    Hello All, 
    We had our interview on May 23 and our visas were approved. 
    Wanted to mention some information in here in case it is useful for others.
    Our case was EB-2 NIW, DQ Nov 2022. Both born in Iran. We lived in US on F1 Visa for more than 4 years and had never entered US other than that. We didn’t have a job offer.
    So the interview went great. As everyone mentioned here, one officer took our original documents and a copy of our passports. Asked general questions. Then we sat for the interview. 
    The interview then took less than 30 minutes and it went smoothly. Officer was very nice during the interview. we were asked if we have a job offer (by both officers) to which we replied we are in the process and we do not have an offer yet. The officer asked about our past experiences and where we want to live and similar questions. 
    He then took a couple of minutes taking notes after which he congratulated us and told us our Visas are approved. 
    BTW around the MTL embassy is all under construction and it is a good idea if you get a nearby hotel or arrive sooner.

    you are welcome! I think the MTL embassy is very familiar with NIW cases and it is not like they would need the memo but it is good to have it in case it appears to be a problem. 
    He didn’t ask specifics, just if I already have one or if I am still in the process and I said still in the process.

    Cannot be sure about definite but there is high possibility of getting DS-5535 for a male from MENA countries including China and Pakistan. Mentally prepare for it if you are asking this question for yourself. Be positive about the outcome of the interview.

    The EB-2 and EB-2 NIW (National Interest Waiver) visas are both categories within the U.S. employment-based, second preference visa program, but they have distinct differences mainly in terms of the requirements for sponsorship and the basis for granting the visa.
    EB-2 Visa
    The EB-2 visa category is generally for foreign nationals who either have an advanced degree (beyond a baccalaureate degree), or a baccalaureate degree plus at least five years of progressive experience in their profession (classified as "exceptional ability" in their field of science, arts, or business). The key requirements for the EB-2 visa are:
        Job Offer: The applicant must have a job offer from a U.S. employer.
        Labor Certification: The employer must obtain a PERM Labor Certification from the U.S. Department of Labor, demonstrating that there are no qualified U.S. workers available for the position, and that hiring the foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers.
    EB-2 NIW (National Interest Waiver)
    The EB-2 NIW category also falls under the broader EB-2 classification but comes with the advantage of a waiver of the job offer and labor certification requirements if it can be demonstrated that the applicant's work is in the national interest of the United States. The key aspects of the EB-2 NIW are:
        No Job Offer Required: Applicants can self-petition; they do not need an employer to sponsor them.
        Waiver of Labor Certification: Applicants do not need to go through the PERM Labor Certification process.
        National Interest: The applicant must demonstrate that their proposed endeavor has both substantial merit and national importance, that they are well-positioned to advance this endeavor, and that, on balance, it would be beneficial to the United States to waive the job offer and labor certification requirements.
    Key Differences
        Sponsorship: EB-2 requires an employer and a job offer, while EB-2 NIW allows self-petitioning without a specific job offer.
        Labor Certification: EB-2 requires a labor certification, whereas EB-2 NIW does not, provided the waiver criteria are met.
    Both visa types aim to benefit the U.S. by attracting high-skilled workers, but the EB-2 NIW provides more flexibility for individuals who can prove that

    @neds @Coco_2023  My lawyer also recommends to have an employment letter of any correspondence from an employer can strengthen the application and if I do not have, my case may result in AP.

    You get whatever you are missing from your own doctor or Travel Clinic or Walk-in Clinic.
    You can ignore the US State department website as they are out of date.
    MMR and Hep B can be tested by blood work if no records available.
    Tdap must be within 10 years and COVID-19 within 1 year.

    They send the results electronically to the consulate. However, a few clinics give a sealed envelope and you must keep it sealed for the interview.

    Long story, but my original DQ date was October, 2020.  For some unknown reason it was changed to September 2022.   We could never get an explanation as to why.     Either way, interview date is April 15th.

    2 months progress. May to July! So glad to finally be seeing movement again! Hopefully it continues to clear 2 months each month!
