    Second link is the USCIS authorization, just write in DOS ( dept of state) and send it in , if she wants you to re do one , don’t stress. Also call her office , just use baby daddy’s address as your permanent US address when speaking w them. Say you have booked tickets and need urgent help w passports

    4. Pay for another delivery tracking to replace the expired one , just in case it’s asked for. But email the delivery service and have them confirm in writing how to find out if anything was ever sent through that tracking number from the embassy. …because a passport or documents may have been lost/ stolen in transit and they cannot just walk away from the issue. All of this through emails, cause by phone everyone seems to be blowing you off.

    Thank you so much! I called the duty officer but his secretary claims he is busy with a missing persons case right now and to send him an email and he will reach back out. She said it will be a while before i hear back but if I dont hear back in 24 hours, then to call back. 
    I am going to send an email AND fill out the form you suggested too for the Emergency Passport. 
    I've had enough of this now and I am booking our flight home for next week. 
    They WILL give me his passport or an emergency passport as this has been almost 4 years of this back and forth.  I’ve found the congresswoman for dads city but nothing about a Case Work Organization form so I will be calling them as soon as they’re open! 
    DX Delivery is the courier service and they DO NOT answer phones. It’s impossible to get a hold of someone but I will definitely be paying for another tracking. The issue is that they cannot locate my old tracking as its expired so they will have nothing to link the new tracking to.

    eTA is electronic travel authorization required for UK citizens to fly to Canada.  

     

    You fly to Canada and enter the USA by land because the child is a U.S. citizen and the courts have ruled that CBP cannot force the child to present a U.S. passport to enter the U.S.   

     

    The long day in secondary inspection is CBP verifying the child is a U.S. citizen.  
     

    Your update indicated the situation was dire. So it seems time to take this extraordinary action.  
     

    I never suggested crossing the border illegally. You enter through a lawful CBP check pout that is open. Most are 24 hour operations IME.  Nothing “naughty” at all about 3 US citizens presenting themselves for inspection. 
     

    This move will jeopardize your son’s CRBA but it doesn’t seem like the embassy wants to issue it anyway. N-600 provides  certificate of citizenship which is just as good.

    i just feel like they’re looking at me as a criminal or something already being that so many people, including lawyers and legal aids, cant believe we are still in this predicament! I dont want to give them any reason to think im sneaky or anything. 
     

    it does seem as though they dont want to issue it. Is that even legal though? Why provide a list of things you need from me in order to get these documents but then reject and skip around the documents i give you. Ive provided EVERYTHING they’ve asked for and they can still say no? 
     

    thank you Mike. I will look into this Canadian option now. The hard part is getting there. Ive run out of money as this has taken so long. So i will have to go home first and get selling! Possibly have my mother bring my child to Canada for me as i wont have enough for 3 trips!! This is so draining and depressing!

    If the child has a UK passport, then both of you can fly to Canada (after getting Canadian eTA for the child).  The child’s father should drive into Canada to icon you up.  Then the three of you drift into the USA early in the morning and spend a long day in secondary, declaring the child to be a U.S. citizen.  
     

    Once in the USA, file for the child’s passport and passport card using secondary evidence based on the father’s physical presence.  Then once you have that, file for certificate of citizenship.

    not sure if we have the CRBA yet. I’ve contacted the embassy twice for updates and i’m just told to check the tracking number via automated response. The next issue is that the tracking number doesn’t even work. 
    i have no way of finding out the status ag this point unless i continuosly email them (which ive been doing and they just send the automated response to each email i send and stop responding after 3 emails. ) or calling them which sends you to an automated system or an extension that rings into nonexistence. 
    i feel defeated. 
     

    im sorry i dont understand any of the Canada stuff. I will look up what the Canadian eTA is and what ‘icon up’ means. I dont want to do anything to jeopardize my sons citizenship. Whilst i watch and interact with a lot of illegal migrants who are quietly living in the states, i dont want to be looking over my shoulder every minute wondering if my child will be taken for entering illegally. Filtering into the states early in the morning sounds like a naughty move lol. Please correct me if im wrong

