I was asking about the other biological parent.  Sometimes, they have to provide written consent.....but, like I said, I haven't seen many cases where a child adjusts from a non-immigrant visa alone.  Thanks.

The other parent is still in their home country, they are not together.  I will advise them to seek written consent in case.

The Father didn't petition for an immigrant visa for the child?  Does the other parent have to consent?  I'm asking because I haven't seen many of these cases.

The father became naturalized and is now a USC attempting to petition for his daughter.  This is what I'm asking for assistance with. I was confused with your question because this is what we are trying to do.

Yes you can use the I-864W. The I-765 is just so she can get the Social security # so as EAD card arrives since the approval of the I-485 can take some time. Just nice to have that sooner rather than later.

Here's the addresses of where to file according to where you live.

    Thank you so much.

Also file I-131. You never know when you need it.

For now, I-765 and I-131 are free with I-485.

    Will do, thank you.

Huh?  I'm confused.  The other parent is on board.

  4. Thanks.  She is 15, but I will file the 765 anyway.  Also, being that she is a child of USC, I believe I can do the 864W.  Can someone confirm if I need a full I-864.

I did the I-130 online and will file the receipt with the 485.  Should the package still go to the Chicago lockbox?

I'm sorry if my questions sound basic, but its been so long since I've done this.

  5. yay! so happy she is here and you finally have your family together. Its such a relief to be through the process!

It is! Thanks so much, but now Im having problems with the next process.

For those of you who applied for passports right away, aren't both parents supposed to be present? How did you get past this hurdle? And I do need to wait for the social before I can apply for passport, correct?

  6. Question for you folks whose kids have already arrived: Did their SSNs arrive automatically in the mail? We were under the impression that because we ticked the box on the DS-230, requesting it to be sent that it would be (as it was for my husband), and that is also what we were told at POE.

Last night my husband was reading through the materials sent by the embassy with the visa package and there is a note that it will be automatically sent.... blah blah, UNLESS you are under 18 years old, in which case you have to go to a SS office.

We can certainly go to the office, but it's totally a pain in the butt and half a day wasted if we don't need to. Especially if we get there and they tell us it will be mailed to us.

Good question. Let me know the answer when you figure it out. :)

  7. When my husband went for the interview we got the blue paper and said we could pick up the visa on Friday the 14th. When I checked our cases on CEAC yesterday, it said the visas were ready for pick-up. Today I see this:

Your visa case is currently undergoing necessary administrative processing. This processing can take several weeks. Please follow any instructions provided by the Consular Officer at the time of your interview. If further information is needed, you will be contacted. If your visa application is approved, it will be processed and mailed/available within two business days. Under the U.S. Immigration and Nationality Act, Immigrant Visas for "Diversity Visas" cannot be issued after September 30th of the year in which you were selected to apply for a Diversity Visa. For example, entrants into the Diversity Visa Program in Fall of 2011 were selected for Diversity Visa 2012 Program, and selectees MUST apply and receive their visa prior to September 30, 2012 otherwise they lose eligibility to receive a Diversity Immigrant Visa, regardless of additional administrative processing. In addition, please note that some immigrant visas may not be able to be issued if the annual numerical limit for that category has been reached.

WHAT DOES IT MEAN? Can they switch up and now put us through processing?

After reading this the other day, I checked ceac, and my case still said ready. As in ready for interview. I checked again yesterday and it said Administrative processing, with the same message above. Later yesterday, I checked again and it then said Issued.

I'm sure your status has changed as well by now, since the message says two days for approved visas. Best wishes.

  8. OMG I have been checking all day. Did they ask them any questions? What were they looking for? Thanks. I will update tomorrow. Congratulations.

Nothing much. Who I was to her? "Stepmother"

    Who she lives with? "Grandmother"

    How old she is? "13"

Has she ever traveled to the states before? "No"

They asked us a few other questions like what we did for a living, and he took the original of the notarized letter from her mom. Looked through the pics in the file, an said everything looks to be in order.

  9. Lucy4 and SerenityNOW we are so close. I am still in the U.S. and kinda freaking out waiting praying for all of us. I will post as soon as I know as well. Our interview is 7am local time 11am U.S. time. I think it will be interesting to see what they ask for, what they focus on, so others will know what to expect.

Because the kids are younger we decided not to tell the kids about the interview. We did not want them driving us crazy with "is it time yet". Today we are freaking out so bad we said we would tell them so they could enjoy some of this stress we are feeling. Thought we would spread it around equally.

Good luck to all of us, what I notice is those of us who use visa journey are so well prepared, the CO are usually really impressed with how we present ourselves. At least that was true in my case.

We are soo close. Everyone please cross your fingers and toes for Serenity and myself tomorrow. Can't wait for this to be over.

  10. Serenity,

I will be glad when the interview is over. My husbands ticket was $1400 RT. We will probably be changing it. We scheduled for him to come back in August in case they ask for DNA. If not he is so ready to leave Ghana, he says it is too hot. My husband has finished the medicals and will pick everything up next Thursday. His daughter said they got two shots and looked in her mouth. The kids interview is at 7:30a. When my husband had his interview it was 7:30am. We were interviewed after lunch around 3pm. I will definitely update after they are done. I will be on pins a needles waiting for the outcome. I am praying that they do not ask for DNA. My husband has custody papers from the divorce as well as the fact that these kids have been to an interview before when we applied for and were denied a fiancé visa. We also had applied during the 129F and of course the 130 for my husband was approved at the same time. We did not do the 130 for the kids then. I hope all that amounts to no DNA and quick interview. Good Luck to you and Lucy4

Thanks Evoria. I can't wait for all of this to be over with either. I wish we could get medicals out the way early, but we have to wait til a day or two before the interview.

I just remembered that we had initially listed my stepdaughter on the i129f also, but at the interview at the embassy, they removed her from the process and told us we would be better off with me petitioning her after we were married. We also had several visitors visa applications denied over the past five yrs that we've been married, so her name should definitely raise flags in their system. I hope this helps us as far as not being asked for DNA.
