  1. Hey guys, 

    I was just wondering if anyone can share his/her experince for the Naturalization process and n400 interview with the following condition :

     

    1- Prevouis deporation due to losing Asylm case and unlawful present. 

    2- Coming back with approved Immigrant throughUS citizien parent Visa after 212 & 601 waivers approval, and get a 10 year GC.

     

    I have my chance to apply for N-400 in sooner time and would like to know how the Naturalization process goes in this case.

There's definitely bias towards certain applicants. Worst case - you can sue USCIS for decision after interview if no decision is given in 120 days.

    @OldUser I have a quick two concerns please:  In my N-400 interview , next year, as I will complete 5 years;   1- I had an asylm case before which got denied and I got deported and I came back with approval 212 & 601 and GC through my US citizen mom, the first question is : will I be asked about my closed asylm case , which I did not get my GC through , and will that effect any on the N-400 Approval? 

     

    2- I got married in mid 2004 and We got divorced in Jan 2005, we did not file any I-130 and after getting my FIOA record, I did not see any I-130 from my prevouis marrige, my question here: will i be asked abotu may prevouis marrige and will that effect my N-400 approval?

     

    All those concerns and negative thoughts, due my filing will be next year.

  3. Thank you Old User, Thanks GOD i have no crime history and when i was applaying for my GC in UAE, i had to submit police certification from my country and UAE and both were clear. So I was asking all of that as i take the naturalization process so serouisly and i know they are doing deep background check, i even was under Administration Process in UAE US Embassy and i passed and they approve my IV.

  4. Thank you Old SUer, I have two questions please

     

     

    1- I came back to the US with Green Card through my mom but had to file for 601 & 212 waivers for over stay my visa and they approved both of them that why i was able to come back. Will that help me for smoother US citizhipe process?

     

    2-  I have a police clearence certfication from my orginial country and the country i used to live before coming here which is UAE. Also will that will helo me showing good background check?  

     

    As today i never travel outside the US and i pay my yearly taxes.

    Congratulation Yehia, I had the same issue , my middle name is my father and my grand father, and my grandfather name is too long so they only type half of it. as you mentioned the 18 letters only limit. However, you should see on the back of your card , your name must be full correct. if so , you have no issue.

    make an info pass also to be able to go the local USCIS office and see what is the problem. Is it still stuck in Immigrant Visa Payment Received ?

    Try to call them and make an info pass and service request.  Do you have your VISA PACKET with you ?  if so , you need to call them right away and ask if you need to submit it in nearest POE to CBP to get your green card produced.  this what happened to me.

    So, the problem indeed was with missing IV packet! Yesterday morning I got a letter from the USCIS in my mailbox. They wrote me that they haven't received my IV packet and I need to schedule an appointment to the nearest USCIS Field Office.
    After that I reached out to representative and asked for an appointment to submit IV visa packet. He added me to the 'regular' appointment queue...
    In this queue now I need to wait until another USCIS representative(maybe from my local Field USCIS office) call me on the phone with further information about appointment. The representative must call me... within 30 days. 
    As a summary, I'm on 141 day now, and I don't know how soon they will call me and finally schedule this appointment for me... I hope not later than April...
    Well, I guess my case will be the longest one when I will receive GC 😅

    Good news. Now you will be on the right track, i think you will get your GC, in about one month from submitting your IV packet , same as what happen with me. but you seems in the right path.

    that is a good idea. but in my case when i went to the USCIS office, they gave me a referral sheet with USCIS logo on it to request service from the CBP, which made it more easier for them to accept it.

    Did someone managed to reach for some live representative by that number??

    When you call you should say : INFOPASS" then it will transfer you to real agent.

    The officer opened the package and checked all that, and then after checking he returned the package to me. There are not only medical report copy, there are also other copies of all documents and also my photos!!... I still wonder why he did not collect all of that at airport? Now I think this is the problem of the delay! But the response of the USCIS after request is only 'We need additional time before replying to you with information about your case, please wait 90 more days since that response"... Very strange! If they don't have the IV package they could have told me about that during this 140 days! They just answered on my request without any information :( very dissapointing..

    I recommend to call USCIS and ask them to make for you Info pass in the most closer USCIS field office and they will tell you what is the problem. I did that and they told me your IV visa packet that i had must be  submitting to closer POE.  My case is old and an IV packet was issued and because the officer did not take my IV packet, my card production was delayed for months

    This what happened to me. And my GC was not producing and sent to me until I submit my IV packet.  It could be only required for certain IV types or if a IV packet physically has been issued,  the packet must be submitted. This what happened to me. It might be different to others.

    After reading your comment now I think that maybe the delay because of Immigrant Visa Packet??? At the airport the officer opened it, checked it and then just returned it to me! He did not keep the packet... just said that everything ok... So I still have this packet with me... Do I need to to give this packet to USCIS??? 

    As what happened to me and what the USCIS officer told me.  That I won’t never get my GC if I have my IV packet with me. Its not belong to me and must to be handover to CBP at the airport to stamp it on the visa summary page and to be processed to USCIS through them. This is the correct path to issue the GC. One month later i got my GC. I think you need to request an info pass and see what is the wrong

When I went to the local USCIS With infopass, The officer told me that your IV packet must be submitted as its not belong to you. it has to be submitted to the airport and the CBP will stamp it and send to the USCIS. if anyone has the IV packet, he/she must contact USCIS if he did not get his GC yet to make sure that missing on the IV packet is not effecting the card production. my card delayed for months because that. 

  15. I’m sharing my experience from the POE until the receiving my GC so anyone is passing with what I had to get benefit from my experience.

    My time line was as following:

     

    POE: JFK September 2021.  (My Immigrant Visa Packet was not taking by the CBP officer as I was told all my information is in the system ). YOU MUST SUBMIT YOUR IV PACKET IN ORDER TO GET YOUR GC PRODUCED

     

    Card On hold as IV packet was missing, not in the file: January 24, 2022. USCIS sent a letter to me for that.  

     

    Submitting my IV packet to Detroit Airport as the closest POE to the CBP office: Feb 23, 2022.

     

    Visa Packet Uploaded on my file: March 09, 2022.

     

    Card Is Begin Produced:  March 14, 2022.

     

    Card Is Mailed Out:  March 18, 2022

    Card Is Picked up by USPS: March 18, 2022

    Card Arrived: March 21, 2022.

     

    1-      Please make sure to contact the USCIS all the time, if you did not receive your card after passed of 90 days and have an info pass to check on your file if you sees any delays.

    2-      IV packet must be submit to the CBP AFTER  going to the local USCIS office and they may give you A Referral Sheet to submit it to the CBP OFFICE  with the IV visa packet. (This what happened to me).  CBP officer were so much understanding and helpful.

    3-      Have a USCIS account to get updates on your case.  

    4-      Have a USPS Informed Delivery account to get updates on the delivery of your Card and all your mail.

Basically they just took a picture of my father and welcomed him!! I really don’t know the reason for delay for printing the plastic green card… maybe they are working half staff because of corona?!!!let me know what you think please 

    Please keep calling them(USCIS). As i have the same situation. I had my visa packet with me in POE. And I want it to had over but they said no need as all information in the system. I found out later that i must submit the visa packet in order for my card to be produced. Im still waiting for appointment from them to submit the visa packet in the local USCIS office. If you do have the visa packet then you might require to submit it.
