Y Habibitk FOR PRESIDENT!!!!!!!!!! LOL......
10/14/08As history has shown many times b/f, there is power in numbers. Those of us who are waiting and getting no news from the VSC can cry every day and do nothing or take positive action. Wouldn't it be good to draft a letter with blanks for name, address, receipt number, etc, and several of us who are being impacted now can print, sign, and mail it to at least 4 Congressmen who sit on that committee. Of course, each of us will have to send it to our own reps, too. When the committee of 4 or 5 sends an inquiry, they will repsond, I belive. If anyone else is interested, I can draft the letter by this Fri. Just let me know what you think.--Amor1
If i were the Congressman i will pass a BILL to require every state to have a Service Center so the processing may only take shorter time rather than just VSC & CSC. How about that?
On Oct 19 our case is already 8 mos old and still pending.
I would get a commitee together, have a few consultants to evaluate their processes and give them a 30 day timeline to get their sh*t together. 1)Hire and train more employees and 2) implement a tracking system that ensures and documents that petitions are adjudicated in the order that they are received.
The goal would be to get petitions adjudicated within 4 months tops! If the problem lies in background checks.. then we should evaluate those processes.
This is my specialty... mainlining processes to improve productivity and compliance. See? they should hire me as a consultant! lol

I have a recipe for Melwi if that is what you are looking for.
YUM I love millui. My sisters in law taught me to make it in morocco and now my daughter is addicted to it. I am a millui slave. I can't eat more than 1 piece or I gain 10lbs tho too much carbs

I talked to a man at the consulate this morning and he told me to fax everything I think might help and he will review it. He made it sound as if he knew little about our case because he had to go and get it and said he needed to examine it.

And with the current state of the country's economic situation, I don't think the Immigration System is even in the Top Ten List anymore!
Plus we are a good sourse of income for the gov. We are all in this for at least $1000 ea. plus we support the airlines industry....we are like a cash cow..it's gov. prostitution thats legal! LOL
-
congratulations....wish you a long and happy life together

The burden of proof exists on us to prove our relationship and their right to come. Sort of like a job interview - you have to prove you're the right candidate.
I'm sorry, did you really just go there? Do you have any idea how many of us DID have proof, and they refused to look at it? You really hit a nerve on that one. What a slap in the face to me, Martiniolive, Brnk, Chi, Kiya, etc. You don't know our specifics, so perhaps you should think about that before you accuse people of not being prepared.
Yes it is their job, but they suck at it. How many make it through first time just to leave their spouse at the first opportunity? How many of us that were initially denied are still with their spouse? Go take a look at the divorce forum and you will see how many made it through easy, then after they get their GC all of a sudden their spouse has changed. Coincidence?
Yes their job is a hard one, but if it isn't working they need to face the fact and find a new strategy.
morocco4ever please don't be upset at what she said sweetie, I know what she means by her words and it is too true. You did nothing wrong! I remember when I was getting divorced from the father of my children, he was ruthless and kneww all the strategy's to fight me in court. I was passionate about my freedom and children and fought with tears and pleading and I got nowhere!!!!! It was so painful and humiliating "just like this fight now!!!!!" But than I sucked it up and LOOKED deeply at why he was winning and I always lost and learned "the laws and rules" of the fight in a beurocratic way and I finally got somewhere. This stupid process is so complex we are all like law student who get "slapped down" all the time. I don't know what the solution is but....I know I am thankful to all of you "faceless friends" who are a click away...for all of your help, encouragement, cheer leading, you have picked me up off of the ground more than you know!!!!!!! And when my husband and I are finally together...where ever that will be...we will follow your example and help new people to be strong too...THANK YOUUUUUUUUUUUU!

