  1. what are priority dates?

    The priority date decides a person's turn to apply for an immigrant visa. In family immigration the priority date is the date when the petition was filed at a Department of Homeland Security (DHS), U.S. Citizenship and Immigration Services office or submitted to an Embassy or Consulate abroad. In employment immigration the priority date may be the date the labor certification application was received by the Department of Labor (DOL).

  2. Hi guys i was looking through the photocopy of my I-129f and i found out i wrote my husband's date of birth in the wrong format. I wrote 24/06/1981 instead of 06/24/1981. what should i do? Any advise will be appreciated. Thank you.

    It is OK. Just do not confuse with British format of date with American format.

    Incidentally, the British format for dates (expressed as numerals) is the same as the French one.

  3. Is there any reason to translate my childs birth certificate for the DS230? I can't find anything on the embassy web site stating that I need too but thought maybe it would be a good idea.

    The child is mine and my wifes (I am USC and she is alien).

    It is better to translate as it is (you can do it) and notarize it. I did for one of my certificate.

    I am the USC and I live in America. My wife and child live in Japan. My question is - Do I list that

    Myself

    &

    My daughter

    as accompanying my wife to the United States? I ask because I will be going with my wife to the interview in Tokyo and at the time she returns I will also be flying back with her. Because of this, should I say that myself and child will accompany my wife?

    I think we are in same situation, in DS-230 form; I mentioned my daughter name in #19 but wrote “none” in 21a, as she is USC. Also, “none” in 21b.

    I am ready to send AOS. I was unemployed since Nov .But i started my new job from april 2009 . Had enough income in past years .Beside i have strong joint sponsor. Do i need to send letter from my employment. I am afraid to ask one as i just started my job . I would appreciate to hear from you guys.

    Here is what I-864 instruction says:

    You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a Government official. For example, you may include a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months.

    Employment letter is an evidence to support your income. Do you have a paycheck stub or something that you can show as proof of your current employment? In my opinion, you should be fine, but sadly I am not reviewing your case :) You can always call NVC to find out if employment letter is required. I don't know of anyone who got RFE because they didn't have employment letter.

    Agree with Champi. Employment letter require proving current annual income and employment. I do not know if they need it from joint sponsor too or not.

I just got my oath letter today :dance::star::dance: The weird thing is that I had a feeling it could be today of all days :yes: My oath is scheduled for May 1 (oaths are held only on Fridays in Vegas). I am soooo happy, I can't wait!! I already started thinking about what I am going to wear :blush:

    I just want some advice or opinion regarding a situation about my upcoming N-400 Interview.

    In 07/2006 I was arrested for DUI, I hired a lawyer for it and in 09/2007 I was offered a plea bargain under which I would have to complete a DUI school, 80 hours of community service, pay a fine & attend a DUI victim meeting, and my DUI would be reduced to Reckless driving. I completed all of the requirements and the DUI got reduced to reckless driving.

    Now should I hire a lawyer to go the Interview with me and If this DUI incident would have any kind of Impact on my Naturalization chances. Any opinion or advice would be greatly appreciated.

    USCIS has not provided guidance on whether a drunken driving conviction (DUI) affects the “good moral character” requirement, leaving it up to district offices to determine the impact.

    However, in the past Naturalization application denied with the notes “constitutes an unlawful act committed within the five-year statutory period immediately preceding the filing of application and adversely reflects upon moral character". And “Because of the DUI, statutorily ineligible for naturalization”.

    Since you already did the community service, etc and DUI reduced to reckless driving.

    You will be OK, as the DUI itself is not a bar to Naturalization.

    But at last, I just like to add, USCIS reserves the right to deny any naturalization application in the provision of INA 101(f).

