and tell these things? because they have not touched my I-130 yet.

    Please help me, looks like I messed up. I have already waited for more than 9 months and if I get RFE rather than NOA2 then wait will be forever.

    Call USCIS and tell them what happened and they will fix it for you. This happened to me and that was what I did.

  4. The form g-325a has information on it the person who has their information on the form is the person who prints and signs their name. In a K-1 visa both the petitioner and beneficiary have to fill out the g-325a just double check whether both ur mother and father need to fill one out for this process. Also on ur fathers g-325a it will ask for his alien regustration number if he doesn't have one just put "none".

    I understand that. Both my mother and father has to fill up g325a but on my fathers part , there is a art there at the very bottom that says applicant signature. So the applicant is my mom?

  5. the forms need to be originals but documents such as birth certificates and passports should clearly just be copies. If you are sending any of these: The tax transcripts should be originals sent to you from the IRS and letter from employer needs to be original.

    You are wrong. Docs like bc certificate, marriage certificate ,police certificate should be original or if they are copies, they should be authenticated. Tax return can be copies

  6. Hello guys. Nearly one month here in California and not yet received my SSN and greencard. So this is my case: After going to SSA office, they have found out that in the system they mixed my first name with my middle name, making my first name three instead of two. Went to USCIS in San Francisco for the correction and they have told me that they cannot make the amendment if I do not have the greencard on hand yet. To get it short, will wait for my greencard to arrive and apply for the changes.

    I went back to SSA office and requested for my no. to be expedited as I am getting bored and must work. I have accepted the mistaken first name to be put on the SS card in order to have the SS card number to be delivered to my address in two weeks (I will just amend my first name after I get the corrected greencard).

    Now, I want to take the DMV exam for my driver's license. Shall I wait for my first name be corrected before I take the exam? I am afraid that they will put again the same mistake on my first name on the DL card. But the law says that I should apply within 10 days for a driver's license after being a resident of the state. It is very confusing for me.

    Wait for the green card so that you won't have to go back and amend everything.

  7. I want to know if anyone here encountered the same case that I have. I was filed 14 April 1998 under F2B category when my mother was still a permanent resident, but when my mother became US citizen my category became F1 category. Lately, my lawyer and I executed a letter requesting that I want to remain under F2B category and I was approved by the USCIS Manila to be processed back to F2B category. Upon browsing the net, I noticed at the Travel.State. Gov site of United States of America Visa bulletin for July 2012 here in the Philippines they are already processing under the F2B category applications that were filed 22 DEC 2001. I became current 3 years ago under F2B category. My lawyer said that I am still current that we need to submit some original documents to the National Visa Center so they can schedule me for an interview. In fact, my lawyer already sent forms to my mother, my petitioner, Blue form G-28 and White form I-864 to be signed. And my lawyer has requested verification of employment letter and 3 most recent pay stubs from my mother. I have this question at the back of mind, if I will have the possibility of getting a scheduled interview this year, 2012.

    I think you will. Why don't you or your mom call NVC to inquire about your case. So that you will know asap

  8. The NVC will contact you indicating that your sister has been automatically converted to F1 from F2B (that is when your mother becomes a US citizen). You will need to send USCIS (not NVC) an opt out letter to retain her F2B category as F1 category has more waiting time. I have the same case.

    Then what happens next?
