  1. I was informed by the USCIS that my wife's Green-Card was lost in the mail because I never received it and neither did they. It's completely frustrating to pay $370.00 now after I already paid almost $1000 for the adjustment of status application. Is there any way I can avoid paying this fee? :ranting:

    Also, how long can I wait before applying for the Green Card? In other words, if I go to the USCIS office and they stamp my wife's passport for a year (I'm not sure what that stamp is called but it's the one they usually do to prove that you're a permanent resident if the green card is lost of in process), can I wait a year before I apply for her Green Card?

    You have to file form I-90 and may not require to paying any fee.

    Our Noa2 is received on July and we were still waiting for the NVC letter.

    It has been almost 5 months but still nothing in hand.even NVC did not create a file number for our case.

    Today my husband called up USCIS office to check with them if there is something wrong.

    I am confused please help because now USCIS is asking to fill I-824 form and pay USD340.

    Do you know what is this form and why they ask this?I never read about this forum here while the people are on CR-1 visa.

    Form I-824 is use to request a duplicate approval notice, to request approval notice to another U.S. Consulate, and to request notice to a U.S. Consulate for derivative visas to family members.

    You should not be calling USCIS after NOA2 instead bug NVC for your case.

  5. My husband arrived in the USA 3 months ago, and has now left me and his daughter behind to go live with friends in another state. I do not know the address. I called ICE to report him. What other steps do I need to take to ensure that he be caught for fraud?

    He has not did AOS yet but has applied, not interview yet.

    Is it possible to contact local police and file for “missing person” report?

    Send notarized letter to USCIS for withdrawing “affidavit of support”.

    File for divorce.

  6. Well today I went to the grocery and while I was driving back I got a call from my mom who was at my house. She said, you got something in the mail from Department of Homeland Security. I was like "OPEN IT NOW" I was so excited. I thought it was my approval. But NOOOO it was an RFE. I sent a translated copy of my marriage contract with my application. Evidently, they wanted the original as well. So as soon as I got it I ran myself up to the post office and sent it back priority mail. So guys, tell me how much additional time is this RFE gonna add to my case??? :angry:

    You should send original’s photocopy along with translated ones.

    I sent original certificate photocopy and translated.

    Do not worry; it will not take much time for approval.

    1. My husband was studying 3 years ago, but worked as a part-timer. In short, he didn't make much money as the NVC requires. However, right now, he is employed in the USAF. What should we do about our situation? Will the 3 years income tax affect the decision on the interview?

    Including 3-years tax return is optional (form I-864, question#25). You will be fine with 2008 Tax return.

    2. He told me that I need to get a TIN before he can get his recent tax transcript. Is this right? It's taking a long time. I submitted a form applying for a TIN and we have not got any reply for IRS yet. How long will it take?

    If you have SSN then do not need TIN. I do not whether you will get TIN or not. Are you currently in US?

    3. My husband scheduled my interview on April 3rd, and we're not done with NVC yet. Is that possible?

    Yes, it is possible for K-3 visa even your NVC journey not completed for CR1/IR1 visa.

    Preference 1: By Phone

    Call 1-800-829-1040.

    When Calling Between the Hours of 7AM to 10PM,

    Select “All Other Options, i.e., Option # 3"

    Enter the Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN).

    Then select option # 3, "Request a Tax Transcript/ Photocopy of your Tax Return"

    Enter the Numbers in your street address.

    Option 2 (Transcript of Tax Return)

    Enter the year of the Return you are requesting.

    Preference 2: By Phone

    When calling at any other time,

    Select “Option #2

    Enter the Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN).

    Then, Option #1, enter the Numbers in your street address.

    Then, Option #2, enter the Year of the Return you are requesting.

    Preference 3: By Mail

    You can also order the transcripts by mail.

  9. I called the IRS number, and the ability to order tax return transcripts doesn't seem to be possible any longer through their automated system. Now when you get to to the end of the automated system, it says the office is closed and to call back during the weekday.

    Anyone else have this happen to them?

    Queuedup, I received my 2008 IRS tax transcript by using automated phone service in one week.

    Few years back, I got it by fax and I do not know now, as I did not try.

  10. I had sent my I-864 during the middle of February. I received an REF for I-864A and letter of employment. I sent both of those form. NVC received both forms and everything was ok. Now NVC is saying they did not receive the I-864A and the letter of employment. I talked to 2 people and they are both telling me different things. One of them is saying all NVC is asking for is DS-230 while the other is saying I need to send in the I-864A and letter of employment. I'm so confused. I sent this stuff in already. NVC received the stuff March 13th. When I listen to the AVR it says "when my financial stuff was reviewed I was missing documents" But I dont know what documents it is. One of them is saying its the DS-230 while the other is saying its the I-864A and letter of employment. I don't know if they want me to resend the I-864A and letter of employment or the DS-230. Can someone PLEASE PLEASE help me.

