  1. Why is it that the "K-3 Spouse Visa Process & Procedures" seems to be a sub-forum of this one but I don't see where you can click into it, like a stickied thread or something. In fact I am not exactly sure how I stumbled upon it but I am glad I did.
  2. So I saw this in the instructions of the I-129f. "NOTE: You do not need to file Form I-130 on behalf of the child of a K-3 beneficiary in order for the child to obtain a K-4 visa. However, a K-4 nonimmigrant is only eligible to adjust to lawful permanent resident status if he or she is under 18 years of age when you and the K-3 parent marry and you file Form I-130 petition on the K-4’s behalf before the K-4 reaches 21 years of age." Do I still need to file an I-130 for the child as well or is there some loophole here where I can get my wife's 16 year old son to come on a K4 along with her? If I read this right I can file the 130 after he arrives. Is there anything special I need to file for this? If this is the case can we delay his entry for a bit before we bring him here?
  3. Correct me if I am wrong but there is a lot more to provide than just those 2 things. Page 10 of the instructions under "What evidence to submit" goes over numerous things you need to send. Evidence of US Citizenship, Termination of previous marriages, passport photos, and so on.

  5. It won't allow me to put in anything but a date... Can't put in present or NA. I could write it in after I print them.
  6. Also... I am a US Citizen by birth so do I just check No for "Have you obtained a Certificate of Naturalization or a Certificate of Citizenship in your own name?"
  7. So I put in my current employer and the date I started but I can't put in NA or Present in the end date. Do I simply leave it blank or give them a date way off in the future like 12/31/2042? Also it seems to let you do different things when you pull it up on different browsers or in Adobe itself. Is there a better program to fill it out typed than Adobe? Anyone else run into these issues?
  8. The only thing I have on my USCIS page is that my case was received on 9/29/22. There isn't a document in the document tab, just my uploads. A copy of that page is good enough?
  9. @Simplytex OK so I only skimmed it but it seems like you are processing the same thing you did on the I-130 except for this time I would be sending everything through the mail. There isn't a fee, you just follow the VJ guide to putting it together and make sure you triple-check everything. I do however have to wait until I get the paper NOA1 from USCIS before I can send this all because that has to go with it correct? Does that kind of sum it up?
  10. So how do you know if it is even worth trying? I just filed the I-130 but I am trying to find any way to get her here faster. I have seen many posts about them not approving them anymore and just closing them as admin whatever. If this is supposed to be a way to get your spouse here quickly to shorten the physical time away then why are they closing them all? Like a K1 visa, they have to apply to be able to work as well correct? I get so frustrated with this whole immigration process. When I see people just flooding across our borders and being allowed to stay while their court-appointed lawyer helps them file for asylum at no cost to them and then they just wait here for their court date where many of them just get approved. This all just feels like punishment to do it the right way.
  11. I am no longer self-employed but work for a transportation department of a large company driving trucks and moving trailers around our facility. If they look at my current income then I won't worry about my past income although I will provide it as they ask. Thanks again for your wisdom.
  12. I see in the instruction that I can send a letter from my employer about my salary or 6 months of pay stubs for this year if needed. I believe the instruction says they use total income from the transcripts. Last year I made just barely over the poverty level with total income but I did not come close in 2019-2020. The last 3 years were 24k, 17k, and 5k(business deductions) The instructions are unclear to me as to whether they go off the current year or all 3 years as a whole for determination. It talks about 1 year and then makes it sound like I can add the other 2 years but I know that they want the information on the last 3. So my question still stands about needing a co-sponsor. How are they going to look at my income to make the determination?
  13. Currently, I make more than enough to qualify for my AOS and I probably will be including the 2022 transcript in my package by the time I am approved. My 2019 transcript doesn't show a large amount of AGI but does show a large income due to having my own business that year. My 2020-2021 tax transcript does not show a lot of money made due to the pandemic and other issues (I was out of work from March 2020 to September 2021). I had an unemployment income but it wasn't enough to be over the poverty level in either 2020 or 2021. 1. What number do they go off on the transcript for income qualification? 2. If I had a couple of bad years as I did (which is due to the pandemic), will I get disqualified and need a co-sponsor even though I make twice the amount now? 3. If I get approved prior to my taxes being done for 2022 how do I show them I have a large enough income so I don't need a co-sponsor, pay stubs? Thanks for the help
  14. I spoke with the consulate a few days ago and they claimed 4-6 weeks to process. I didn't realize there was a lagtime between them processing it and PSA showing it in their system.
  15. If you want to change her name on her Philippine passport you will need to register the marriage with the PSA. This video goes over the requirements but they are for the Utah marriage so you will need to adjust where you are sending it.   18. She has her COVID shots and a booster so we are good there. Thank you all for help on this one. One less thing I need to think about.
  19. @hunny&me So if she shows up with no records of vaccinations will they do this Titer Test to confirm what she has or hasn't gotten or just administer the MMR, TDap and whatever else a 35 year old needs to have? Should we get a Titer test?
  20. Do they send an email for the NOA1 or am I going to get a letter from them? When I login to my account the status says they "sent you a receipt notice or acceptance notice" but I didn't get an email other than the receipt for my payment. It also states 10 months is the estimated processing time with the note it could be shorter or longer.

  22. Reading through --> USCIS Immigration Vaccination Requirements it lists 8 different vaccines, but when you look at the I-693 it has more on there. If I go to https://www.cdc.gov/vaccines/ link from the same instructions and answer the questions I just get MMR, TDap and the flu vaccines are needed. I know she has to have documentation to show she got certain vaccines but what are all the vaccines that my wife will need before she is allowed to come here on her visa once we get it? I would like to get this taken care of now and make sure she is all set so we don't have to worry about it later. So who do I follow? The requirements page here, the I-693, or the CDC?