    So quick update!

    we are still in England waiting on my childs passport. 
    April 22nd the requested documents were sent to the embassy. 
    may 15th rolls around and i decided to contact them again to get the status of the application. I was emailed back from London info unit who told me they could not give me a status as i am not the applicant and if i want status then the applicant will need to give consent. 
    i explained that the applicant is a minor and i am his mother (as stated in my initial email) so he could not give his consent. 
    then emailed me back and said ‘whoops, meant to say this is the wrong department, I’ll pass tour request on to the correct department ‘

    a few moments later i got an email from the embassy with an attached letter dated MAY 6TH addressed to me. They were requesting more documentation, a ds-3053 to be exact, for the issuance of the childs passport. So no longer did they want me to prove my residency. Thank god!! 
    firstly, i explained that this document is in the packet of requested documents submitted in April. Secondly, that a letter of such importance was left sitting instead of being sent to me… why? This letter had a time limit on it and if i hadn’t contacted them, i would never have known this is what they requested from me snd my application would have been denied due to insufficient evidence. 
    went through the process of getting the ds-3053 AGAIN (note, the ds-3053 already submitted was less than the required 3mnth age limit) and sent it in special delivery. 
    They state to wait 2 weeks before checking the status. So 3 weeks later i email for the status and get an automated response which says to check the tracking number for the return of documents. 
    my tracking provided by the embassy courier service is no longer valid as it has passed 90 days. I contact the couriers who confirm the tracking is outdated and no longer active. They advise me to contact the embassy ir the passport office. I contact both who tell me to check the tracking number instead of calling or emailing for updates. Now im in a circle of madness as nobody wants to answer the question i have - how will i receive my documents if the return service i paid for is no longer valid?... The couriers tell me to contact the embassy. The embassy tells me to contact the couriers. 
    i dont want this to be another case like before. If the passport and documents are ready but theres an issue with the delivery, i will gladly pay for another delivery service ir go pick ip the documents, but who do i speak to for that as both parties want me to speak to the other person! 

    Im about to lose my house back home, my child is missing out on school and his fathers input, i need to fly back to sell my car and belongings and arrange some kind of housing to come back to when we finally receive his passport but i have to fly back alone again. It breaks my heart to leave him here in London again as he begs me and cries to go home.

    is there some kind of emergency visa i can get him to bring him home with me so i dont have to leave him? Hes never overstayed on his previous visa so that should go in our favor right? 

    Or should i just give up now. The email responses are automated and the phone is never answered. What do i do?

    also, haven’t heard a THING from my lawyer either! I emailed to let them know the documents were signed for and we are waiting now but ZERO response. Think they’re done at this point. They keep expressing they’ve never had a case like mine before. Whilst they deal with many crba’s, the outcomes of mine have been shockingly rare.

I am surprised you did not send your attorney that very information and ask him WHY he has held back from submitting the fathers forms….and am curious what his response is. 
    @jan22 even addressed the steps the step needed to dispel any questions about your own citizenship..and waiting on entry/exit is counter productive since your experience crossing is a bit of a mystery from day 1. 
    I think it’s important to trust and have support from your legal rep, so hopefully you bring him up to speed

    my attorney still hasnt responded and has read the message i sent YESTERDAY! 
    initially we held off on the fathers forms as we needed to reregister the birth with the father on the birth cert. we waited quite a while for that so he included the forms but no birth cert with the last application but also quoted the confirmation and case number of the new birth cert so they could access it online instead of having it physically (as it wasnt ready yet).

    even that was a big palaver as the registry office lost my origibal documents and passe me around for 3 weeks to different departments pretending i hadnt sent anything!

    Those were already provided. They said it doesn’t prove that it was actually me in the store or at the atm, even though they asked for that initially as proof of physical evidence. I also provided atm receipts.

    It’s ok if you don’t know ur A#, just put in  UNK and give them your US  passport number and as much details as you can. Ask for your COMPLETE FILE ..

