In my experience they are approved together.

It’s as accurate as the info VJ members are inputting on their timelines. The processing times on USCIS (by service center) is what I’d go with.

Just expect a year. It might take more or less but there is no accurate way to predict.

Mickey344 reacted to GEOntificator in How much of Evidence is scanned online?
Some are poorly scanned as same pages show up a few times (at least for me). My guess is that whoever the third party contractor they are using is just jamming papers into the scanner without checking it again. If pages are stuck together and that is how it scans they let it happen. This is not to say that they do not have what you sent but everything is possible with the USCIS.

Not really sure it is normal as I was of the understanding that all evidence submitted is eventually scanned and uploaded. That being said, it probably doesn’t hurt for you to upload them yourself, but I would wait a week or so to see if more documents show up first.
Good Luck!

Not being in the US shouldn't be a problem for you (I hope you can manage to receive the approval letter from USCIS).

Hey everyone, so I'm an attorney. I finished this J-1 waiver process for my family last month (see previous posts), and am now considering staying involved in this area and helping out after realizing how much of a nightmare this can be for people. I'm not going to give legal advice in this forum, but go ahead and message me if you want my contact information.

So the actual processing time is 20 months. At least we have one certainty in the midst of all the uncertainty.

It's extremely random for hardship cases. Some cases were adjudicated 6 months after filing, and some were filed in 2020 and are still pending. No clear pattern allows us to establish which cases DOS is currently working on, i.e., submitted in May 2022, and DOS does not share how they choose the case and how they process it. All we can tell is that the rough average waiting time is ~20 months, but it can be 30 months or 10 months in your particular case. We don't know how many cases in total, how many people processing it, what is the processing time for the average case, nothing. Only the time from submission to approval/denial. There was an attempt to collect many cases to apply statistical methods to determine more about how DOS handles individual cases. Still, it faced significant negativity and shut down shortly after rolling out.

Very devastating. May we have the strength to keep waiting for our cases to be adjudicated.

No approval for me so far. 7 months since form I-612 reached DOS.

Not at all. Writ of Mandamus is a legal tool to compel a government agency to render a decision when a case has been pending beyond normal processing time. It cannot force the DoS to render a favorable recommendation but they will be required to decide within a specific timeframe . I don’t think they are offended when it’s filed against them. In fact I have seen cases get approved this year after filing the mandamus . The person had been waiting since 2021
