Yor family has the 10 years green card.
I think your uncle is just angry and I doubt he can do something other than upsetting the family, if he was the petitioner he is the one who started the process for your family, then he may be the one comiting fraud (if he can figure out a way to put together a fraud story). There is no law that says that the beneficiary has to obey the petitioner after getting a GC or that they must have eternal grattitude. Even though there is people who believe that.

The only way to get deported is fraud (in this case), and if he helped them immigrate, wouldn't he be just as liable for fraud? If your family is living with the uncle, they need to make it a point to move out pretty much right now, the best protection they can have at this point is to distance themselves from him.
They are not living with my uncle, the filipino community in their area, help my family to find a job and house.
Because my Uncle call them Refugees
I do not know why my father's family attitude is like this,We just pray to God that he will change.

Could be that he knows something behind the scene but his actuations on being superior won't work on any legal aspect.

They did not violate any laws, the only problem is that my Uncle always says that they(my family)entered the US with his help,and he has the authority
to report to the immigration that he do not want my family to stay anymore in the US.

Technically he cannot do that. But he can report something about your family (fraud in application, misdemeanors, etc.) to the USCIS/NVC which can be the basis of their deportation.
My Uncle personality according to my siblings thinks that he is manipulative, always brags,and thinks that he is very superior.
My Uncle always says that if they will not follow his rules and regulations, he will call the immigration.And said that the 10 year Gc is no use if he request for deportation.

My parents and siblings migrate in the US last year thru F4 Family Based petitions.They have a 10 year GC.
The petitioner(my Uncle)and my father had some arguments regarding family issues, and my Uncle warns my family that he will call the immigration in order for my family to be deported.My Uncle and my father's family do not want my family to stay anymore in the US.
Is that right that, my Uncle(petitioner) has the power to call and request for deportation of my family??

Let me cut this short as all goes the same except for the questions.
Woke up at 4am, Cloe fetched us with his dad and arrived USEM at around 6am. Went on line for appointment letter/ID check, scanning of things and went right away to sit on the blue chairs.
Waited to get instructed to line up again for DS-forms checking, pictures attached and no blanks left unanswered. Stub will be given as your cue number.
Was called for finger scanning at window 16.
Watched out for our number to be flashed for pre-screening. Was getting nervous until assigned to window 24, she was nice that you won't feel nervous at all as she asks you.
*We greeted each other 'good morning'!
*Was asked the following questions:
How we met? when?
When was his first visit?
Any other visits?
What's age? my age?
What's his job?
What course I finished in college?
If I still see the girls' father?
She asked the girls their names and age.
Asked from me our birth certificates (wasn't expecting since my fiance' submitted them with I-129F) good I have them, NBI clearance, CENOMAR, affidavit of support, ITR, money remittances, pictures and emails. She complimented me on the emails for using good quality papers,LOL. That's all she asked from me, I was wanting to give her more to lighten the weight of my bag.
Too bad she did not even a single printed chat from one of our talks for 2 years, NO!
Went back for a seat and waited for our number be cued for the final interview. Assigned at RM27, waited for 15mins I guess for an interviewee to finish ahead of us, was seeing RM28 has interviewed about 3 already and we haven't started yet which goes to show our CO might give us a hard time.
As we enter, we greeted her with my daughter saying 'good morning po'
She likewise greeted us. The CO is in her 30's, pretty and simply brushed up her hair.
*Raised our right hand for the oath.
*So you are......? yes ma'am.
*Asked the girls' names and ages
*How did you met Michael?
*When did your first talked?
*When was his first visit?
*What's his job? What does he do? I explained in detail.
She kept browsing our album as she asked me questions.
*Ahh, so you are a nurse? You'll have good opportunity there!..thank you ma'am!
*I see your family are all there..how were they able to get there?... t'was through F4 visa ma'am..what's that? My grandparents petitioned us but unfortunately as the visa quota was available, I was more then 21 yrs old then.....ooohh, u were too old to go..
*I also see that u were once denied for a visa, why is that? Ma'am I was supposed to attend my aunt's wedding as a bridesmaid but got denied......oohh that was bad.
*Alexa's registration is late, why is that?...I answered...then she asked me her baptismal certificate...she asked me again...so Portia is late registered?..I said no ma'am, that's Alexa...oh yes, sorry. I think she was just trying to test me how familiar I am with the facts.
*Does the girls have same father? yes ma'am!
*Do you still see the girls' father? yes ma'am on unexpected circumstances since he lives on the same city....ok, I understand that.
*Can you show me some pictures of you and the girls? I handed her 10 pics each for Portia and Alexa (infancy - pre-adulthood).
, hospital pics right after they were born,baptismal, bdays......the CO really looked at them in detail and glances at each of the girls...she again tried to confuse me, is this Alexa? no ma'am, that's Portia.
CO: I think everything's ok, I don't see any problem. All you have to do is go to window 34(cnt remember it right) so your visa could be printed...I replied kindly...our big thanks to you ma'am...the girls dueted, thank you po, goodbye po!
She smiled and said welcome.
At Window 34, I was given PINK SLIP only!
What a relief! Our talks was just like very casual though I kept waiting for her to look at us but she didn't. It was me who kept trying to make an eye contact. I think as long as you know every detail, there won't be a problem, that's how I see it. Just be smart, show a little confidence and be professional in answering. Being over prepared with documents is an advantage than be sorry later.
Above all, have faith in HIM.