    @Depressed M I am curious though if this was a late registration of birth.  That was where I was going with my question.  

    They haven't asked for him to do a dna test as of yet but thats no issue to do.

    So piecing this together, I speculate that when she entered on her immigration visa the first time, her visa was not stamped by CBP by accident and there was no follow up with deferred inspection. She might never have been issued a green  card because CBP didn’t log in as a green card and/or because she didn’t pay the green card fee because she was going to be a citizen automatically upon proper endorsement.  
     

    Then she left the USA. With no USA passport.  Her immigration visa was expired. When she wanted to return to the USA, she applied for a USA passport. The embassy realized the mistake, and so she was issued a returning resident visa and a sealed USA passport. The plan the embassy had was to have CBP at passport control stamp the returning resident visa (thus making her a USA citizen) and then CBP in customs open the customs packet, read a note from the embassy that explained what was going on, and then CBP in customs was to hand her the sealed passport. 
     

     I don’t know what happened at the passport booth in the mind of the CBP officer.   Perhaps there was a problem with dates on the returning resident visa.  Perhaps she was gone for less than a year and the CBP officer was going by the book and wasn’t going to admit her on that basis since that visa (aka SB-1) is only for absences of 1 or more years.  The officer instead wanted a Lincoln boarding foil and maybe made noises about sending her back to the UK to get one.  
     

    Anyway, my guess is no one at POE was listening to her, she ripped the packet open in frustration,  a USA passport falls out, and CBP is stunned. Then CBP figures out what State’s plan was while she is waiting in secondary inspection, and screams at her for producing  a USA passport before they anointed her USA citizenship by stamping her returning resident visa and then formally unsealing the packet.  
     

    Regardless in the end, they sorted  it, and she was logged as entered the USA on her USA passport.  And the visa obviously wasn’t stamped because she produced the USA passport before the visa was stamped (CBP don’t stamp a visa of a USA citizen). This is causing consternation at the embassy again and distracting it from the CRBA.  
     

    Anyway that’s the best explanation I can think of.  
     

    I agree that this should be pursued  by the father of the child and I will post a comment in reply to OP on that next.

    definitely some insight into what may have been going on from the embassy’s side. 
    i felt as though i was the puppet in the middle because i was just doing as i was told until i got scared and opened that envelope! 
    my father told me i was issued a green card. Whether I actually was i am not sure of unless i ask him as he would have those documents. I just remember him calling me after school and telling me ive been given a green card so to come over and be issued my social security card. Whilst there we went to take passport photos and sent that passport application off whilst still in the US. I went back to UK as i was told the US embassy in london would be issuing my American passport. I dont know if thats how its supposed to go but thats how it went. 
    when i went to pick up the passport i was taken into a private room and told that it was sealed in this envelope and not to open it. I was given paperwork and told to use this as my entry document. I never received a returning resident visa as there isnt one present in my UK passport. Once i arrived and was told the documents were not sufficient i got scared. I explained word for word what i was told at the embassy which is when the second officer approached. i didnt know what was going on and i told the officer the passport was in the envelope. He told me i need to produce it to go through. Thats when i ripped it open. Like you said nobody was listening to me at all. He handed it over and i was escorted to immigration. I wasnt searched or questioned i was just told to sit and wait.

    Believe me! The headache is shared lol. I am very grateful for them though. I filled the forms out with my mother initially and had my embassy friend look over them and she shook her head and told me to get a lawyer lol. I would have effed it right up! 
    whats crazy is that my mother and i both worked in immigration for the UKBA so we thought we knew our sh!? But the bloody laws change weekly so it was hard to keep up 😩🤦‍♀️

    Thank you. We have explored this option too. My dad was on board at first but he’s very fickle with me. I have asked him again and he says he will help if it all fails first. 🤦‍♀️

    Application is now by USC from father , here’s proof of 5years for father . 
     

