Only EB1/EB2 update on NVC (DQ, IL)
appleblossom replied to snm2212's topic in National Visa Center (Dept of State)
Nobody will get an IL straight away, it takes time to be added to the queue once the PD is current, then scheduled for interview. Even the quickest consulates won't be immediate. And some consulates have really long queues (2 years or more), so it does very much vary. If you can please fill in your timeline it would be really helpful. -
An airline employee isn’t going to ask you that - the person that was asked above was asked by the immigration officer. You’re overthinking it because you already have a visa in hand and you just need it administratively processed. You’ve done the hard part! I travelled with my envelope last July and my only concerns were if I’d remembered to cancel the post and should I have packed more tea bags. It honestly didn’t occur to me that I’d have issues on entry, and the whole thing was maybe 2 minutes (and that was for 4 of us) before we walked through the arrivals hall as LPR’s of the US.

Delay … we sent too much?
appleblossom replied to nullaccount's topic in K-1 Fiance(e) Visa Case Filing and Progress Reports
If you only applied in August, then you’re certainly overthinking it (not dumb though!). Processing times are 14 months (https://egov.uscis.gov/processing-times/) on overage so whilst there will be some that are processed sooner, most will be nearer that timescale. -
I-130/Proof Of Marriage (Merged)
appleblossom replied to mopekmez's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
No, you're misunderstanding the process. The petition will take around a year to be approved by USCIS (official processing time says 14 months, but most people seem to be approved in around a year or so), and then it will go to the NVC for the second stage of the process. Follow this guide which gives you a step by step overview of it all so you can understand how it works -https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition.html And the VJ guide linked to above is worth reading too. She will complete the process in London, no need to go back to Nepal at all. Good luck. -
For what will need to be uploaded when you get to the NVC stage - https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-5-collect-financial-evidence-and-other-supporting-documents/step-7-collect-civil-documents.html Make sure you check the country specific guidelines so that you can ensure you get the right documents i.e. the correct police cert. And for the interview you'll be sent a list when it's scheduled.

The can of worms has to be opened at some point anyway, unless they want to spend the rest of their lives looking over their shoulders and risk him being detained and deported. They need to take some kind of action to get him legal status, the only question is if there is any way to do that from within the US due to his disability, or if they need to leave the US. -

So did they take any steps after his I-130 was approved? Did they do anything to get him a visa? I can't see how he can adjust now as he's overstayed and is out of status, I'm afraid I think they need to get him back to their home country. But I'd absolutely consult with a lawyer in case there's any kind of exception due to his Down Syndrome. -
Can I re-marry my ex-wife?
appleblossom replied to Okegiftgift's topic in What Visa Do I Need - Family Based Immigration
What does your ex-wife think? Maybe it's just the phrasing, but it sounds as though you've decided this unilaterally! Whatever you (both) decide, I'd suggest you take your time to re-discover each other and see if you are compatible or not, people can change a lot in 7 years. Even though you've been married before and have children together, you should date for a while first and see what happens - both for yourselves, but also so that it doesn't look suspicious in USCIS's eyes. You say your ex has just moved to Canada on a study permit, did she ever try and get a F1 to study in the US?? -
Glad you asked that, I was thinking exactly the same thing! It's possible I guess, if the I-130 was approved in record time - or maybe the OP means the I-130 was approved in March rather than being DQ'ed and is just confusing the two terms?

1. No, he wasn't eligible back then due to his Priority Date being current. 2. What's happened since then, nothing? Why didn't they submit his AOS application when his PD became current? Where is he now? -
Only possible within a year of yours being granted I'm afraid. https://travel.state.gov/content/travel/en/us-visas/immigrate/family-immigration/nonimmigrant-visa-for-a-fiance-k-1.html#:~:text=Your children may travel with,of your K-1 visa. So you'd need to petition them for their own visas. Good luck.

If you submitted it online then you know it's been received (there would have been a message saying so after you hit the 'submit' button). If it doesn't meet the consulate requirements then they'll be in touch again. Nothing to do but wait, you won't get any kind of update in the interim as said above.

The whole process is set out step by step here, which tells you everything you need to submit - https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-5-collect-financial-evidence-and-other-supporting-documents/step-7-collect-civil-documents.html Just in case you hadn't found that webpage yet, as I found it super useful. And make sure you look at the country specific documents too to make sure you get the right version of everything.

There are long running threads about AP so worth doing a search for them. But as you'll see from those, the length of time varies hugely (as above, 2 weeks to 2 years or even more), depending on the reasons for it and the country(ies) where the checks are being done. Some countries are known to take much longer as their records aren't great, others will be quicker at getting the info needed. But have a search and hopefully you'll find some relevant info on some of the AP threads.

Yes. It will tell you when it's being produced, then about a week to 10 days after that it will tell you it's being shipped, and give you the tracking number.

No way to track the SSN, but you can track the GC. Just use the same tracking page you've used all the way through, but use the receipt number from when you paid the GC fee this time instead - https://egov.uscis.gov HTH.