Yes, dito kasi ako nag wo work sa BMC, once a week lang ako umuuwi sa Iriga.

My husband and I told her that the SSN office told us that they will not change my last name until I receive my GC.but it went on more questioning.She asked also why we dont have joint bank account.Still my husband and I told her that SSN in my married last name should be change first,for us to have joint account .
That Social Security office told you wrong. You dont have to wait to get your green card to change your card from your maiden name to your married name. All you need is your certified marriage certificate. My wife has her SSN card in her maiden name and we changed it to her married name ( she now has both), and we dont have EAD or AOS yet. Try another SSA office or go back to that one and ask for a supervisor.

Actually, you got lucky. Technically, since they married, the K-1 is not longer valid. She's legally here; but without any real status at this point. AOS is needed to change the name on the SS card.
We had the same issues and the norm is for the SSA to tell you to come back with the GC.
I think they need to ask help from their congressman.or try to go back again at USCIS local office

Im just wondering any people here same with my case... when my husband petition me as a fiancee visa or K1 he include my daugther in the petition ..so in my appointment letter for visa and medical appointment i should have my daugther with me .. i told the consulate that i will just get my daugther in 6 to 11 months in other words i will be back in philippines this coming feb...2009 this date is a year before they grant me a U.S Visa because they told me i have 1 year before the petition will be expired for my daugther... now my main problem is i still have the paper that the u.s embassy send me but i dont know how to set a appointment for my daugther for her medical and visa...and im having a problem too i do i set it in the fastes way coz im working here now in the U.S ... pls help

BTW, payxibka is right about the TSA stepping up random checks at airports, but Border Patrol also has set up interior checkpoints in the U.S. along border state highways. They stop vehicles and ask the occupants if they are U.S. citizens. So, even if travelling on U.S. highways there is a possibility that one could be questioned about status and have their visas checked. It's not just at the airports that non-U.S. citizens may be questioned.
Oh my! so its not safe? me and my husband wants to go to New York one of these days by train.. we live in Delaware so its just nearby. Now upon reading this thread I'm afraid. My I-94 expires 2 days ago and we are submitting the AOS papers by this week just waiting for 1 important thing. Are we safe to go? It's his birthday gift for me..I'm dying to go I swear! Lol:)

I would think that it is ok for her to travel, even with an expired K-1; as long as she met the conditions of the K-1 and was married within 90 days of arrival in the U.S. She is just waiting for the AOS to be processed and has proof that she complied with the K-1 as evidenced by the marriage cert. I don't see how traveling would be an issue.
I think that it is wise to follow the advice of others here and to bring the documents they suggest with her. She very well might be stopped at the airport and questioned about her expired K-1, but with the proofs that she has I would think she should be fine.
My condolences to your family for your loss.

Since she already had her interview I presumed she already received her Work Authorization Card? That would also be a valid Identification. Just make sure that her name on the plane ticket is the same with the ID she is going to present. As the other have corrctly stated, bring her NOA2, passport, and marriage license in case they need more documentation.

But she is worried if, it is safe for her to travel, without the GC, and TSA is very strict .
I hate to break it to you; but most green card holders do not regularly carry their green card.

Not by airplane. Just be aware that the TSA has begun random checking of immigration status at the aiport checkpoints..... So the answer is NOT 100% no problem. While she is OK it may take some explaining.

her and the father signed the affidavit of acknowlegement at the back of her son birth certificate.
and her son is using the father last name.
Is this create a problem during the visa interview?
The biological father of my kids also signed the paternal acknowledgment at the back of my kids BC but it didn't cause any problem at all. My kids do not use their father's surname though since they were both born prior to the ratification of R.A. 9255 (An Act Allowing Illegitimate Children to Use the Surname of their Father)
An illegitimate child may now use the surname of the father but it still does not legitimize the birth status of the child. Therefore, being illegitimate, the mother has sole custody of her child as stated under Art. 176 of the Philippine Family code.
So if the date of marriage was left blank on the child's BC or if that space has a notation saying "not applicable" then, she could easily prove that the child is illegitimate and that she is and was never married to the father even if the child is using the father's surname... therefore, if she is NOT married then there is no cause for worry come interview time. They will be fine.

The signature only acknowledges the child as his biological son , nothing more. This is actually good for inheritance purposes. Also , I believe we have a law now allowing illigitimate children to use the father's surname as long as the father consents it. Being illigitimate, the mother has sole custody of the child so she doesn't need the father's consent for purposes of bringing him here. Just tell your friend to be honest about the circumstances if questions about the father arise during the interview.Goodluck.
