    Got an interview notice. That's annoying, I thought that getting an RFE for medicals means it was waived. Oh well.

    God is good. I contacted my congressman yesterday morning and boom this morning they sent the details of my interview also they promise to send the letter to the right address as soon as possible.  Thank you all for your help, without God and vawa family I dont know what might have become of me. You all should remember me in prayer the interview will be on my birthday , I was surprise. Thank you all.

    yes i have contacted them. I was in same situation once when i did not receive my receipt notices. They were able to get those for me. Just contact them and give them your A#.

    i was in same situation as you. Once i sent the renewal package i did not get the anything from USCIS. Hence, i contacted my congress person to get me the receipt.

    You can write to Vermont but i think that would not make any difference. I have wrote them few times in the past which was waste of time. Just contact your congress person next month. You should be fine.

    Just give it 2 more weeks. Right now USCIS is taking 4 to 6 weeks to send the receipts. If you do not get it by the end of this month then reach out to your congress person. I would not send another renewal package. Back in 2021 my congress person helped me to get the receipt notices from USCIS after i waited 60 days. 
    When did USCIS received your package? Did you send it on Jan 31st or did they receive on Jan 31? In either case it is very early to panic about the receipts.

    Just say info pass, many times and they will aswer, i just did an info past last december for my inlaw and she got the appoinment for this past thrusday.

    If you are not in removal proceedings and you never applied for asylum then you will be fine traveling abroad .

    They only RFE if they need missing documents or a further explanation on a certain info. There’s no set time to when they send an RFE, sometimes even after the listed processing time has passed. And sometimes they don’t send any RFE. I never got an RFE from them

    I honestly sent all the evidence I didn’t wanna wait for RFE because I didn’t want any further delays. But in your case, it will depends on the reviewing officer if he finds the evidence you submitted enough or not. 
     
    i don’t know about the dui and traveling, I don’t know if it will affect your travel at this point but hopefully other members can help with this info. You should also consult your attorney

    Ran into my ex over the weekend at a social event for the first time in 2-3 years. I know he has no idea how I have been because my family and friends have been a protective vault with regards to me and my wellbeing. Judging from his reaction, I gather he expected me to die of misery following our awful marriage and even worse separation/ongoing divorce. But I didn't - in that time I have lost all the weight i gained in my suffering, graduated, and now work as a physician at a fantastic hospital, moved into a cute little condo, and just overall living my best life. Finally. He said hello, I responded cordially and i think we both realized at the same time that I am now blissfully indifferent. I always thought I would hate him or be resentful but turns out I just really don't care anymore. Guess who now wants to go to therapy and do everything to work this out? Hahaha. Never again.
     
    This process is long, draining, and still ongoing for me but i am grateful it has helped me find myself again even though that felt impossible at some point just a year or two ago. We just all need to hang on a bit longer, this story will have a happy ending for us.

    My journey has finally come to an end. Want to say thank you to Sandra and many others who helped me years ago when i started my vawa journey & Want to share my VAWA N400 process. 
     
    application Sent to uscis - sept 27 2022 Priority date - sept 29th 2022 Fee processed - oct 5 2022 Notice for biometrics received - Oct 17th 2022 Biometrics - Oct 25th 2022 Interview scheduled- Oct 26th 2022 Interview - 29th November 2022 Oath ceremony- 11th January 2023 (didn’t make it) Oath ceremony rescheduled & held - February 25, 2023 officially a US citizen. 
      feel free to ask me any questions you may have. Below is my vawa journey for those who want to know. My vawa was approved in 4.5 months. 
     