    My lawyer definitely sent a stern letter involving the congressman with the last packet. Im not sure how much effect it had as im being asked for these last two pieces of evidence. I was advised my my friend in the embassy to have the congressman write a letter to the consulate if im not issued my childs passport after submitting this evidence. Shes worked in the embassy for over 30 years and said they may be looking at me as a child trafficker of my child too. 
    i wish i was more savvy with this as i feel like im just the idiot in the middle. 
    I have my childs father doing it from his side but advised by the lawyer to wait until i submit this evidence before he files the application from his end. What do you think? Put the application in motion whilst mine is in motion too?

Your child was born in 2018 and it sounds like you have been going at this alone , without the USC father filing with you and acknowledging paternity ( doing DNA per consulate instr and signing up for child support) …this is what they tried to tell you when they said father not being considered. They know he is on B/C but is MIA in the CBRA for ur child. He can be added , and you will have an easier time gathering proof.

    Assuming app for your child is “ Child born out of wedlock to USC mother “ you will see they are asking You to show 5 years TOTAL in the US ( 3 years can be before you turned 14 and only 2 years after you turned 14…) before 2018 ( baby is born) …they are NOT asking for 2013 to 2018 specifically. 
     

    5. Figure out what age you came to US ( 2006) how long you stayed in US each time and ask your parents for help. More than likely they claimed you as dependent on their taxes and if you did not work in the US , maybe they sent you money to pay rent, beauty school tuition or even co signed for student loan at that time…if you have cosmetology license , contact the State Board for records. 
     

    6. Focus on WHERE you were living , you paid rent , had driver’s license, had us bank accounts, maybe established credit ( pull credit report copy). If you ever worked in the US , then Social Security Earnings Report would show the years, 

     

    7. Sworn Affidavits from parents, friends, old neighbors, old jobs..

     

    8. Not sure why ur attorney said they are giving u a hard time..but they are not. It’s just a bit complex but glad you posted hope you get many responses! 
     

    9. Also hope the father of child steps in , but no matter what if you spent the time here then you can do this alone too.

    2. I wasn’t a CRBA case. I wont have a crba record of my own. (Not sure if thats what you meant)

     

    3. father is fully involved and has had his paperwork and all accompanying documents. My lawyer prepared his paperwork and I flew back to have it all notorized with him. The consulate haven’t asked for DNA and child support as he already supports and has acknowledged paternity. All supporting docs to show this will be resubmitted too. 
     

    4. my five years total would be from 2013-2018 as that is when I entered the United States permanently. I had to finish school and college in UK before moving to the US as part of my fathers request. I was traveling back and forth before 2013 when i could. And permanently moved 2 weeks after I finished college lol! This is why it’s difficult for me to gather the evidence from 2013. A week after my arrival I got my state ID and did my driving test. Got my license and got a job! I provided the w2 and paystubs for that but was told its not enough proof. I need to show that i was passport stamped into the US. 
     

    5. My cosmetology license was submitted in the last packet. Along with letter from the director of the school stating transcripts in the spa are not kept for that long. Its a spa. We did a month theory and the rest practical. Took a paper register in the morning. It was quite informal if im honest. I still speak with a tutor who says she can write me a reference. 
     

    6. i provided leases if where i lived, rep said thats not physical proof as i could have rented the place and left america. I asked if he though i was rich enough to do that. A student with a job just rents an apartment and then leaves the country. For what? 
    i provided bank statements, he said that its somewhat proof as the atm transactions show i was physically present at the atm but doesn’t prove that it was ACTUALLY me withdrawing the money. If i had the physical receipt, that would have been proof. From 2013 😒

     

    7. Sworn affidavits from my massage clients and a coworker from a job i was at for 3 years were included. Rep said i still could have left the country. He didn’t deny the proof he just said i could have still left the country. He is asking for 5 consecutive years. Im giving what i have and 2013 my first year in the US is where he is focused. I cant even access the email address i had back then! 😩

     

    thank you so much for responding!! We are not alone. Daddy is in this with us lol. This is why its so confusing to my lawyer that im being denied based in my information even though daddy’s information is there too.
