  1. Hello,

    I filed my I-485 packet and haven't received a confirmation yet.

    There was a question I misunderstood.

    It asked if I "have ever violated the term of my nonimmigrant status,"  I answered no because I thought it meant working here. To be honest I never intended to stay in the US, I have an approved i-130 and on a recent visit my husband insisted I stayed. Has this ever happened to anyone? What was the penalty as I do not want to be fined for lying but I hinestly misunderstood

    Present tense- if you were in the US. So N/A for you.

     

    Past tense for when you arrived and present tense for when it expires. Again applicable to if you were in the US. Since you are not, N/A.

     

    If still confused, read pdf instructions where it specifically says those questions to be filled out if you are currently in the US.

    I do since I visit the USA. I came back to my country a month ago. when i log into the i94 website and put in my information I do have a number along with when I entered and when I am authorized to stay to.

    should I put that in this section?

    What was the beneficiary's date of arrival?

    When does the beneficiary's authorized stay expire?

    For beneficiary class of admission do I full this part out and put B2 or leave it blank?

    I have a visitor's visa and not in the US now but the explanation says:

     

    What was the beneficiary's class of admission?

    The beneficiary's class of admission is the 3-digit code for the immigrant category under which they were granted their permanent resident status.

    This code can be found on their Permanent Resident Card and usually consists of 1 or 2 letters followed by a number.

  5. Hi,

    'I am filling out the i-130 for step child. I selected child when it asked about relationship and selected step child as the description.

    Now I am getting an error because I didn't attach anything for proof of parent - child relationship even though I added the requested evidence for step parent -  stepchild relationship.

    can someone please advise what I did wrong?

    I cant find the appropriate video on youtube about filing for a step child

    Yeah, my whole thing was I would rather take my time and do it right than get an RFE and lose weeks. It took forever to get all the affidavits (it was like herding cats) because we always lived separately and don't have lots of 'hard' marriage proof so that .  Evidence part (pictures and all that proof) took almost two weeks to put together.

    A pack rat can complete this in a day because he will have so much info handy for evidence. (letting go of it is a different issue 😜)

    A very methodic person could spend over a month dotting all 'i's and crossing all 't's.

     

    As has already been stated it varies for everyone.

    no passport, birth cert, marriage cert, missing boarding passes, etc - time to get or find them

    not married - time to wait 🤪😝

     

    As you plan to get married, start getting your docs in order. that way last item needed will be the marriage cert.

    If already married, just work it the chance for doing some work in advance is gone

    Yes I understand. I just wanted to hear experiences.

    Once we decided to file it took about 3 months to get our evidence together. But, we've been together for 2+ years... 

    how long did it take to put your i130 packet together when you started?

    Thank you. That’s the timeline I was thinking of too because I will be in the states in a few weeks and will be putting the application together. Hoping to finish it before I leave

    Maybe work through gathering all the required information you need for both I130s referencing the I130 instructions (the I130A is self explanatory for you), scan and convert these documents to PDFs and have them ready to help your spouse file everything online.  The online form is fairly easy, my wife and I recently filled one out for her adult married son, and as stated, it is the easier way to file and pay, but there are a few weird things about it like when it asks for his or your current address, it requires a date input even though you are still living there, you can simply put in the date you fill out the form.  Also, you sometimes have to re-enter the name of your current spouse.  When you come and visit next time, you can both work through the forms and get them filed.

    Good idea. 
    we have nothing joint since I don’t live in the US. I’m worried about what to submit with the i130 as evidence. We have photos, tickets and conversations since we have been together 3 years so I hope that’s enough