I swear I thought this yesterday too. In my desperation I told my husband maybe we should put our petition number on VJ and tell everyone to help haha or everyone fax the congress and senators with complaints about the poor and flawed system at the consulate levels. I mean they should have to have a degree in psychology (sp?) or some set rules of what they want from us exactly. I mean if they want notorised papers from witnesses or family..tell us so we do it the first time. Or if they only want a petition after we are together 2+ years...tell us that so we don't even exhaust ourselves! Just tell us what the bleep you want so we do it. They make it so vague on what proof of relationship like it's a cat and mouse game.
I know they want to wead out the faulse petitions but with modern technology why not just use a lie detector? And I think both spouses should be at bthe interview....than they can both be questioned even if seperately.... You knoe they even asked my husband why he did not look for a girl in france or spain or a boy even? What the heck is the point of that? It's about us not his or my choice in a spouse and if he's muslim and I am not what is it to them? If we are cool with it thats all that should matter......It's humiliating.
To be honost I don't feel this consulate is being held to any sorts of standards and then by whom??? I want to know who is in charge of these consulates and what these "Standards are" I've been just steamed over all of this and being there myself tryng to get answers as an American citizen in front of them I am still treated less than American.I was in the service and worked with governement agencies i am amazed or just don't see what the protocal and SOP are.. it appears each consulate is ran on their own SOPs I even tried contacting my pals at DOD these consualtes are the "golden goose" if you will of job placements and yet noone knows anyone in them. Strange
What can we do??? how about getting the person that overseas this consualte and create a petition of those who question their practices and sign it pleading that a oversight counsel be established and an investiagtion done???
Just a name and email is all that's needed.
ok sorry Yvette i am with you girl.

I jokingly told my husband tonight that if I have to go live in morocco I will apply for a job at the consulate.....Can you imagine LOL I am like monica on friends...I could get some stuff done!

Yes I am given new hope and that is good for my spirits...will keep up my efforts

Dear Madam,
Thank you for your follow-up e-mail. This office must conduct further administrative processing in Casablanca before sending your husband’s case to USCIS. We apologize for the delays associated with this case. Unfortunately we have experienced an unexpectedly high volume of cases and we have not processed cases as quickly as we initially anticipated.
Regards,

yes that is what I have been told by so many on these forums so our families and freinds are pouring out thye most beloved letters in a plea for us but congressmans office UHG!!!!!! (woolsey) says that will make no difference....heartless @#$%^!!!! sorry
humm maybe you should look for a lawyer!!! I will see if anyone knows a good lawyer in the SF areaNita
I dont think this is a law, I just found it in a site called findlaw.com
this is what I found interesting An applicant can influence the change of a prior visa denial only through the presentation of new convincing evidence of strong ties.
this pretty much verifies what I am saying I think. Is this a newrule as of julyish or has it been in effect along time?
I found this:Who Can Influence The Consular Officer To Reverse A Decision?
Immigration law delegates the responsibility for issuance or refusal of visas to consular officers overseas. They have the final say on all visa cases. By regulation the U.S. Department of State has authority to review consular decisions, but this authority is limited to the interpretation of law, as contrasted to determinations of facts. The question at issue in such denials, whether an applicant possesses the required residence abroad, is a factual one. Therefore, it falls exclusively within the authority of consular officers to resolve. An applicant can influence the change of a prior visa denial only through the presentation of new convincing evidence of strong ties.

can it be too new a bill to be on the list? Congressmans office said it is very recent and she did not even have all of the facts accept that it gives the consulate power to make a FINAL decision that is not contestable.
is it possible she does not know what she is speaking about? Because i thought they were supposed to be in the know!
Any new law proposal would be published in the Federal Register notices - I see nothing here:http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD
There are always proposals = a few years ago there was a senate bill that wanted to cap family based immigration, but increase employment based - It failed. It's a good idea to keep your ears open about the law, but also good to research what is proposed and what is fact.

221 slip. But she said she was sending the petition back. And the congressmans office read the slip and said the same.
Martini was your husband Denied or put on AP?? was he given a 221g or 214?Nita
I was told today by the congressional office that a new law just passed whereby if a visa even a CR1 is denied (221) at a consulate it is concidered rejected period! No longer can be contested or rebutted at another date....it is just denied! end of story and closed. Please say it isn't so! Does anyone have an attorney they can ask??????? to be sure?this new law is supposed to be in effect imediately as of like july this year.

