    Hi everyone!

My girlfriend and I met while on a trip. We exchanged numbers we were purely friends then. She went back to her country, and I came back to US. We kept talking as friends and as usually things goes, we planned a trip to see each other for 2 weeks, we did and it was amazing and all great. Because we have been talking for so long and also because we are already planning another trip to see each other and be together, we also discussed the K1 possibility since we do want to be together. I have not proposed yet, and I completely understand the whole K1 process and it's requirements. However one thing stood up to me, do I need to be engaged to her before starting the process? Can I start the process, get engaged, then marry as soon as she come? I have evidence of our intentions, due to chats, and also photos of us together since we were a relationship pretty much from day 1 since we just clicked. Will have even more photos on the second trip but that is like 2 months from now.

In essence, any issues I submit now and don't have specific wedding plans or are not engaged yet? Even though I do plan on getting engaged with her.

A K1 visa is a request to the US government to allow you to bring your fiancée to the USA so you can get married. This starts with an engagement and an engagement ring and then wedding plans which are all included in your K1 visa package.

A visa package without significant wedding plans, photos of an engagement event etc will probably result in an RFE asking for this evidence.

Don’t forget you need 2 letters of intent to get married too signed and dated & properly filled out.

  3. When you get the Affidavit of being single for your fiancée from the Colombian government get it translated into English by a certified translation company.

Then write a short letter to the service center that is handling your K1,case with a copy of the Colombian government affidavit of being single,  the certified translation and the NOA1 letter.

In your letter - Briefly apologize for forgetting to submit this affidavit and respectfully request it be added to your K1 visa package.

USCIS can accept the addition,  or not,  it’s up to the visa officer but go ahead and be proactive with this suggestion.

This should cover the service center adjudication.

Upload the certified affidavit of “being single” at the NVC CEAC stage under other documents include the translation.

Bring the original letter to the visa interview.

Then 2 weeks before the face to face visa interview at the embassy both of you write new letters of intent to get married clearly stating you are both single - and legally able to get married in the USA.

You can get the Colombian government affidavit certifying your fiancé is single at this address in Bogotá Colombia -

    Carrera 7 - Calle 32 - numero 17 - Edificio San Martin, Bogotá Colombia

  4. In Colombia it’s a normal term of endearment but we recommend you get a letter from the Colombian government that attests to your fiancée’s single status.

its called an affidavit of single status and can be easily obtained from the Colombian National Civil Registry  -   The address in Bogotá is Avenida Calle 26, #51 - 50.  - CAN

This letter states your fiancé is single and free to marry - get it translated into English.

Have this affidavit of single status letter ready in case you get asked about the chat logs.   Either from the service center or at the embassy interview.

it overrides any playful banter and chat in your chat logs.

Relax - you will be fine ok

  5. My first wife was from Colombia and I submitted dozens of pages of chat logs using these terms of endearment -

it’s normal in South America to use such terms of affection even though not real -  on paper 📑

using the term promatida  and promatido   is redundant here in Colombia.  If engaged you are now the esposo in Latino culture.

My first wife visa was approved no problem.

Now I’m waiting on my second K1 visa for my beautiful new wife and our chat logs contain the same words as you used -

mi esposa mi Esposo etc.   Relax - if your fiancée gets asked about it she will tell the immigration officer it’s a normal means of showing affection in Colombia 🇨🇴 Which it is - don’t sweat it ok -

I’ve been there and done that twice now 👌

This may be a waste of effort, but I am curious if there is any faster way to get my spouse-to-be into the US and living with me, as she has been struggling financially. I studied as much as I could the differences between K1 and CR1 (with K3) and was advised by a friend that works in immigration that we should go K1 route. We filed our 129f at the end of July this year and it we got NOA1 that it was received on 1Aug2022 and had begun processing at the California center. The approximate timelines are pretty disheartening. My fiance is a Canadian citizen, if it matters any.  I was just curious if we had made a mistake and should have just gotten married over there and filed for the 130. I wasn't sure if there was any way for her to move here while waiting on this processing timeline, had we went the other route. I read that the Biden administration was going to work to get times down to 6 months, I don't know if there has been any change to be hopeful for though. Thanks!

USCIS has been allocated $275 million dollars by the congress to hire new employees.  By October 2023 the K1 visa process will hopefully be a 6 month process from NOA1 to NOA2 once the new employees get properly trained.

Filling out the form I-129F, I came across the section about meeting through an IMB. I answered "no" because we met on a dating website which is not a marriage agency. However, do I need to provide any kind of evidence that the website is just a dating app and not a marriage agency?

Download the terms of service from the dating website- this is good evidence for USCIS. Include in your K1 visa package.
