    but the 485 she applied was after Vawa approval.  she did pre order instructions part from uscis , she didn't not filed for adjustment with court, instead she terminated it.  In the pre order instructions it was a copy sent to Texas service center as we submit original to judge.  she got an appointment with uscis, lets wait for her reply.

    So a lot more money spent on attorney and depending on courts docket..delay between each hearing. 
     

    Taking termination/dismissal order from IJ, means you get USCIS to reopen the previously filed I-485 ( if you had one w spouse and I-130 ..and USCIS switches I-130 to I-360)…all you need is to gently poke them to “ call” file and send it to Field Office 

     

    Just a thought. I lean towards take the Termination and RUN 

    It all depends on judge and a good lawyer. I see someone who did Motion to advance and adjust status with court  without MHC nor IH. Ice will accept based on approved i-130 or i-360 unless you have any criminal background.   Lets wait for God is a good god interview.   if the officer can adjust based on his termination or  if he asks to file again or he may take the updated i-485 and continue with processing time based on her field office.

    Congratulations.  Its not a glitch,  they took the priority of your i-130 petition.

    This is what they mentioned on my I 360 approval that I will be notified separately on my pending i485. Should I send another i485? I am afraid it will be returned as they can see another one pending already

    it will if u have applied vawa and 485 together.

    have you filed 485 before termination?? because  I know people who filed before termination , they have tried to update the uscis with termination letter but no use.  some people filed again.

    Thank you for your clarification. I just checked my lawyer email. She sent the original to court with supporting documentation and a copy to uscis texas before proceedings were terminated.     Yes still u need to  file if judge terminated ur case . if judge granted your adjustment then you follow post order instructions. You can google for pre order instructions and post order instructions.

    some folks told me I need to make an info pass , take the termination letter and i485 receipt to them and they’ll be able to pull up my application and schedule me for interview later?

    folks may be wrong, plz cross check with govt websites.

    you should file original i-485 to VSC after your termination, not to Texas service center(which you sent was a copy).  please read pre order instructions clearly. It says send original 485 to court and one copy to uscis Texas and one copy to ice to adjust status in court when your  in removal proceedings.

     

    If your case is terminated, that  means the jurisdiction is with uscis. you should file original application with VSC.

    My i360 got approved march 2022. My immigration proceedings terminated April 2022. My i485 was filed I court and a copy filed to USCIS irving Texas. Now I don’t know how my i485 will be transferred. My lawyer sent letter to uscis with the approval letter i360, a receipt of payment of i485 and a copy of i485 application and a letter of termination of proceedings to uscis since may 2022 but until now no response.     I think you messed up. 

    1.) If your case is terminated after Vawa approved and before 485 filing , then u have to file 485 with uscis with original application and supporting documents. 

    2.)  If your case is still pending with court.  Just follow the preorder instructions eoir and post order instructions from uscis.

    3.) if u already filed 485 copy with Texas before termination, you need to file 485 again with VSC.

    Here’s what I did:

    1. Sent a personal letter to USCIS for an update

    2. Contacted my congressman for support

    3. Sent a copy of my police report (good moral character). They didn’t ask for another copy but I needed someone to review my case. 
    4. Sent another letter which I stated that I’m ‘wondering if I missed any correspondence because I was working in another state temporarily’. lol …. sshhh! 🤐 

    5. Submitted out of normal processing request. 
    6. They’ll send you a letter refusing to provide any update and ask you to mail USCIS instead. I made a copy of that letter and attached a written letter pleading for an update. I received a status update in 2 days with approval  😂😂

     

    I can send you a draft of the letter for help. (With my info blurred of course). Good luck!! 
     

    I didn’t take these actions at once. Some in parallel and others giving months in between.

     I'm august 2019 filler. I'm waiting from august 2021, still the same correspondence was received and uscis is reviewing it.
