    If you were in the US and applied for your green card via AOS, then forget everything you did! It’s a completely different process for consular processing. There is no adjustment of status for them as they’re applying from outside the US. As you say, your parents are immediate relatives, so no wait for them, versus many years for your sister. Good luck.

    It's more complex than that - child must be under 21 by the time the visa is available, but there is the CPSA which can sometimes help. But it won't in this case, as it will just take too long. So both of the children will definitely have aged out by the time a visa is available. Just I-130. I-485 isn't relevant for your sister. Good luck.

    There was no need to delay the approval, as it's the length of the marriage on arrival in the US that determines whether it's a CR1 or IR1, not at the time of approval. As long as you enter after the 2nd anniversary of your marriage, your actual GC should be IR1.

    I think you're underestimating how big a mistake that was though. She is very unlikely to be granted a visa now having shown she ignored immigration laws previously, particularly with a USC spouse. As said above, leave it for a few years then try again, you never know. Good luck.

    There's a long running thread about IL's for Montreal for CR1 applicants, that's where I found when the last batch of IL's were sent out. If you were only DQ'ed on 15th Feb then I'm not surprised you've not received an IL yet, even with an expedite. Montreal probably haven't even got your file yet, what does your status say on CEAC? Just to confirm, you have received the expedite from the consulate? Not from NVC?

    OK, then yes, they have - went out at the beginning of the month. But if you have been expedited at the consulate then you may well find your IL isn't sent out with everybody else's. When was the expedite approved/when were you DQ'ed?

    You file one I-130. Both the children will have aged out. You’re looking at far longer than 14 years - if you look at the Visa Bulletin you’ll see that it’s currently at May 2007 (meaning those who applied nearly 17 years ago only now have visas available to them), but go back a couple of years and look at the bulletin from February 2022. You’ll see that it was at March 2007 for that category, so has only moved forward 2 months in 2 years. At that rate it’ll be at least 25 years before they can get a visa. But all you can do is file and see what happens. If your sister or her husband have any other route to a visa (i.e. employment), they be wise to explore that.

    Unless you would qualify for EB1 or EB2 NIW, it will be whatever your employer is prepared to sponsor you for and whatever their immigration lawyers recommend. You're not likely to get a choice in the visa.

    Ah ok. Yes, that would be fine, plenty of people move countries after applying. You may need to rethink your timescale for applying though, and do check the wait times for interviews in Sydney as I know they did have a big backlog (whereas London is very quick). Not sure what it will be like by the time you are at the NVC/interview stage, but it's something to check and try to factor in anyway. Good luck.

    Just to be clear, you'd be returning to the UK in August 2026 to wait for your visa to be issued? You may find that you end up interviewing and finishing the process in London anyway then if that's the case so spending time in Australia in the interim wouldn't have much of an impact.

    As an EB applicant, your only option is to mail the documents. Do you have a lawyer, has the WL gone to them maybe? Daft question, but you've checked your junk/spam folder I assume?

    Not everybody that's DQ'ed in a month will get an IL that month - if, for example, the IL's for London go out tomorrow (27th) then usually there is a cut off date i.e. anybody DQ'ed after the 17th won't get an IL in that batch as they were DQ'ed too late to be added to the list. So then they'll go in to the next month.

    OK, so you'll have been added to the queue in January. I don't think this month's IL's have gone out yet (they are often right at the end of the month for London), so you may well get an IL in the next few days for an interview in March or April. Good luck.

    Usually super quick, generally IL in the month following DQ (possibly another month if you were DQ'ed late in the month and miss the cut off). And the interview is usually 4-6 weeks later.

    But as per the link - the certificate is valid indefinitely if they haven't lived there for at least 6 months since it was issued.

    Your concern isn't clear. We don't know if you (or whoever is being interviewed) has returned to the Philippines and resided there for 6 months or more or not since you got the certificate. If they haven't, then it's still valid regardless of the date of it, as per that answer. And if they have, then yes, you'll need another one unless you by any chance get an interview just before it expires.

    I think it's just proportionate to the amount of interviews done for each category. If you look at the monthly visa stats you'll see that there are very few family based visas (non immediate relative) issued each month compared to other categories so presumably a lot less interviews too.

    I'd say no chance at all of it reaching Feb 2021 in the April bulletin - that would be a jump of 10 months! Given the amount of retrogression over the past year, I can't see it moving that far personally.

    It depends on the consulate. And the wait for an interview varies hugely depending on the consulate too - some have waits of only a couple of months, some are a couple of years.