    I'm so glad to find this site. I can start relax a little bit knowing there are people out there doing the same thing as I am doing right now. It's so hard to be apart from your other half.   9. Alemi, sometimes it takes 3-4 weeks for them to do something after the case arrives at the Consulate. Try immediately sending an email with your case number and asking what the status is.

    dagnytaggart, yes pretty much everything is available here, except the pressure cookers just rock back and forth and don't whistle like the Indian ones (cook for 3 whistles, 4 whistles etc). Once here, a rice cooker is a super handy thing to get - we got ours at Walmart. :thumbs: Also we couldn't find my honey's favorite Priya pickles in any of the 5-6 Indian grocery stores here in our city (only ones that expired in 2006! :angry:) but I don't know if you can bring the oily pickles on the plane. Good quality, inexpensive idlee cookers are hard to come by here, that would be a better thing to stuff the luggage with rather than a pressure cooker!

    Make sure to bring all the original official paperwork just in case (school and birth certificates, etc.). Keeping a joint bank account in India (joint with some family member staying there) is handy for sending money over to India later. :yes:

    I think North and South Indian spices are similar - you can look at recipes online. Sure the spices are expensive here but what to do - keeping spices for years makes them less tasty - they should be replaced every six months at least. We love South Indian food and we always have a full supply at home of the following: coriander powder (dhania), cumin (jeera), mustard seeds, fenugreek (methi), tumeric, dried red chilies, dried curry leaves, cardamom, cloves, cinnamon, ginger plus urad daal (black gram), chana daal (dried chick peas), toor/tuvar daal, moong daal (green gram). The ready-made spice powder mix packets are sold here and oh so handy: masala, curry, pulav biryani, korma, sambar, rasam, etc., as well as idlee, dosa, vada mixes.

    Wow, great thanks so much!!! I will certainly have him get one of those Idlee cookers. I saw a bunch of spices at the store and they were fresh and not too expensive so I think we are better off just getting the spices here. The one thing I am having him bring is kashmiri saffron. So much cheaper there. Here is it $15 for a gram and there is it $6 so it makes more sense to bring it from there. The joint bank account is a great idea also. I will let him know about that tomorrow. He already has all his important papers put aside to bring with him.

Unbelievable...our third party agent...the one who has done all our paperwork, but done the most minimal to check on things calls me at midnight last night, woke me up (he is in Jordan, 7 hours ahead of us). I was like, is something wrong? He said no, its ok sorry to bother you I will talk to you tomorrow. I called him this morning to see what was up. You know what he said? "Oh I got like 15 e-mails for some of my clients with their May interview dates, but I didn't get one for you." What? Why the heck would you call me to let me know that? If you don't have one for me, why wake me up at midnight & ruin my sleep???? Geez...what a jacka$&!

    I am Citizen of Canada and married to a US citizen, I noticed for interview they need birth certificate from your origin country. My origin country is Iran and I left my country more than 20 years ago.

    Due to moving, I lost my birth certificate, and I am unable to obtain a new one! Does anyone know what happens if you don’t have birth certificate from your origin country, or what are other options/procedures? Is there anything else I could provide instead? I have an original translation of my birth certificate in English, but I don’t know if it is going to be enough or not. Please if you have any knowledge let me know! I am worried that they are going to reject me just because of that. Thanks for your help!

    P.S Does anyone know how long takes to get approval for I-130?

    As birth certificate “unavailable” to Iranian nationals then they can use Identity certificates (Shenasnameh) which is available.

    Identity certificates (Shenasnameh) showing the date and place of birth, parents' names, place of residence, and marital history where appropriate, are issued to Iranian nationals in urban centers by the Department of National Registration and Statistics (Edareh Sabt Ahval va Omar) and in rural regions by district (Bakhsh) offices of the Department.

    These are accepted by the Embassy in lieu of birth certificates for visa purposes. Information contained in these certificates must be evaluated with the understanding that certain data, particularly dates and places, may be inaccurate.

    No official fee is charged for delivering documents to the applicants. When these documents are requested from abroad, an indefinite waiting period should be expected before a reply is received.

  12. My wife interview was very short and the office did not ask to see any thing. Here are the questions they asked my wife:

    How did you meet?

