  1. For EB-3, isn’t your employer providing the immigration lawyer? Unusual if they’re not. We used Fragomen for our EB case and they were great. *Thread moved to Work visas, as the OP is not doing adjustment of status*
  2. If it’s health related have you called the doctors? The consulate don’t really have anything to do with the medical other than ticking a yes/no box to say if you’ve passed that requirement or not. Anything more nuanced I’d ask Visa Medicals.   8. They do mention about police records, but normally only for those with 3+ alcohol related incidents. Odd that they've asked him for this. Maybe he ticked a box he didn't need to? Or has he perhaps been arrested more than 3 times but only convicted once?

  14. The classification seems correct to me. By my calculations you were only a month or so short of your 21st birthday when your mother applied for you, and your PD didn't become current until July 2025. So by the time your PD became current your CPSA age was approx 21 years and 7 months, meaning you'd aged out in to F2B.

  18. The IV scheduling tool is usually pretty accurate. On the plus side, it was 18 months wait not that long ago, so they've reduced the backlog massively - and possibly will speed up a bit more between now and then too. Good luck.
  19. Does her employer by any chance have has US locations she could request a transfer to? If her job will continue from the same source then she could use it. If not, then sounds like her only option is to go ahead and find a job in the US. You can visit in the meantime though, and most jobs would qualify her so hopefully you won’t be apart for too long.   21. Ah, ok. In which case I'd definitely wait for the response from USCIS, no point in chucking more money at it if there's no chance of a visa anyway.
  22. Doesn’t sound like it then. You need to have spent 5 years in the US but at least two of those must be after the age of 14. DCF isn’t an option if you’ve already filed the I-130 as said above. Looks like you’ve already tried for an expedite and had it refused? So nothing you can do but wait it out I’m afraid. And yes, back file your taxes asap! Good luck.
  23. Why was the first case refused? What kind of case and what complications? It doesn’t sound great, the whole point of using a lawyer is so they make it easier and save you the stress of doing it yourself - but sounds like they’re doing the opposite!
  24. It’s perfectly normal, just means they need something re-doing. My daughter had to do the same, apparently her photo wasn’t good enough so she had to have it re-taken.
