    This is only $4450 above the very minimum.

     

    In my opinion (not a legal advice), there's a great chance of getting RFE down the line if you try to use your income and it's this close to the 125%.

     

    All of this can result in delays getting your case approved as you will be searching for joint sponsor then and there and having USCIS to pay attention to your RFE reply.

     

    I'd find somebody with at least $40k income ($50000+ even better for every year in each of the last 3 years) to be a joint sponsor.

     

    Please do not take personally, I say this to save your time and reduce chance of RFE.

    A risk for sure, esp if from LPR or non-citizen but just to say, my husband made 1k over threshold and under threshold yr prior and we weren't RFE'd

    It's all simple and straightforward to us, but simple things are like rocket science for USCIS.

     

    I'd attach a copy of I-485 receipt with I-131 and a short letter explaining how the fee does now apply for this filing.

    But its updated today to case approved with yesterdays date and approval notice is under documents

    mine was 10months 
    IT was 3months for 4 months then when it went to FO it jumped between 8-10 for 2months
    Then approved

    For my case, I'm the beneficiary and my fiancée (now wife :D) is US citizen. I never left the US since filing the case.

    I was curious if I-485 got approved and they gave wrong denial notice. I got a denial for i-131 after i-485 approved but I imagine you would have known by now. Definitely think it's worth applying again with proof for reason you say. Especially as it's free.
    Make sure you include I-485 NOA1 when you file

    We initially filed in March 25th but they only accepted the vaccine waiver I-601 and rejected our case because of an error on their side (USCIS mistake)

    Resent everything back in April and got rejected again because of wrong payment (still had to pay over 1k more for THEIR mistake)

    Eventually resent everything back again in June and they accepted our case.

    4/17    NOA for I-601
    6/21    AOS Final Application Sent

    7/05   Biometrics Scheduled
    7/16    Biometrics Done (Went 2 weeks earlier)

    Hopefully everything will move as quickly as the EAD, especially after all the hiccups with the initial application. Also, wondering if anyone else had this experience of USCIS "mistake"? Our lawyer said they had a lot of cases rejected like ours for an error USCIS made and we're assuming they were just trying to get more money from people since they changed the fees in April?

    Should have your receipt number as end of address. You have to have logged into myUSCIS recently for it to populate else you'll get an error. You can only look up your case numbers.

    Only useful bit is 'last updated'. Rest won't tell you anything that myUSCIS doesn't

    my petition date was 3/13 and I had my biometrics on 4/4. This is the first update I’ve had on my I485 since my biometrics. Not sure if this has happened to anyone else or if this was a glitch of some sort? Nothing in my documents tab either.IMG_0713.thumb.jpeg.14b0c91e9a678efb8f124fedcd655351.jpeg

    best you can do is wait a day or two or ask Emma. I have an update today too but no change on myUSCIS yet

    Was hoping on a fast approval, we have a pretty easy case, same nationality originally, lived in same city back home etc.

     

    I think besides the few cases that are approved in 3-4 months time a more realistic timeline is 1-1.5 years from recent approvals i've seen on our Facebook Group.

     

     

    It's very Field Office specific (as well as usual fluctuations). I personally don't know any 2024 filer that has been waiting longer than 7 months for AOS. I think he was the longest we've had waiting (Applied Dec 2023 technically). The 2023 and 2022 filers seem to have been a bit 'left' behind. 
    I don't have the largest sample size of K1 to AOS though as not everyone in k1 group stays active during AOS but yeah, from personal experience everyone I know has gotten in 7months or less recently. The 7 months also had RFEs, an interview scheduled then canceled so it was an odd one anyway.

    I do always say it can be anywhere from 2 weeks to a yr on ave though. I did see someone get it in 2 weeks which is rough when still waiting 😭 I wasn't originally bothered but it turn out a lot of local jobs in my field require gc, USC or travel so now I'm anxious for it.

    Have you been checking API to see when your case was last accessed or checked if it's at local field office yet? Mine was sent to KC early June

    for k1 you need 100% of poverty line and assets need to be 5x the income req, think just over 100k now?
    spousal is 125% and assets need to be 3x

    Your parents will be cosponsors, so you'll both fill out an i-134 (or I-864 if you go spousal)

    I am not up to date on spousal or if you can do consular processing but I think spousal takes about 12-18months on ave in London
    Fiance is taking 6-8months

    Spousal is the better financially and giving your partner right to work/drive etc but if time is main priority, which it may be here with parents being ill, K1 may be better. As I say, not up to date on spousal route so I could be wrong but 'what is fastest' is not usually what people consider when advising here, for me that was a big factor which is why I did k1.

    you'll need a joint sponsor

    EDIT: if your partner is Polish, make sure they have a Polish police certificate by interview or NVC stage for spousal (I think?). There's sometimes confusion for people who left their birth country young, no idea if that's your situation

    they can renew your noa2 up to a yr, your medical sets visa validity (6months) so don't do that too early

    current k1 timeline to hear back (RFE incl) is 3-6 months, then 1-2months NVC then unsure what wait time is at Iran but others are right you have a high chance of additional processing (extra bckgrd  checks) which could be any length of time

    agree with appleblossom, I think they actually sort medical within 5 days but it just depends how fast embassy processes it. 9 days will probably actually be enough time but if not, you'll just go into 'reused' status until they have it and process it. It's not a denial, just what they do while they wait for missing documents.

    They also review the case to check USCIS included everything and there were no errors in their adjudication. I imagine they also need to enter things into their system and then liase with embassys. It is entirely the embassy who decides if and when a case comes to them. NVC can't ship without the go-ahead from embassy. They are also handeling numerous other case types which are more intensive. K1 is a drop in the bucket to them, they have more going on that looking after your case. You're in a queue, it takes the time it takes. 

    Average is 3-6 weeks with 5-6 weeks being most common.

    I am not aware of any institutional scale scams faking USCIS security…plus the handful of banks/credit cos have had since 2015 to authenticate USCIS. 
    They are a bit self interested since the no charge back provision…and immigrant consumers too vulnerable to make noise…let’s see

    this has been a long term issue with cc payments, it's not new to fee incr to deliberately catch you out. Banks know if a charge is legit you can just call and  fix it, however uscis won't wait around for that to happen

    After the interview I went straight to the hospital..Doctors said was Guillain Barre syndrome that Tdap vaccine and stress caused it 😐 

    I had a treatment for a week and now I get better and better every day ✌🏼😊

    yes, k1 they just use it as a guide. It's not officially enforced like it is for AOS. You also submitted it previously to embassy, not USCIS

    you don't need to include form I-693 if your AOS is within a year of your foreign medical
    Just attach the copy of vaccination record. I also attached the instructions that state I'm exempt from I-693 due to foreign medical