That we both know of he has not done anything bad. and they gave no reason for the denial and are ignoring us because they are finished with us. The congressmans office said a new law just passed whereby after a denial the petition is just cancelled. No rebuttals...no nothing. I am trying to get a lawyer to verify it. So Sad!!!!!!!!
Unfortunately after speaking with a conressional rep. I was told that as of august the law changed and (she ref'd a simular case as mine she had from august 08) we are no longer allowed to contest the consulates dicission to deny a petition and when they are denied they are no longer rebutable. She said once denyed now they are cancelled peroid! Even a CR1. She said I can wait several mos or years until they get around to telling me it is invalid. Botoom line is it is now perminantly denyed and con not be contested. She says that is the new law and to get an attorney simply so I will know the reson for the denial because only an attorney is legally required to get the information.Carole, is there something else that was brought up in the interview that would permanently deny him entry to US? I guess I'm just not seeing it based upon the Affidavit of Support. Has he done anything in his past that you know of? Overstayed his time in US - which would cause a 10-year ban? Did he misrepresent himself? There are major issues for permanent deniability...such as being a member of a terrorist organization or fraud. Those are the biggies. I am so sorry that you are facing this situation. These are the moments when it is hard to understand the US government.

Carole, I think you're giving up too quick. I know it is good to have a backup plan, but you're not finished yet. Make it work (as Tim Gunn says) - you can do this. You just need to get on the stick with the USEM. Furthermore, you need to learn everything you can about your congressional reps and senators - get them to fight for you on this issue. It can be done.I send you lots of support!
I agree and disagree...lol
I do believe that you always should have a backup plan, but don't give up on the system here yet. You are way to early in the process to make any firm decisions.
How are things going with your representatives? Are they helping? I have heard of some that are useless. When ours was denied I had contacted the senators office. At first the lady was just a big flake and blew us off. That is when I went with the congressman. He was very hard to convince at first that the marriage was real, but once I convinced him he stood by me, although he wasn't quite as aggressive as I would have liked. I had completely given up on the senators office at that point, but after several months I got a phone call from another one of the senators liasons. This one was located in Washington DC. She asked me if the other lady had been of much assistance and I told her no. She took the reins and was very aggressive. She even got the consulate to admit that they had made a mistake in our case, but because the case had already been sent back they couldn't change it. I am sure that is why there was absolutely no questions on his second interview.
The reason I am explaining this is that if your representatives aren't helpful could it be because you haven't convinced them? I hope they are helping, but just keep going. One day at a time.
I am not sure of the process in the UK, but I wouldn't say it will be any easier. My husband had a friend that married a girl from the UK, and they were denied. She ended up pregnant and delivering with him still in Morocco. They accused him of using her for a greencard. She was able to fight them in court and won, and he has been there for 2 years. They have their second child together now. Their timeline was about the same as ours, and their system seemed to be working a little faster, but it was surely no easier. Also if their system is similar to ours then he might have a pretty long wait. For instance, they would have to be a citizen, and for a relative that isn't either mother, father, husband, child, it takes much longer for them to immigrate. Like I stated, that is if their system is like ours.
-
My congressman is recommending that we contact an immigration attorney so they can find out exactly whu our petition was denyed in Casablance morocco. Can anyone give us a good referral?
-
he has no relatives in canada so I do not think he can go there. He has an uncle in London who would sponsor both of us. I have relatives in vancouver tho.
I don't know anything about him getting there and being legal to work -- but I do know that you, the USC, will not have an easy time finding legal work there. I don't know what type of work you do/want to do --- pub work is probably possible, not probably not office work for a company. Unless you currently work for someone who would send you there. The Europeans want us to visit and spend $$ - but not work --- mirrors the US.
Way to think out side of the box. There may be smaller country options that are easier. Have you investigated Canada??

My wife's Social Security Card showed up on Saturday!
Anyone have any updates for the timeline?
Yes my husbands interview was a dismal failure
we are frantically petitioning the consulate, congress etc...to stop from sending hus petition back to the usa and give us another shot...send us luck..martiniolive

My husband and I were discussing all of our backup plans if we don't
get a visa for him to join me in the USA. One idea is that he has
family in the UK and life there for us will be a better choice than
morocco because of english language. He says if his relatives petition
or invite us we can go there. Has anyone done this? we were thinking we
can live (and work) there for a few years until we can maybe come to
the USA together if we still want that eventually. Any ideas?
Will he actually be deported?

How about renting him a room and making him pay his own way........treat him like a roommate till he grows up.
