  1. For CR1: you need DS-230, Parts I and II, for presentation at the time of the visa interview. The Consulate cannot process your case until it receives this form.

    For K-3 visa: you need DS-156 Nonimmigrant Visa Application (in duplicate) and one DS-156K Nonimmigrant Fiance(e) Visa Application.

  2. Isn't the K-3 good for 2 years, multiple entry? It is the K-1 that is only good for one entry. Did they change this rule?

    K-3 visa generally valid for 2-years, except in those instances in which the limitations of age (aging-out), security concerns or ineligibility waiver limitations indicate a shorter period of validity is necessary.

    K-3 visa holders are authorize to remain in the United States for the period specified on their I-94.

    They may request extension of their stay using form I-539. Their status may be terminating if they do not file adjustment of status or extension of stay with the Service.

    They may travel outside of the United States and return using their nonimmigrant K-3 visa, even if they have filed for adjustment of status in the United States prior to departure.

    Rule of thumb is if there isn't a section for the notary then no need to notarize.

    I don't think there are ANY "standard" fiance/spouse USCIS forms that have to be notarized anymore.

    Someone correct me if I'm wrong!

    All depends upon requirement of particular US consulate abroad.

    US consulate, Mumbai still want notarized I-864, I-864A, I-134 forms. In addition, not only they want tax transcript from IRS but also W-2 and tax returns (form 1040). Very clearly following lines are mentions in their instructions:

    .........Failure to provide a 1040 form for the most recent taxable year will delay your application.

    ................Only U.S. consular officers, DHS officers and U.S. notaries are authorized to notarize forms I-864, I-864A, and I-134.

  4. I just received the long awaited approval emails from USCIS for my I-130 and I-129F.

    Getting these emails was definitely a sigh of relief, especially since I had not gotten a single touch since July. I called my wife and woke her up to tell her the good news!!! She was speechless for atleast a few minutes, and then started to cry. A funny coincedence is that I actually faxed my congressman this afternoon to see if he could get any more information on my case, and in response I got the USCIS emails.

    How can I count 5 and 5. In the form written:

    "If you have sponsored any other persons on an I-864 or I-864 EZwho are now lawful permanent residents, enter the number here. "

    But no one is lawfull permanent residence.

    Can any one please put thought on this. Q No 21 on I 864

    1. You can check box 8 for principal immigrant (say your father)

    2. Check box 9 and write your mother name

    3. In box 10, total # of immigrant: 02

    4. In box 21 (a) write: 02 (i.e., total from box 10)

    4. In next line of box 21 write

    Yourself: 01 (it is already mentioned there)

    Spouse: 01

    Dependent children: 01

    and so on…………………..in box 21(h) write: 05

    And reverse the info for other principal immigrant on other I-864 form.

    First, I would like to say congrats to those people starting off this week with approvals. I think VSC is starting to get back into action after a long break.

    I have question: I, like many others on this site, got an approval for both my I-129F and I-130 at the same time. My approval date for both was Aug 3, 2008. Today I just got a letter from the NVC stating that my I-129F papers were being forwarded to Tokyo. I am very grateful for this, but I was really hoping to have the I-130 approved and save on the expense of doing an AOS. My wife and I just had a baby on July 5th, so she is not exactly fit for travel at the moment. I know I am going to kick my own ### for saying this, but I do not mind waiting a bit longer to get the I-130 approved.

    Any advice on what to do? Should I just keep an eye on the mail for the next week or two and wait to see if the I-130 notice also comes? I do have the right to surpass the K3 and wait for the I-130 to make it to the embassy, correct?