     
    Jan 23 2017- filed I-360 Jan 24th - I-360 received at VSC  Feb 14th - received receipt notice for i360 Feb 21- prima facie issued March 02 - received prima facie for i360 in mail  March 20 - i485 transferred to new office, Vermont  March 31- sent out additional correspondence/evidence for i360 with blue sheet attached to prima facie  April 3rd - additional correspondence delivered  April 5th - additional correspondence received and under review by VAWA unit  April 12th - EAD and AP applications transferred to Vermont  May 23rd - EAD approved and card is being produced  May 24th - VAWA approved  May 26th - EAD/AP card received  June 6th - vawa notice date  June 15th- transfer to NBC Jan 19th 2018 - interview scheduled for feb 28th Feb 28th 2018 - interview  Aug 2019 - RFE & Response Sept 24th 2019 - approved and green card production ordered  Sept 29th 2019 - greencard recieved   
    Had my green card for 3 years and applied for citizenship

    Looks like you or your attorney did not send enough documents initially to meet the requirements. Gather what documents you have for now, so it’s easier how to go about what’s not available. Anything that’s not available can be explained in an affidavit. For proof of residence with your spouse, even if you stayed together for 24hrs in your shared residence (not visiting each other) meets the requirement. For good faith marriage, they want to know you did not marry for immigration benefits. So your personal affidavit, alongside statements from friends, family etc can attest to your good faith marriage. For abuse, statements from witnesses and your police report or medical report, or psychological evaluation concerning the abuse will suffice. The good news is that..a detailed attestation of your journey with your abuser might be able to explain the absence of some evidence.. I personally used a personal statement to respond to my RFEs alongside few evidence I could lay my hands on. Everyone’s situation is different and as such these i360’s are adjudicated on a case by case basis. This means that your evidence can vary from the next person and sometimes you might scale through with very limited proof where others will be required to present more facts. I hope this helps.🙂

    Thank you, my friend. I appreciate you, and your advise. And there's no way I'm getting into a situation like this again. 
     
    I have letters from my professors, employees, and friends. I'm now thinking of volunteering at different organizations and then get letter from them. 
     
    If anyone has anything more to add, please do, it would be greatly helpful. These interactions are godsend for all of us on this journey and in this group. Thanks

    Glad you are an attorney as you should be familiar with these processes to an extent. Being completely honest as you have demonstrated helps..also if it’s your first time according to what I read somewhere, it’s usually not as bad as a frequent occurrence. Here’s what I found and hope it helps.🙂
     
     
     
    Driving under the influence (DUI) of alcohol is a serious crime. If you have a DUI on your record, you may be wondering how it will affect your green card application and whether you will be approved for your green card.
    Drunk driving, by itself, is usually not grounds to deny an applicant a green card.  However, in certain circumstances, drunk driving can result in inadmissibility on health-related or criminal-related grounds. 
    Will A DUI Disqualify You on Health-related Grounds?
    When considering whether your DUI will disqualify you on health-related grounds, it is important to note that the United States Citizenship and Immigration Services (“USCIS”)treats alcoholism and alcohol use disorders (abuse or dependence) as a physical or mental disorder. Applicants with a physical or mental disorder will only be inadmissible if they exhibit harmful behavior associated with their disorder that has posed or is likely to pose a threat to the property, safety, or welfare of the alien or others.
    During your green card application process, you will be medically evaluated for disorders, including alcoholism, and any associated harmful behavior. Driving a vehicle while under the influence of alcohol does qualify as an associated harmful behavior. Therefore, if you are evaluated and found to be an alcoholic or have an alcohol use disorder, the DUI in conjunction with the disorder may amount to a health-related ground for inadmissibility.
    Medical Evaluations During Green Card Application Process
    If you fail to report alcohol-related driving incidents during your medical evaluation, the incident will likely be revealed in your criminal record anyway. In such a case, an immigration officer may require a re-examination if you have a significant criminal record of alcohol-related driving incidents, including:
    One or more arrests or convictions for alcohol-related driving incidents while your driver’s license was suspended, revoked, or restricted at the time of the arrest due to a previous alcohol-related driving incident. One or more arrests or convictions for alcohol-related driving incidents where personal injury or death resulted from the incident. One or more convictions for alcohol-related driving incidents where the conviction was a felony in the jurisdiction in which it occurred or where a sentence of incarceration was actually imposed. One arrest or conviction for alcohol-related driving incidents within the preceding five years. Two or more arrests/convictions for alcohol-related driving incidents within the preceding ten years. After the re-examination, the immigration officer may find you inadmissible on health-related grounds.
    Criminal-Related Grounds For Inadmissibility 
    The second way a DUI may affect your green card application is based on criminal-related grounds for inadmissibility. If the DUI is categorized as a crime involving moral turpitude, you will be deemed inadmissible. A crime involving moral turpitude (“CIMT”) generally involves conduct that violates accepted moral standards. Driving under the influence, by itself is not a CIMT, nor will multiple convictions of driving under the influence amount to a CIMT. 
    However, the Board of Immigration Appeals (“BIA”) has found DUIs to be crimes involving moral turpitude when the DUI was coupled with knowingly driving on a suspended or revoked license. The BIA has ruled that a person who drives while under the influence and knowing that he or she is prohibited from driving, commits a crime that is contrary to accepted moral standards. Thus, the element that transforms a DUI into a CIMT is the offender’s knowledge that he does not have the privilege to drive. It is the deliberate and knowing disregard for the law that brings the offender’s conduct outside the confines of accepted moral standards and subjects the applicant to criminal-related grounds of inadmissibility.