    What does he do?

    Why did you wait over one year to marry him?

    The officer called me and asked me the last and final question

    why did you marry this charming lady?

    I will post in detail about interview experience upon returning to US.

    By the way I bought my tickets for $897 round trip from USA and $629 one way from India.

    I am just double checking everything. I presume that the filing fee for I-751 is still a total of $545.00. You never know if they changed there prices over night.

    Another question is about where to send the package. It says on the Instruction that if you live in TN you need to send it to:

    Is that still correct???

    Last but not least what are the recommendations on how to send the package? Overnight or regular mail? Send it with UPS, FedEx of USPS. I am definitely going to send it with return receipt, confirmation and all that good stuff. Just wondering what is recommended?

    I would suggest to send it by USPS priority mail (you can attach return receipt) or certified mail (return receipt not require as you can track it online, who sign the package, get e-mail confirmation).

  14. I just realized that my attorney had given me a copy of the I-134 that was not notarized and i have already sent it to india, did any one who just have there interview use the non notarized copy? do you think they will give me grief?

    If you look instructions for form I-134, you will find “Signing form I-134 is under penalty of perjury under U. S. law. For this reason it is not necessary to sign form I-134 before a notary, nor to have your signature notarized after you sign it“.

  15. ok for starters THANK YOU to everyone on this forum it has been a great help and starting point.

    My wife (Petitioner) and i have been married for 5 years is extensive proof of marriage still that necessary?

    i was thinking about just sending bank statements showing our joint account status and also papers from our insurers from work showing each other as our beneficiaries. Not sure if pictures from our wedding will help as it was 5 years ago nor affidavits for that matter.

    What did some of you send that were for DCF more specifically here in Canada, anyone do a DCF after being married for a long period of time.

    I do not know exact requirement for DCF Canada but here are some examples for Proof of Relationship:

    For spouses of U. S. Citizens (IR-1, CR-1, and K-3 Visas), spouses of Legal Permanent Residents-

    Primary: marriage registrations issued by a recognized governing authority at the time of the marriage. Proof of the termination of any previous marriage must also be submitted (e.g. death certificate of spouse, final decree of divorce or annulment).

    Secondary: Wedding invitations, church certificates, wedding photographs or other reliable documents that show the required relationship. For proof of an ongoing relationship, please submit such evidence as cards, letters, emails, photographs, phone records and other evidence that your relationship is continual.

  16. Hello all.

    My wife is currently filling out her G-325a form and it says to list your employment history. She currently live in Bislig, Philippines and she only work for about 6 months as a sales clerk, in Cebu which was around 2 years ago.

    They ask for the months and year started work and month and year ended work. She cannot remember the exact dates when she started and finished. Also, she has no records or paperwork regarding that employment.

    Would it be better to not list it at all (leave the employment section blank) since she had only worked 6 months in total, or put dates in that will probally be inaccurate.

    I am a US citizen (living in a Chicago suburb) and filed N-400 for my wife (from Pakistan) on March 13th, 2009. Yesterday (April 11th), she received the invitation for finger printing.

    My question is.......Is I-751 (Petition to remove conditions on residence) a requirement for a US citizen filing for the spouse?

    I don't believe I filed I-751 for my wife.

    Is this going to cause a problem with my wife trying to get citizenship.

    If so, can I file I-751 now?

    I-751 use to remove condition on permanent residency (GC has 2 years expiry date) if marriage less than two years but if it is more than two years of marriage USCIS gives 10 years GC. Have a look on GC card.

  18. wondering if it is better to send a check or money order with our I-130. I see advantages of both but which is quicker or more preferred by USCIS? Problem with a check for me is I do not get the cancelled check back from the bank for paperwork reduction policy of the bank. Of course will make copies of either payment method for our records.

    I would suggest personal check as it is easy to track the payment (through online banking or by monthly statement) and receipt numbers as stated above.
