@tas005 >>>in the 221 g paper they gave me, CO crossed check on “supplemental question” line and asked me to wait for the email, in interview upon my asking, CO didnt even tell me anything what to submit Same here but we received email with DS-5535 link + request for resume In our case email subject line contains MTL###, Last Name, First Name - DS-5535 if your email does not say DS-5535, just wait rather than asking consulate for DS-5535

Sorry to hear about that. Please enter your information in the following spreadsheet for benefit of others in AP https://docs.google.com/spreadsheets/d/1jV7rzX2eCRVoEDRhOtN9a6hDoHRLNEf1P3ZGZbQ0_Dc/edit#gid=0 You may look at it to get some idea about AP - Generally AP completion time varies from 2 - 6 months plus. Most of the member interviewed in Mar/April 2023 are still waiting for AP clearance.

Electronics Engineering is not in TAL list publicly available. It is hard to tell where your AP ends up until you receive visa stamp. There is annotation on visa that says "Clearance received on ....". That mean your case went to DC for clearance supplemental questions refer to DS-5535. and it is checked on 221g. The DS-5535 email from consulate contains online link for DS-5535 form now a days. Updated resume is mentioned in the same email if requested. It is up to you to mail the hard copy to consulate or not. At this point all you can do wait like other members are suggesting.

This link show you what happen when you appear for interview. CO have system to search you in the system. to see if AP is required on not. Generally they ask for your travels in last five years outside USA. I would not mention my visits beyond five years unless CO ask.

You have to reestablish domicile intent before interview otherwise visa will be delayed I would suggest upload and mention formal Rental agreement from your parent in above letter as a separate bullet point + Show some emails that you are actively seeking jobs in USA or enroll for physical courses in USA college . You need to upload everything one week before interview and also take proof of intent to reestablish domicile to the interview . Sometimes petitioner move to USA prior to interview to reestablish domicile.

Consulate used to ask for Resume only when the DS-5535 was not introduced. Resume can be asked from any IR/CR category depending on your education background or work experience in addition to DS-5535. Would you mind telling what is your education background /work experience? In general if the AP can be resolved at consulate level, it will be relatively quicker but if your case is going to DC for clearance then it may take longer. Since they kept your passport and gave you 221g at the spot, you case may resolve quickly. Your case is the first in VJ community where they asked for Resume only without DS-5535

>>2) Im employed overseas so pay stubs arent available is my Tax transcripts and Employment letter sufficient enough? *Im glade I found this forum because you just pointed me to a major whole in my application, I never provided an employment letter will do that ASAP Only US income and US Assets can be used for AOS (I-864). If it is foreign income, you better look for Joint Sponsor(if not) or use JS US income on AOS. >>1) I got a JS waitng on proof of domicile: - Would a Vehicle Registration and Drivers license bearing the same address as the AOS qualify as Proof of Domicile? Generally Tax transcript with US address is sufficient as a proof of domicile. Alternative you may provide Drivers license from your/JS state in US. It will be accepted. If you living abroad then proving your US Domicile at interview will be another issue. Please provide more detail about your residency (Petitioner)

If you can prove in the interview that your income+ assets are sufficient for household size and as per NVC guidelines then ignore this message. Only one car will be counted as an Asset. Otherwise get a Joint sponsor and upload AOS and supporting documents from JS to NVC once your case is transfer to the embassy. Also upload latest pay stub and employment letter indicating your salary (if possible) before an interview. https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition/i-864-affidavit-faqs.html

In addition to enter household member information in your I-864 (Section 6), you need to add Household member just like petitioner under AOS section (NVC site) and upload all documents for the household member there provided you have not done so. It may be available to upload documents after few days. Not sure how you did it?

Either Montreal consulate asked for DS-5535 only or both DS-5535 + CV in the following spreadsheet (mostly): https://docs.google.com/spreadsheets/d/1jV7rzX2eCRVoEDRhOtN9a6hDoHRLNEf1P3ZGZbQ0_Dc/edit#gid=0 Your case is the first case, to my knowledge, where Consulate asked for Resume only. My dad was requested for CV only few years back when applied for B1/B2 visa and the case was cleared in 30 days but the clearance was received from DC

If they ask for your CV it means either your education background/work experience is in TAL (https://en.wikipedia.org/wiki/Technology_Alert_List#:~:text=The Technology Alert List (TAL,nontransfer of U.S.-held technologies.) If they did not ask for DS5535 then AP might be resolved at consulate level not sure. Generally they ask for both DS-5535 and resume together. AP Processing may take from 60 days to 6 month plus for Montreal.

Just visit walk-in clinic/travel clinic and ask doctor to write immunity test requisition for you. You can take that requisition to LifeLab. Your walk-in clinic will receive the results within a week. Based on results, you can immunize yourself. One dose is enough for medical and take the immunity test results to embassy panel doctor along with immunization record for recent doses (if applicable) signed by nurse (Yellow booklet).

@ALC I just saw spreadsheet. Congrats on clearing AP so quickly just in 85 days. Would you mind telling what is the clearance received date on your visa. You told earlier that 8/31 was the last update for you.

We also got template reply after one week to inquiry about receiving DS-5535 and resume. They included the interview date in the template reply. There is nothing in the reply about receiving documents or not. Will send next email in mid January 2024 to see if they have any updates. Looks like consulate look at the case as date was updated.

Case FE note with DQ
Leo The Great replied to EternalForeigner's topic in National Visa Center (Dept of State)
Can the immigrant visa applicant count assets that he or she owns that are outside the United States, such as real estate or personal property? Yes, under the following conditions: The assets must be convertible to cash within 12 months. The applicant must show that the assets can be removed from the country where they are located. Many countries have limits on cash or liquid assets that can removed from the country. The net value of assets must be at least five times the difference between the sponsor's income and 125 percent of the poverty guideline for the household size. https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition/i-864-affidavit-faqs.html#aos15 By the way CO only take into account US assets in Montreal consulate. Not sure about other countries. -
Case FE note with DQ
Leo The Great replied to EternalForeigner's topic in National Visa Center (Dept of State)
You always get FE notes when your income does not meet the requirement even though you declare your US assets exceed the income requirements. It should cover 5 years of income. You may ignore it. But before interview upload the documents showing proper property evaluation and mortgage statement if any (if you have not submitted it to nvc). You may prepare a Assets Summary Page showing all property value - mortgage if needed -
It appears from spreadsheet you filed exactly after 90 days. What should be the reasonable time to file WOM in case your lawyer talked about that given current situation when govt is fighting WOM in some districts? MTL ask you to wait for 6 months before sending any inquiry.

One of my parents got stuck in AP earlier this month. The case status updated 6 or 7 times in 2 weeks after submission of DS-5535 and after that no more updates. I can guess they may be preparing file/data based on DS-5535 and DS-260 to send it to State Dept for further processing as our case is in the earlier stage of AP.