    Aside it being your first time which like I mentioned before makes it a lot less than frequent occurrence, you should be able to write about it in your personal affidavit, reiterating that it’s a one time thing and all of that good stuff…also get family, friends, neighbors and colleagues to write of your good moral character. We all make mistakes and even the adjudicating officer should know that. On your part, try not to be in any such situation again. It is true that you need to maintain GMC to meet one of the several requirements for i360, but you have to take your chances. Being honest is a demonstration of GMC…believe the best, stay positive.😊

    Make the infopass. Do the medical and take it with you. 
    I know couple of people. They went to infopass and hand in their medical then within few days they got approved.

    Used AP to enter the country today at Chicago o'hare airport. Using advance parole was very easy. I gave the card and passport to first officer and within two minutes after taking my picture and fingerprint scan, called another officer to escort me to secondary inspection. I hardly waited for 10 minutes there, for them to verify my information on their system. Finally the officer called my name and verified my face with photo in my passport and said I am good to go. Overall very good exp using advance parole.

    Won't be a factor. This is what would normally be considered a simple DUI and it trips none of the criminal bars. Own up to it when asked by immigration and you'll be fine.

    I had several clients with DUI ,and they got their GC, one of them had 3 DUIs.

    Hi Sandranj,
    I got my vawa approved last month & I had applied I485 concurrently with it which says initial review on it.
    I have a first dui probation pending for little over an year , but vsc knew about it .How will it affect my aos
    interview.I had this mistake done in my depressed times.Now I have abstained from alcohol altogether.
    Please let me know any sincere guidance on this.

    Booboo, No big deal. Things happen, you ddnt kill someone as a result and you learned your lesson. I had am altercation with a lady who slept in my house, she told the police i harassed her ( even though she had slept in my house with my husband, we had been separated, he broke in when i was out of town) Anywho , we went to court, i pled guilty because i did call her many times. I got VAWA approved with it AOS is pending and I am not worried one bit.GOD IS FAITHFUL.. DONT WORRY BOOBOO, GOD GOT THIS IN THE NAME OF JESUS. GREEN CARD IS YOUR S WITH YOUR NAME ON IT , AMEN!!!

    Hi,
     
    I’ve had a pretty tough bona-fide RFE, so I can chime in on that part.
     
    What can help is writing a new affidavit that covers your relationship story from the beginning to end by adding more details. Be as descriptive as possible but stay to the point. You can also ask your friends to write affidavits if they have witnessed your relationship. The affidavits must prove that you got married because you loved your spouse and wanted to spend the rest of your lives together.
     
    write a separate document explaining 1 by 1 why you don’t have some things that they are asking you for. “We did not have a joint lease because .. We did not have a bank account together because.. xyz “ If you can explain it here, you can explain it to USCIS

    Filing my motion to recalendar and change venue tomorrow when the post office opens. If I have to file my I-485 with the court then so be it. I'm sick and tired of waiting on either ICE to respond to me or AG Garland to come back from the dead.