    It is an old AVR message and looks like not updated. As I read somewhere, AOS and DS-230 handle by different department so both NVC operators may be right. But my concern is they received your I-864A and employment of letter on March 13 and it is an almost a month. Talking to someone is only best source for info. Try next working day and I hope everything will be all right.

  11. Starting this thread for people who got interview dates for May. Let's wait together during this hopefully last stage before all this nonsense is over and we can be with out jans!!!

    Want to thank all of you for your advice through this, VJ made this whole process so easy and minimized my ulcers and grey hairs. Just got my wife's interview letter today by email for May 18, so happy & excited :dance::dance::dance:

    NVC made me wait a very long weekend 2 weeks ago before they completed my case on a Monday. So I thought was facing another long weekend, this time 3 days, before they gave me a date next week. But thankfully, got the letter tonight at 8:20 pm. I was very shocked since most people I spoke to received the letter in mornings. I rushed back from work and I checked my email at 6pm in the evening today, but was very disappointed and stressed when I did not see any letter from NVC. Thought about calling NVC, but then thought again, as I didn't want to hear the same BS from them about waiting 8 weeks. Thought I was doomed to wait the weekend, as didn't think the NVC was still working after 6pm and Friday is a holiday. I know NVC is working on Friday, but they would probably be pissed they had to work on a holiday and would probably slack off :blink: . I decided to sleep off the disappointment and depression, so took a 3 hour nap. And once I woke up, the letter was there and the Rangers are going to the playoffs!! Best Thursday ever. I am still so surprised, did not expect the NVC to work so late. God bless them, unlike those lazy idiots at USCIS.

    Now have my fingers crossed that the Embassy don't push my date back, as some people from my Embassy got date pushed back a week for April. So can't really book tix to join my wife until 2 weeks before interview date, when I can be sure they won't push back, :( . But that's a worry for later, nothing's gona spoil this weekend now!

    I did have a question, NVC sent the appointment letter and the checklist of what original and photocopy documents the NVC received for the interview. But did not get any medical instructions, which I thought would come with the letter. Should I just follow the instructions at the Embassy website for the medical?

    Good News!!! And congratulations for coming interview. Are you falling under category of CR1 or IR1? Just curious to know.

    Hey, thanks for the links, already went through this and the ***removed*** one is pretty helpful, think I'll ask my wife to go to that one, Dr. Wahab. We got married on December 27, 2007, and I plan on bringing her here in early June 2009, so I guess it is CR1. That's what the NVC have listed in all their correspondence.

    I was a little confused about medical since many said NVC sends instructions for medical with interview letter, but I only received interview letter with documents checklist of what NVC received. No instructions medical. So I'll just use the instructions on the Dhaka embassy website and the DOS website. Though this is confusing as well as Dhaka Embassy lists 2 approved doctors while DOS website lists 3. Why can't they get their stuff together?

    My advice, just do not wait for medical instructions from Dhaka embassy as it will take some time to arrive. Make medical appointment with designated doctor and take NVC interview letter printout along with require documents, i.e., passport, photographs, etc.

    My wife medical done but she is still waiting medical instruction from US consulate, Mumbai.

    I did not submit it or talk to anyone at NVC yet. My only guess is they obtained it from my "evidence of marraige" e-mails in my I-130 petititon.

    Yes, you are right.

    Otherwise, there is no source that NVC know beneficiary e-mail address.

    Petitioner does write their e-mail address (optional) on I-129F form and cover letter, if any.

    Other source is if beneficiary send DS-3032 by e-mail to NVC.

  13. A friend of mine is in dilema. He is US citizen and on his last trip to India got married. The girl has B1/B2 visa and has visited US couple of times already in the past. Can she enter in US on B1/B2 visa and file the paper work I-130 and I-485 can she wait here or does she need to go back to India ? What is best route here ? or should they get re-married ? Do he need to worry about 30-60 day rule or something ? Thanks alot in advance.

    Immigration and Nationality Act, Sec. 245. [8 U.S.C. 1255] provide basic legal authority for adjustment of status.

    What you want to do it is not as per immigration law. If a person enters, the United States as a visitor, with the obvious intention of applying for immigrant status, their adjustment of status application will denied in the exercise of discretion.

  15. Once you send the AOS/IV documents to NVC, how long does it take to show up in their system? The AVR system still has not been updated and the operator has told me they are not in their system yet. I believe my lawyer mailed them last week. Thanks in advance.

    It takes time to update, so do not depends on AVR. Best source for info is to talk someone @ NVC.
